A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PORTION OF A 15-FOOT UTILITY
EASEMENT OF RECORD PER 1195 O.R. 171 AS SHOWN ON THE
FINAL MAP OF THE RIDGECREST UNIT 2 CONDOMINIUM
SUBDIVISION NO. S-7-89.
WHEREAS, a 15-foot utility easement was granted to the City
of Redding by way of Easement recorded under No. 21613 on
October 24, 1973, in Volume 1195 at page 171 of Official Records
of Shasta County; and
WHEREAS the City of Redding water line and sanitary sewer
have been removed from the 15-foot utility easement and realigned
to coincide with the development of the Ridgecrest Condominium
Development; and
WHEREAS, utility easements for the new sanitary sewer and
water lines have been dedicated to the City of Redding as part of
the Ridgecrest Unit 2 Condominium Subdivision Map No. S-7-89 ; and
WHEREAS, the portion of the 15-foot utility easement that
has been superseded by relocation is described in Exhibit A and
shown on Exhibit B attached hereto and incorporated herein by
reference; and
WHEREAS, staff has advised that there are no other public
facilities located within said 15-foot utility easement; and
WHEREAS, the Public Works Department of the City of Redding
has duly investigated the proposed abandonment of that portion of
the 15-foot utility easement described in Exhibits A and B

attached hereto, and has advised the City Council that there is
no indication that said portion of the utility easement will ever
be required; and
WHEREAS, it is, therefore, believed by and appears to the
City Council of the City of Redding that the portion of the 15-
foot utility easement described above and shown on Exhibits A and

B attached hereto is no longer necessary; and
WHEREAS, the City Council of the City of Redding elects to
proceed in this matter under the provisions of the Public
Streets, Highways, and Service Easements Vacation Law as the same
is set forth in Section 8300, et seq. , of the Streets and
Highways Code of the State of California;
NOW, THEREFORE, the City Council of the City of Redding
hereby resolves and orders that:
1. The above recitals are true and correct.
2. That portion of the 15-foot utility easement described
in Exhibit A and shown on Exhibit B attached hereto and
incorporated herein by reference is no longer necessary and is
hereby vacated.
3 . The City Clerk of the City of Redding be and hereby ,is
directed to record a certified copy of this Resolution, attested
to by the City Clerk under seal of the City of Redding, in the
office of the Shasta County Assessor/Recorder.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 2nd day of July , 1991, and was duly
adopted at said meeting by the following vote:

NOES: COUNCIL MEMBERS: None
