Gl-7ld A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING CONTRACT MODIFICATION (CHANGE ORDER) NO. 003 TO THE CONTRACT FOR ENVIRONMENTAL SERVICES BETWEEN THE CITY OF REDDING AND FUGRO-McCLELLAND (WEST) , INC. TO PREPARE AN EIR ON THE CLEAR CREEK ROAD SITE FOR THE CITY OF REDDING TRANSFER STATION/RECYCLING FACILITY, AND TO REVIEW PHASE II OF THE ENVIRONMENTAL SITE ANALYSIS BY LAWRENCE & ASSOCIATES (TO BE INCLUDED IN THE EIR) PURSUANT TO ITS PROPOSAL LETTER DATED SEPTEMBER 26, 1991, IN AN AMOUNT NOT TO EXCEED $39,570.00, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTATION. WHEREAS, the City of Redding entered into a Contract for Environmental Services with McClelland Consultants (West) , Inc. on September 6 , 1989 , to prepare an Alternative Site Analysis and Environmental Impact Report for a City-operated Solid Waste Transfer/Recycling Facility; and WHEREAS, on February 6 , 1990 , by Resolution No. 90-84 , City Council approved Contract Modification ( Change Order) No. 001, Job No. 0901-9509, Bid Schedule No. C-2517 , and its attachments in the amount of $10,910.00 for the preparation of a Feasibility Study and EIR for the location of maintenance facilities for the Redding Area Bus Authority; and WHEREAS, on May 15 , 1990 , by Resolution No. 90-220 , City Council approved Contract Modification (Change Order) No. 002, Job No. 0901-9509, Bid Schedule No. C-2517 , and its attachments in the amount of $47 ,054. 46 for the preparation of an additional Feasibility Study on additional acreage at the Viking Way Site and an EIR on the Viking Way Site-in Addition; and WHEREAS, City Council has requested the preparation of an EIR Study on a 40-acre parcel on Clear Creek Road ( adjacent and south of the Redding Power Site) owned by the County of Shasta; and the review of Phase II of the Environmental Site Analysis by Lawrence & Associates ( to be included in the EIR) ; and WHEREAS, staff has reviewed the possibility of soliciting requests for proposal for these additional services ; however, it is believed that delays in this Project will cost substantially more than the potential savings of a lengthy request for proposal process; and WHEREAS, it is also believed that a benefit of having Fugro- McClelland (West) , Inc. perform these additional services is the continuity of the project due to their background knowledge of the Transfer Station Project; and WHEREAS, Fugro-McClelland (West) , Inc. has agreed to provide these additional services at a cost not to exceed $39 , 570 . 00 ; and WHEREAS, funds are available therefor in the Solid Waste Fund; and WHEREAS, presented herewith for Council' s consideration is a Proposal Letter dated September 16, 1991, from Fugro-McClelland (West) , Inc. , together with Contract Modification (Change Order) No. 003 ; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding that: 1. The foregoing recitals are true and correct. 2 . Council believes entering into Contract Modification (Change Order) No. 003 with Fugro-McClelland (West) , Inc. will benefit the City because of its familiarity with the Project; and hereby waives its Policy No. 1501 pertaining to the selection of technical consultants. 3 . Council hereby approves Contract Modification (Change Order) No. 003, Job No. 0901-9509, Bid Schedule No. C-2517, together with the attached Proposal letter and Table 1 dated September 26 , 1991, in an amount not to exceed $39 ,570 .00 , for the preparation of an Environmental Impact Report on the Clear Creek Road Site and the review of Phase II of the Environmental 2 Site Analysis by Lawrence and Associates (to be included in the Environmental Impact Report) . 4. The City Manager of the City of Redding is hereby authorized and directed to sign said Contract Modification (Change Order) No. 003, and its attachments if necessary, on behalf of the City of Redding; and the City Clerk is hereby authorized and directed to attest the signature of the City Manager and to impress the official seal of the City of Redding to said documentation. 5 . A true copy of said Contract Modification ( Change Order) No. 003, of which the Proposal Letter and Table 1 dated September 26 , 1991, are a part, is attached hereto and incorpo- rated herein by reference. As outlined in this proposal, we can prepare the Administrative Draft, Draft, Administrative Final and Final EIR for a cost not to exceed $39,570.00. Included is review and incorporation of a Phase II Environmental Site Assessment (ESA) to be performed by a separate contractor. Following is: our understanding of the project; proposed project approach including work scope and project team members; a description of optional work tasks; and, a cost schedule. Table 1, found at the end of this letter, summarizes the proposed work tasks and cost schedule. UNDERSTANDING OF THE PROJECT The City of Redding General Services Department is requesting preparation of an Environmental Impact Report (EIR)to identify and assess potential environmental impacts and recommend necessary mitigation measures associated with the development of a Solid Waste Transfer Station and Recycling Facility. This report will be prepared consistent with the methodologies and detail contained in the City of Redding Solid Waste Transfer Station/Recycling Facility and Redding Area Bus Authority Central Operations Hub project Final EIR prepared by Fugro-McClelland (April 1991). The current project proposal is for a site located on Clear Creek Road south of the property, commonly known as the. Redding Power Site, in the southeast portion of the city. The current zoning for the site is Unclassified and the General Plan designation is Industrial. U.S. operating companies in California, Louisiana, Missouri, and Texas International operating companies in Australia, Belgium, Brunei, Canada, Germany, Hong Kong, Indonesia, Japan, Malaysia, The Netherlands, Saudi Arabia, Singapore, United Kingdom, and United Arab Emirates. ------ �UGRo 0 McClelland FUGRO-McCLELLAND (WEST), INC. r" . City of Redding Solid Waste Division October 24, 1991 Larry Miralles Page 2 The primary difference between the current proposal and the former project is that a combined transfer station/RABA use is no longer being considered and that the facility would be a cooperative enterprise with the County of Shasta. The facility's conceptual design would remain relatively unchanged compared to the previous proposal. The refuse transfer building itself will be a large industrial-type building with a through depressed roadway, two tipping pads and a common tipping floor designed to accommodate 750 tons per day of refuse. The City's current waste disposal demands are approximately 225 tons per day, while the County's contracted hauler, Anderson Cottonwood Disposal, averages 100 tons per day. The public resource recovery center and recycling center will remain as project features under the current proposal. The proposed site was formerly used for a variety of waste disposal/industrial activities. Residual contamination from these past uses may exist at the site. Consequently, a Phase II ESA is going to be completed by a separate firm. We propose to review and incorporate the findings of this study in the EIR. PROJECT APPROACH As stated above, our project approach will be consistent with that used in preparation of the City of Redding Solid Waste Transfer Station/Recycling Facility and Redding Area Bus Authority Central Operations Hub project FEIR (April 1991). This proposal is for an EIR which will evaluate the site design, engineering, and environmental concerns relating to the project so that the proposed facility would best balance the City and County's needs with local planning policies and environmental concerns. To this end, an EIR will be prepared in compliance with the California Environmental Quality Act (CEQA) as amended and all appropriate State, City and County requirements. General Approach and Data Sources The general approach will include literature and field research to obtain comparable data for all potentially significant impact areas. The primary data source will be the existing EIR (Fugro-McClelland, 1991). This information will be supplemented, where appropriate, with library sources, agency archives, existing studies and data on file with private corporations and public agencies including the City of Redding and County of Shasta. A Phase I ESA will also be prepared for the project by an outside consultant under contract to the City and will be utilized where appropriate when preparing the EIR. oRo 0 McClelland FUGRO-McCLELLAND (WEST), INC. �_n• _ City of Redding Solid Waste Division October 24, 1991 Larry Miralles Page 3 Impacts will be quantified, where possible, and a determination of significance will be made and substantiated based on predefined significance criteria. If available data is inadequate, it may be possible to approximate the impacts through use of available information, combined with a reasonable set of assumptions, to arrive at an answer. If quantification is not possible, a thorough qualitative discussion of the expected impact will be included. This discussion will describe how the project will influence the particular resource category and the basis for the degree of impact. For all impact categories, the discussion will be sufficiently detailed to support a finding on level of significance of impact. This conclusion will be explicitly stated in the body and summary of the EIR along with the justification for the conclusion. Cumulative impacts will be addressed by evaluating the impacts associated with a list of related or similar projects to be provided by the City. The discussion of mitigation measures is among the most important in the report and will receive a significant level of effort. Where possible, the EIR will recommend specific - mitigation measures for potentially significant impacts so that the measures may be incorporated as specific conditions of approval. Because of the conceptual nature of the project, where specific details are not known, mitigation will be presented in the form of performance standards to allow for flexibility in final project design and implementation. An analysis of each measure will include degree of effectiveness, residual and secondary impacts, person/agency proposing measure, responsible parties, and methods of implementation and monitoring. Cost estimates for necessary public improvements which are included in the EIR will only be those provided by appropriate public agencies. Mitigation measures that are clearly infeasible will receive less detailed treatment than more feasible measures. The analysis will place the major emphasis on mitigation measures that could potentially be utilized as conditions for later project approval. Scope and Content The EIR format and scope will be very similar to that used in preparation of the April 1991 FEIR. The following is a summary of the proposed format and scope. The report will begin with an introduction which will briefly describe the subject, format and use of the EIR. The use of CEQA Section 15150 (incorporation by reference) will be dis- cussed. City of Redding Solid Waste Division October 24, 1991 Larry Miralles Page 4 The introduction section will be followed by a separate executive summary including an illustrated project description,discussion of impacts,primary mitigation measures,and summary of project alternatives/sites. The summary will be followed by a thorough project description section and environmental setting section. These sections will be followed by the main section of the EIR, the environmental impact analysis section. The environmental impact analysis for each issue area covered in the EIR will have three subsections: setting, impacts, and mitigation measures. Each issue. evaluated will have an introductory paragraph explaining the methodology used in assessing the impacts. The impact analysis will address both site-specific and cumulative impacts in accordance with the State CEOA Guidelines. The focus of the EIR will be potentially significant issues pertinent to the proposed project and reviewing agencies. It is understood that the scope of work includes an Administrative Draft, Draft EIR,Administrative Final and Final EIR. The report's emphasis will concentrate on the following issues consistent with the previous EIR: • Geologic Hazards • Hydrology and Drainage • Biological Resources • Transportation/Circulation • Air Quality • Noise • Land Use Compatibility • Agricultural Resources • Visual Resources/Light and Glare • Archaeological Resources • Public Utilities (Water and Sewer, Telephone, Electricity and Fuel) • Emergency Services (Police, Fire and medical) • Nuisance (Vectors/Litter/Odor) • Human Health/Risk of Upset Impacts will be quantified, where possible, and a determination of significance will be made and substantiated. Mitigation measures will be identified for each impact. Following the impact analysis section will be other required CEQA sections including irreversible commitments of natural resources and long-term versus short-term impacts on the environment, and the unavoidable effects of growth-inducing impacts. • • ----------- 1mRo ❑ McClelland 27 r1m FUGRO-McCLELLAND (WEST), INC. City of Redding Solid Waste Division October 24, 1991 Larry Miralles Page 5 The EIR will end with a project alternatives section followed by a persons and organizations consulted and report preparers section. The alternatives section will present a summary of those alternatives already studied in previous reports prepared for the project (the March 1990 siting study and April 1991 FEIR). The Final EIR will be of the same format with the exception of a response to comments section to be inserted following the alternatives section. Kickoff Meeting and Project Description One week after contract authorization, an initial kickoff meeting will be held to assist in defining the current project and adjusting the work scope, if necessary. To maximize the utility of the Final EIR and ensure a timely and on-budget completion of the document, it will be essential that an early consensus is reached for several key project details. Most importantly, any changes from the former project and or new project components to be addressed need to be identified and described. To this end, specific topics to be discussed at the kickoff meeting include site design and layout as well as the County's involvement with the project. At the meeting, Fugro-McClelland will present a draft project description based on our understanding of the current proposal and information contained in the April 1991 FEIR. This preliminary project description will be reviewed in detail at the kickoff meeting by all parties in attendance to assure the project is properly defined. Our work scope assumes that sufficient detail will be provided by the existing project description and that the City will provide a draft conceptual site plan which will preliminarily serve as the basis for impact assessment. Fugro- McClelland's primary role in project description development will be in assimilating the new pertinent information for presentation in the EIR. Based on preliminary environmental analysis, the preliminay site plan could then be modified slightly in response to constraints identified. Immediately following the kickoff meeting,preparation of the Administrative Draft EIR will commence. Within one week following the kickoff meeting, a revised project description will be presented to the City for final review and approval. Following this approval, any significant changes to the project description may require a change in scope and contract renegotiation. Minor changes, which do not result in an appreciable change in the work effort, are acceptable and will be completed gratis. -- UNG 91 McClelland FUGRO-McCLELLAND (WEST), INC. City of Redding Solid Waste Division October 24, 1991 Larry Miralles Page 6 Deliverables and Scheduling Five copies of the Administrative Draft EIR will be delivered approximately 12 weeks after contract authorization. Within two weeks following review of the Administrative Draft EIR by the City, the Draft EIR will be prepared, incorporating comments and/or corrections, and 25 copies will be delivered to the City. Fifteen working days after receipt of all comments on the Draft EIR, two copies of the Administrative Final EIR will be submitted to the City for review and comment. A maximum of 20 issue responses will be completed as a part of the fixed price bid. Additional work, if required, will be negotiated on a time and materials basis. Within 5 working days of receipt of all City comments on the Administrative Final, the Final EIR will be prepared, incorporating comments and/or corrections, and 25 copies, one (1) camera-ready copy, and a set of floppy disks will be delivered to the City. Meetings A total of 48 hours of professional time has been budgeted for meetings/hearings. A kickoff meeting will be scheduled at the outset of the project. During the 45-day public review period for the Draft EIR, two public hearings held by the Planning Commission can be attended upon request. Should the need arise, time for one additional unscheduled meeting is also included in the project budget. Project Team Members The Fugro-McClelland project team assembled for this proposal brings together the resources and background of two firms, combining the expertise of land use/environmental planning(Fugro-McClelland)and full-service traffic and transportation planning(Pacific Traffic and Transportation Engineers). The key personnel of the project team, Chris Stabenfeldt and Mark Morse, are familiar with the local conditions and issues surrounding this project. All project EIR personnel, with the exception of Jeffrey Clark of PacTrans, are located in the Sacramento office of Fugro-McClelland. Chris Stabenfeldt will act as Project Director for the study. Mr. Stabenfeldt is Manager of Environmental and Planning Services for the Sacramento office. As Project Director, Mr. Stabenfeldt will be responsible for contract matters, provide senior level direction of project activities, and provide quality assurance/quality control. 11 McClelland FUGRO-McCLELLAND (WEST), INC. City of Redding Solid Waste Division October 24, 1991 Larry Miralles Page 7 Mark Morse, Environmental Planner, will act as Project Manager for the project. Mr. Morse holds a Bachelor of Arts degree in Environmental Studies with a minor in City and Regional Planning from the University of California, Santa Barbara, and has public and private sector experience in both the planning and environmental impact analysis fields. Mr. Morse will act as the principal investigator/liaison and will conduct the day-to-day management of the project for Fugro-McClelland. Mr. Morse will also prepare the Air Quality, Land Use, Agricultural Resources and Nuisance sections of the EIR. Richard Meredith, Senior Environmental Scientist, will provide biological and wetlands expertise to the project team and will prepare the Biological Resources section of the EIR. Mr. Meredith has more than 10 years experience as a biologist/project manager on federal public works, military, and regulatory programs. James Robinson will be the Environmental Geologist assigned to the project team. Mr. Robinson will prepare the Geology and Hydrology/Drainage sections of the EIR. Tamara Mihm, Environmental Scientist, will prepare the Emergency Services and Cultural Resources sections. Ms. Mihm holds a Bachelor of Science degree in Environmental Policy Analysis and Planning, with an emphasis in Water Quality, from the University of California, Davis. Jeanie Shepard, Environmental Planner/Landscape Architect, will be assigned the Visual Resources section. Ms. Shepard has extensive experience in conducting visual analyses and has participated in the preparation of numerous environmental studies for projects throughout California. In addition, Ms. Shepard has over seven years of experience as a landscape designer with design experience in office and retail developments, parks, private living communities, and custom residential homes. Ms. Shepard is a candidate for a Master's Degree in Urban Planning from Cal Poly San Luis Obispo. Wesley Ingram, Senior Environmental Scientist, will be assigned the Noise section and would conduct the Fiscal study as an optional work task. Since joining Fugro-McClelland's staff in 1990, Mr. Ingram has participated in the preparation of fiscal analyses for numerous environmental studies. Prior to joining Fugro-McClelland, Mr. Ingram was an Environmental Resources Planner with the U.S. Army Corps of Engineers. He has experience in public policy analysis and research. Mr. Ingram has a Master of Arts degree in English from Washington State University and is a Ph.D. candidate in Environmental Policy Analysis at the University of California at Davis. mon 0 McClelland FUGRO-McCLELLAND (WEST), INC. City of Redding Solid Waste Division October 24, 1991 Larry Miralles Page 8 The transportation/circulation and traffic analysis will be prepared by Jeffrey E. Clark, P.E., Principal of Pacific Traffic and Transportation Engineers (PacTrans). PacTrans is a Sacramento Valley-based engineering consultant firm providing a wide range of traffic engineering and transportation planning services including traffic impact analysis and transportation modeling evaluation; traffic signal evaluation and design; freeway interchange analysis; roadway plan line and analysis; traffic safety studies and traffic control device inventories; and parking lot design and analysis. PacTrans principals have provided consultant services to numerous state and local authorities, as well as clients in the private sector and have experience coordinating work efforts with civil engineering, land use, planning, architectural and environmental analysis firms. Jeffrey E. Clark, P.E., has more than 10 years of experience in the preparation of traffic impact studies and transportation modeling projects. He has directed and served as project engineer for major traffic impact studies in Vacaville, Sacramento, West Sacramento, Del Norte County, Chico, El Dorado County and Stockton and conducted smaller projects throughout California and Nevada. He has conducted traffic impact studies for major residential subdivisions, planned communities, commercial developments and industrial/office developments as well as transportation system management plans, safety studies, geometric design, and traffic signal/system projects. OPTIONAL WORK TASK Fiscal Impact Study At the request of the City, a fiscal impact study can also be completed for the project. The fiscal analysis would present a relative cost comparison of implementing the project at the Redding Power Site compared to the previously studied Viking Way and Eastside Road sites. A general discussion of the economic consequences of adding the County waste stream to the facility would be included in this study. COST AND OFFER Fugro-McClelland (West), Inc. will prepare the Environmental Impact Report (EIR) for the project in accordance with our proposed scope of services, for a fee not to exceed $39,570.00. Table 1 is a detailed breakdown of the proposed costs by major work item. The not-to-exceed cost includes preparation of the Administrative Draft,Draft,Administrative Final and Final EIR. A contingency of $4,000.00 (10%) is recommended to allow flexibility in the event of additional work requirements. The proposed scope of services and associated costs are fully negotiable to meet the requirements of the City. It should be noted that the cost for responding to comments is intended for addressing issues within the scope of work presented here. Any deviations from this scope requiring additional research or analysis will necessitate renegotiation. Additional work, not included within our proposed work program, will be completed upon City authorization, in accordance with our "Standard Fees and General Conditions." You should note that the fee indicated above pays for our professional services and does not provide for insuring the entire project. Therefore, because of the limited nature of our fee relative to the value of this project, it is necessary that we limit the extent of our professional liability as described in the General Conditions for Professional Services, paragraph 4, attached. Fugro-McClelland prefers a monthly billing schedule. Ten or 20 percent could be retained by the City until completion of the Final EIR for security. This method of billing allows reimbursement commensurate with cost incurred as typically 50-75 percent of the expense occurs during preparation of the Administrative Draft EIR. We are flexible on billing methods and would be available to discuss a mutually acceptable payment schedule. This offer for professional services will remain in effect for a period of 90 days from the date of the proposal. During this period, questions regarding our proposed scope of services may be directed to Mr. Chris Stabenfeldt, Project Director and Manager of Environmental and Planning Services, or Mark Morse, the Project Manager assigned to this project.
