S-5-89 UNIT 2,FILED MAY 15, 1990 IN BOOK 19 OF MAPS, PAGE 75, SHASTA COUNTY RECORDS (ABANDONMENT APPLICATION A-2020-01670) WHEREAS: A. The 10 foot wide Storm Drain Easement being considered for summary vacation was acquired by the recordation of Highland Oaks Subdivision No. S-5-89 Unit 2, filed on May 15, 1990 in Book 19 of Maps, Page 75, Shasta County records and is described in Exhibit "A" and shown on Exhibit"B"attached and made a part hereof by reference. B. Facilities within the 10-foot wide Storm Drain Easement are private,therefore the Easement may be determined to be excess and eligible for summary vacation. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. 2. The City Council approves the request to summarily vacate the 10 foot wide Storm Drain Easement as described in Exhibit"A"and shown hatched on Exhibit"B." 3. The easement being vacated is considered excess; therefore, from and after the date this Resolution is recorded,the Storm Drain Easement described in Exhibit"A"and shown on Exhibit "B," shall be vacated in its entirety and longer constitutes an easement for public purposes. 4. The vacation of the Storm Drain Easement is consistent with the General Plan and qualifies as Categorically Exempt from environmental review under the California Environmental Quality Act Guidelines Section 15312 and 15061. The easement was acquired by dedication to the City for storm drain purposes. There are no environmental attributes to the property underlying the storm drain easement which would merit preparation of a mitigated negative declaration or environmental impact report. The underlying property does not have significant values for wildlife habitat or other environmental purposes and is of such size and shape that is incapable of independent development or use. The property underlying the storm drain easement has not changed since the time of its acquisition by the City. As such, there is no possibility that vacation of the storm drain easement will have a significant impact on the environment. 5. The City Clerk is directed to cause a certified copy of this Resolution of Vacation, attested by the Clerk under seal,to be recorded in the Office of the Shasta County Assessor/Recorder.
