RESOLUTION NO. 91-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE AMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF SHASTA, THE CITY OF REDDING, THE CITY OF ANDERSON, AND THE ECONOMIC DEVELOPMENT CORPORATION OF SHASTA COUNTY. IT IS HEREBY RESOLVED that the City Council of the City of Redding hereby approves the Amendment to Memorandum of Understanding entered into between the County of Shasta, the City of Redding, the City of Anderson, and the Economic Development Corporation of Shasta County, a true copy of which is attached hereto and incorporated herein by reference. BE IT FURTHER RESOLVED that the Mayor of the City of Redding is hereby authorized and directed to sign said Amendment on behalf of the City of Redding; and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding thereto. AMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF SHASTA, THE CITY OF R.EDDING, THE CITY OF ANDERSON, AND THE ECONOMIC DEVELOPMENT CORPORATION OF SHASTA COUNTY LEGAL AUTHORITY The County of Shasta, the City of Redding, and the City of Anderson hereinafter known as the "applicants" , intend to jointly propose the designation of portions of their respective jurisdictions as a state enterprise zone pursuant to Section 7073 of the California Govern- ment Code for the purpose of stimulating new employment and invest- ment in economically depressed areas of their respective juris- dictions. The area proposed for such designation is shown on the map attached to and made a part of this agreement. It is the intention of the applicants to submit a joint application to the California Department of Commerce for enterprise zone desig- nation pursuant to California Government Code Section 7073 and Administrative Code Sections 5601 - 5636. BACKGROUND The Enterprise Zone Program has designated ten areas of California for a fifteen year period as enterprise zones. Recent legislation has provided for the designation of an additional fifteen areas as enterprise zones, and the State of California has agreed to provide certain incentives to businesses located within these areas as specified in Sections 17052. 13 , 17053 . 8 , 17053 .9 , 17231, 17252 . 5 , 17276. 5 , 23612, 24331, 24333 , 24356. 2 , 24384, and 24417 of the California Revenue and Taxation Code for the purpose of stimulating new investment and employment in said areas. It is the intention of the applicants to seek conditional designa- tion from the California Department of Commerce of a proposed enterprise zone based upon the applicants ' proposal to the Depart- ment which will commit the applicants to provide effective, innova- tive, and comprehensive, regulatory, tax, program, and other incen- tives to attract private sector investment to the proposed zone. STATEMENT OF PURPOSE The County of Shasta, the City of Redding, the City of Anderson, and the Economic Development Corporation of Shasta County enter into this agreement for the purpose of assuring their mutual and common understanding of the intent of each party to use their best efforts, subject to the continued availability of financing, to continue and complete long term programs and projects to attract private sector investment to the area proposed for designation. i r Amendment to Memorandum of Understanding Between the County of Shasta, the City of Anderson, the City of Redding, and the Economic Development Corporation of Shasta County - Enterprise Zones Page 2 OBJECTIVES It is mutually agreed that: 1 . The County of Shasta, the City of Redding, and the City of Anderson will each provide staff support to administer pro- grams , projects, or incentives provided by their respective jurisdictions within the area proposed for designation. The staff of each jurisdiction will coordinate those economic and business development activities related to the designated enterprise zone through the Shasta County Economic Development Corporation (hereinafter known as the coordinating agency) . As a part of this effort, the staff of the County and each City will cooperate with the coordinating agency to work with existing and prospective new businesses to explain the incen- tives , programs , and projects which may benefit the business , and to identify serious unmet needs or problems facing said businesses. In the event staff identifies a need for financial or job training assistance on the part of a business , the staff person will refer the business to the coordinating agency to arrange action by an entity or agency designated to provide such services. 2. There is hereby established an Enterprise Zone Policy Board consisting of one representative from the County of Shasta, the City of Redding, the City of Anderson, the Economic Development Corporation of Shasta County, and the Private Industry Council, and a sixth member to be selected at large by the other five members. The Enterprise Zone Policy Board shall review and monitor the progress and activities of the zone, and shall make such recommendations thereon as it deems appropriate to the applicants. 3 . The Shasta County Economic Development Corporation will func- tion as the coordinating agency in marketing and promoting the area proposed for designation to businesses and developers ( including both those businesses and developers currently operating within the designated area, and those interested in locating within the designated area at some future time) . The Shasta County Economic Development Corporation covenants to provide print advertising, print materials, and other promo- tional activities as needed and feasible, subject to the continued availability of funding from Shasta County, City of Redding and City of Anderson, and such other sources of revenue as may be available to the Economic Development Corporation of Shasta County. 4. To supplement such sources of revenue as are, or may become, available to the Economic Development Corporation of Shasta County, the parties to this Memorandum of Understanding agree Amendment to Memorandum of Understanding Between the County of Shasta, the City of Anderson, the City of Redding, and the Economic Development Corporation of Shasta County - Enterprise Zones Page 3 to share the costs of marketing and promoting the enterprise zone ( including such costs as may be engendered in preparing the preliminary and final applications for designation, and the environmental processes required under the California Environ- mental Quality Act) on the basis of proportion of each agency' s industrial and commercial acreage which is included in the proposed zone. It is further agreed that the City of Redding' s share of costs is thereby established at 60.7%, the County of Shasta' s at 32 . 50, and the City of Anderson's at 6. 8%. 5 . This Memorandum may be amended only by the mutual agreement of all parties in writing. This Memorandum, and any amendments thereof, shall remain in effect until terminated. IN WITNESS WHEREOF, the Parties agree to have executed this Amend- ment to the Memorandum on this 3rd day of September, 1991. This Amendment shall become effective upon the execution of it by all parties.
