A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
ORDERING FORMATION OF TERRITORY INTO A LANDSCAPE
MAINTENANCE ASSESSMENT DISTRICT, TO BE KNOWN AS
LANDSCAPE MAINTENANCE DISTRICT NO. 17, AND AUTHORIZING
PROCEEDINGS FOR THE LEVY AND COLLECTION OF ASSESSMENTS
THEREIN PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF
1972.
WHEREAS, on September 17 , 1990, a Petition and Consent for
the Formation of Territory into a Landscape Maintenance District
and to the Levy and Collection of Assessments Therein Pursuant to
the Landscaping and Lighting Act of 1972 signed by the owner of
the land as shown on the last equalized County assessment roll,
or entitled to be shown as owner on the next County assessment
roll, or, where any of said property is subject to a recorded
written agreement of sale, are shown therein as purchaser, of all
of the territory more particularly hereinafter described, was
filed with the City Clerk of the City of Redding, pursuant to the
Landscaping and Lighting Act of 1972, Division 15, Part 2
(commencing with Section 22500) , of the Streets and Highways Code
of the State of California, and especially Section 22608.1
thereof; and
WHEREAS, said Petition and Consent consented to said
Council' s conduct of said proceedings without notice and hearing
and without the filing of an Engineer' s Report, all in accordance
with said Act and especially Section 22608. 1 thereof; and

WHEREAS, proof satisfactory to Council of such Consent by
the owner of the property within said territory, together with an
Engineer' s Report ( although waived) , has been filed with the City
Clerk of City;
NOW, THEREFORE, IT IS FOUND, DETERMINED, and ORDERED as
follows:
1 . Said Petition and Consent for the Formation of
Territory into a Landscape Maintenance District and to the Levy
and Collection of Assessments Therein Pursuant to the Landscaping
and Lighting Act of 1972 was signed by the owner of the land as
shown on the last equalized County assessment roll, or entitled
to be shown as owner on the next County assessment roll, or,
where any of said property is subject to a recorded written
agreement of sale, is shown therein as purchaser.
2 . The territory proposed to be formed into a Landscape
Maintenance District is described as follows:
All of that certain real property situate in the City of
Redding, Shasta County, California, being:
( 1) Lots 1 through 12 inclusive of College Highlands
Subdivision, Unit 1, as shown on the map recorded
April 19, 1990 , in Book 19 of Maps at page 68, Shasta
County Records (previously APN 72-12-16) ;
( 2) Lots 1 through 22 inclusive of College Highlands
Subdivision, Unit 2, as shown on the map recorded
October 9, 1990, in Book 20 of Maps at page 7 , Shasta
County Records (previously APN 72-12-16) ; and
( 3) All remaining lands of the College Highlands
Subdivision, hereinafter referred to as "Remainder
Parcel (R1) " (APN 72-12-16) .
3 . The formation of said territory into a Landscape
Maintenance District and the authority of this Council to levy

and collect assessments therein pursuant to said Act are hereby
approved without notice and hearing, pursuant to Section 22608.1
of said Act.
4. That the Report of the Engineer ( although waived) , on
file with the City Clerk, contains a full and detailed
description of the improvements, the boundaries of the proposed
District, and the proposed assessments upon assessable lots
within the proposed District. Said Report is hereby approved by
Council.
5 . Said territory be and hereby is ordered formed into a
Landscape Maintenance District for the installation or
construction of improvements and the maintenance or servicing, or
both, thereof, together with any and all incidental expenses in
connection therewith, all as more particularly authorized
pursuant to said Act, and shall hereafter be designated as
"LANDSCAPE MAINTENANCE DISTRICT NO. 17," by which name it shall
hereafter be referred to in all subsequent proceedings, including
proceedings for the levy and collection of assessments.
6. That proceedings shall be taken by this Council
pursuant to said Act for any fiscal year during which an
assessment is to be levied and collected within said District.
7 . That a public hearing will be held on Tuesday,
August 6, 1991, at the hour of 7 :00 p.m. , or as soon thereafter
as the matter may be heard, at the City Council Chambers located
at 1313 California Street, Redding, California, to address the
levying of the proposed assessment for the fiscal year 1991-92 .

8. The City Clerk of the City of Redding is hereby
authorized and directed to:
(a) file a certified copy of this Resolution, together with
a map of said District, with the Auditor of Shasta
County; and
(b) record a certified copy of this Resolution, together
with a map of said District, with the Assessor/Recorder
of Shasta County.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 16th day of July , 1991, and was duly
adopted at said meeting by the following vote:
