A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
AUTHORIZING CONTINUING IN THE LITIGATION PROCESS AND THE. COST
SHARING OF LITIGATION EXPENSES IN THE MATTER OF THE CITY OF
SANTA CLARA V. JAMES D. WATKINS.
WHEREAS, the City of Redding has been involved in the lawsuit
entitled Santa Clara v. Watkins since its inception in 1975; and
WHEREAS, the case is of significance to the City of Redding in
that the federal government, through the Western Area Power
Administration, has taken the position that a portion of the allo-
cation of federal energy to the City of Redding is withdrawable;
and
WHEREAS, if the federal government' s position is sustained,
they would be able to reduce the amount of energy delivered to the
City of Redding which would result in the City being required to
buy additional energy from higher priced sources; and
WHEREAS, the Cities of Roseville, Redding, Palo Alto, Biggs,
Gridley, and the Plumas-Sierra Rural Electric Cooperative (REC)
have joined together in the litigation and have been successful in
preventing Western from being able to withdraw energy; and
WHEREAS, the law firm of Goldberg, Fieldman & Letham has been
relied upon to pursue the federal court arguments in a cost-sharing
arrangement between the above-mentioned Cities and REC; and
WHEREAS, it is in the best interests of the City of Redding to
continue as a party to the litigation through its conclusion in

order to ensure that the City receives from the federal government '

its maximum contract rate of delivery; CX

NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Redding authorizes continuing in the litigation process and
the cost-sharing arrangement of expenses between the City of
Redding and others involved in the City of Santa Clara v. James D.
Watkins litigation.
I HEREBY CERTIFY that the foregoing Resolution was introduced
and read at a special meeting of the City Council of the City of
Redding on the 30th day of July, 1.991, and was duly adopted at said
meeting by the following vote:
