A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE FIRST AMENDMENT TO LEASE BETWEEN THE CITY OF REDDING AND LANDON LEFFLER, DOING BUSINESS AS AIRPORT BUS SERVICE, FOR THE ADDITION OF TWO AUTOMOBILE PARKING SPACES AT REDDING MUNICIPAL AIRPORT. IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: 1. That the City Council of the City of Redding hereby approves the First Amendment to Lease between the City of Redding and Landon Leffler, dba Airport Bus Service, a true copy of which is attached hereto and incorporated herein by reference. 2. That the Mayor of the City of Redding is hereby authorized and directed to sign said First Amendment to Lease on behalf of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding thereto. 3. That the City Manager of the City of Redding is hereby authorized and directed to sign all future amendments to said Lease, if any, on behalf of the City of Redding; and that the City Clerk is hereby authorized and directed to attest the signature of the City Manager and to impress the official seal of the City of Redding on said amendments, when appropriate. RAYS, q1ty Attorney F=RST AMENDMENT TO t.Fp►SE THIS FIRST AMENDMENT TO LEASE is made and entered into by and between the CITY OF REDDING, a Municipal Corporation, of 760 Parkview Avenue, Redding, California 96001-3396 , hereinafter called "LESSOR," and LANDON LEFFLER, DOING BUSINESS AS AIRPORT BUS SERVICE, 1620 E. Cypress Avenue, Redding, California 96002, hereinafter called "LESSEE" : W I T N E S S E T H: WHEREAS, LESSOR and LESSEE entered into a Lease dated May 8, 1991 , for the purpose of operating an Airport bus ground transportation service activity from within the Municipal Airport Passenger Terminal Building; and WHEREAS, LESSEE has requested two automobile parking spaces for the exclusive use of OPERATOR near the Passenger Terminal, as depicted in Exhibit "B" attached hereto and incorporated herein by reference, to which LESSOR has agreed; and WHEREAS, LESSOR and LESSEE wish to amend said Lease pursuant to the terms and conditions of this First Amendment to Lease; NOW, THEREFORE, it is agreed by and between the parties hereto as follows: 1 . Effective November 1, 1991 , paragraph 1 of said Lease is hereby deleted, and the following substituted therefor: 1. DESCRIPTION OF PREMISES. The parties acknowledge that LESSOR owns, maintains, and operates the Redding Municipal Airport, and that LESSEE desires to use a portion of said Airport for the purpose of operating an Airport bus ground transportation service activity from within the Passenger Terminal building. Therefore, LESSOR hereby leases to LESSEE and LESSEE hires from LESSOR: 1) that part of the Redding Municipal Airport Passenger Terminal building depicted in Exhibit "A" attached hereto and incorporated herein by reference; and 2) two automobile parking spaces near said Passenger Terminal building as depicted in Exhibit "B" attached hereto and incorporated herein by reference; (hereinafter collectively called "Premises") , upon the terms and conditions and for the compensation set forth below. 2. Effective November 1 , 1991 , paragraph 6a of said Lease is hereby deleted, and the following substituted therefor: 6. FEES AND CHARGES. a. LESSEE will pay to LESSOR for the privileges herein granted a monthly rental of Eighty-three Dollars ($83.00) which is comprised of the following fees and charges: i. The sum of Thirty-nine and 06/100 Dollars ($39.06) for its Terminal space fee, based on 36 square feet of area as depicted in Exhibit "A" attached hereto. ii. The sum of Eighteen and 90/100 Dollars ($18.90) for its proportional share of the Terminal maintenance and operational costs and for the area depicted in Exhibit "A" attached hereto. "Maintenance and operational costs" provided by LESSOR are defined as electrical, air conditioning, heating, water, garbage, and janitorial services for the shared public areas; LESSEE is to pay for all other utilities required in its operations. iii. The sum of Five and 04/100 Dollars ($5.04) for its proportional share of Terminal security costs. iv. The sum of Twenty Dollars ($20.00) for the two automobile parking spaces ($10 each) as depicted in Exhibit "B" attached hereto. 3 . All other terms and conditions of said Lease dated May 8 , 1991 , shall remain in full force and effect. IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to Lease in the presence of their respective officers duly authorized in that behalf on the days and year set forth below.
