A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING AND AUTHORIZING THE MAYOR TO SIGN THE
CONSULTING AGREEMENT BETWEEN THE CITY OF REDDING AND
ROBERT D. HASTINGS FOR ENGINEERING SERVICES FOR THE
SOLID WASTE DIVISION.
IT IS HEREBY RESOLVED by the City Council of the City of
Redding as follows:
1. That the City Council of the City of Redding hereby
approves the Consulting Agreement between the City of Redding and
Robert D. Hastings, a true copy of which is attached hereto and
incorporated herein by reference.
2 . That the Mayor of the City of Redding is hereby
authorized and directed to sign said Agreement on behalf of the
City of Redding; and that the City Clerk is hereby authorized and
directed to attest the signature of the Mayor and to impress the
official seal of the City of Redding on said Agreement when
appropriate.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 6th day of August , 1991, and was duly
adopted at said meeting by the following vote:

CONSULTANT AGREEMENT
THIS AGREEMENT is made and entered into effective July 1,
1991 , by and between the CITY OF REDDING, a Municipal Corporation
and General Law City, hereinafter referred to as "City," and
ROBERT D. HASTINGS, 1906 Bechelli Lane, Redding, California
96002 , hereinafter referred to as "Consultant" ;
W I T N E S S E T H:
WHEREAS, Consultant retired from the City as an Associate
Civil Engineer; and
WHEREAS, during his employment with City, Consultant
provided 20 years' engineering services for the Solid Waste
Division; and
WHEREAS, City has need of and desires the historical
continuity and experience in Solid Waste activities which
Consultant can provide; and
WHEREAS, Consultant is ready and willing to provide such
service for as long as City requires the same;
NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the
parties hereto as follows:
1. Consultant shall perform engineering services for City
through its General Services Department, Solid Waste Division,
under the direction of the City Manager of City, or his designee,
on an as-needed-basis commencing July 1, 1991 . Said services
shall include, but not be limited to, the following:
* Engineering Estimates. Update various estimates
pertaining to the transfer station—site acquisition,
design, construction, etc.
* Transfer Station Design. Prepare a Request for
Proposal for a design engineer; assist in evaluating
proposals, awarding the project for design, and
monitoring the design.

* Transfer Station Construction. Assist in evaluating
the proposals, awarding the contract, monitoring the
project, and any related unknown tasks.
2 . This Agreement shall continue in full force and effect
until the 30th day of June, 1992, or until such time as the
compensation hereunder has been expended, unless written notice
of any change in the terms hereof or of termination shall be
given by either party thirty ( 30) days prior to said change or
termination.
3 . It is anticipated that Consultant will perform services
on behalf of City on an as-needed-basis. The compensation to be
paid to Consultant for the authorized services to be performed by
him is the sum of Fifty Dollars ( $50 . 00) per hour. In no event
shall the total compensation to be paid Consultant under this
Agreement exceed Five Thousand Dollars ($5 ,000.00) .
4 . City shall provide Consultant with secretarial and
technical services from the staff of the City General Services
and Public Works Departments , and transportation, as required.
5. This Agreement is granted upon the express condition
that City shall be free from any and all liability and claims for
damages for personal injury, death, or property damage in any way
connected with Consultant' s services to be performed hereunder,
including claims of Consultant. Consultant shall indemnify and
save harmless the City, its officers, agents, and employees, from
any and all liability, loss, cost, or obligation on account of or
arising out of any such injury, death, or loss caused by the
negligence or other legal fault of Consultant.
6 . This Agreement does not constitute a hiring of
Consultant by City. It is understood and agreed between the
parties hereto that Consultant, in carrying out the services to
be performed hereunder, is acting as an independent contractor
and not as an employee of the City of Redding.
7 . Either party may terminate this Agreement at any time
upon thirty ( 30) days' written notice to the other party.
8 . Any notices or demands that may be given by either

party hereunder shall be deemed to have been fully and properly
given when made in writing, enclosed in a sealed envelope, and
deposited in the United States Post Office, certified mail,
postage prepaid, addressed as follows: To City c/o City Manager,
760 Parkview Avenue, Redding, California 96001-3396; and to
Consultant at 1906 Bechelli Lane, Redding, California 96002.
9 . It has been determined that this matter is not subject
to the provisions of the California Environmental Quality Act.
IN WITNESS WHEREOF, the parties hereto have hereunto
executed this Agreement on the day and year set forth below.
