HomeMy WebLinkAboutReso 91-257 - Declaring its intention to abandon a 33' by 300' section of Twin View Blvd right of way adj to 955 Twin View Blvd between State hwy 273 & I5 (A-4-91) RESOLUTION NO. 91- Z s 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING ITS INTENTION TO ABANDON A 33-FOOT BY 300- FOOT SECTION OF THE TWIN VIEW BOULEVARD RIGHT-OF-WAY ADJACENT TO 955 TWIN VIEW BOULEVARD (ON THE EAST SIDE OF TWIN VIEW BOULEVARD BETWEEN STATE HIGHWAY 273 AND INTERSTATE 5) (A-4-91) 0 WHEREAS, certain real property, namely a 33-foot by 300-foot section of the Twin View Boulevard Right-of-Way adjacent to 955 Twin View Boulevard (on the east side of Twin View Boulevard between State Highway 273 and Interstate 5) as described in Exhibit A attached hereto and incorporated herein by reference, has been heretofore dedicated to the City of Redding, as the same is set forth on a map and/or plan on file in the office of the I City Clerk of the City of Redding, which right-of-way is more particularly shown on the maps attached hereto and incorporated herein by reference; and WHEREAS, it is believed by and it appears to the City Council of the City of Redding, subject to the conditions herein- after set forth, that the 33-foot by 300-foot section of the Twin View Boulevard Right-of-Way adjacent to 955 Twin View Boulevard (on the east side of Twin View Boulevard between State Highway 273 and Interstate 5 ) , as described in Exhibit A and shown on the attached maps, is not necessary; and WHEREAS, the Director of Public Works of the City of Redding I has duly investigated the proposed abandonment of said portion of I street right-of-way, and has advised the City Council that, isubject to the conditions hereinafter set forth, there is no indication that it will be required in the future; and ��}} WHEREAS, the Planning Commission of the City of Redding has -�lJ held a public hearing regarding the abandonment of the above- described portion of Twin View Boulevard Right-of-Way, and at the conclusion of said hearing has recommended that said portion of 211 street right-of-way, as described in Exhibit A and shown on the attached maps, be abandoned, subject to the conditions hereinafter set forth; and WHEREAS, the City Council of the City of Redding elects to proceed in this matter under the provisions of the Public Streets, Highways, and Service Easements Vacation Law as the same is set forth in Section 8300 , et seq. , of the Streets and I Highways Code of the State of California, with the provision that this Resolution shall be deemed a Resolution of Intention; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redding as follows: 1. That all of the foregoing recitals are true and correct. 2 . That City Council intends to and hereby declares its intention to vacate and abandon said 33-foot by 300-foot section of the Twin View Boulevard Right-of-Way adjacent to 955 Twin View Boulevard (on the east side of Twin View Boulevard between State Highway 273 and Interstate 5) , as described in Exhibit A and shown on the maps attached hereto, subject to the following ! conditions: (a) Dedication of a 33-foot-wide public service easement for existing utilities; and (b) Construction of curb, gutter, and sidewalk along the property frontage of 955 Twin View Boulevard at the time of development under Use Permit UP-15-91. Development of the property is also subject to the attached conditions for Use Permit UP-15-91, as approved by the Board of Administrative Review. BE IT FURTHER RESOLVED that all persons interested in or objecting to the proposed abandonment will be heard on Tuesday, August 6 , 1991 , at the hour of 7 : 00 p.m. , or as soon thereafter as the matter may be heard, in the City Council Chambers and Police Department Building located at 1313 California Street, Redding, California. BE IT FURTHER RESOLVED that the Director of Public Works of the City of Redding be and hereby is instructed to post or cause 2 i to be conspicuously posted, at points not more than 300 feet apart in distance and along the line of property now proposed to I be abandoned, notices of this intention to vacate and abandon said portion of street right-of-way. Said notices shall set forth the passage of this Resolution of Intention, and shall set forth the time and place of hearing as hereinabove set forth. At least three such notices shall be posted in the manner set forth above, and posting of said notices shall be completed not less than 15 days prior to the date of the hearing. BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage and adoption of this Resolution of Intention, and shall cause the same to be published once in a newspaper of general circulation in the City of Redding at least 15 days before the date set for public hearing of protests to the afore- said proposed vacation. UP-15-91 Name and Address Ken Walsh c/o Enterprise Realty 100 .Howe Avenue, Suite _18ON Sacramento, CA 95825 The Board of Administrative Review considered and approved USE PERMIT UP-15-91, granting permission to establish 17,000 square feet of retail sales use, 33,504 square feet of storage area, and 2,200 square feet of office associated with property located at 955 and 1045 Twin View Boulevard, in a "C-3-F" Heavy Commercial and Light Industrial District, subject to compliance with all provisions of the Redding City Code and subject to the following conditions: 1. Development shall be in substantial conformance with the site plan dated ' April 3, 1991. Minor modifications may be approved by the Planning Director; any substantial revisions will require either an amendment to this permit or a new use permit. 2. This use permit shall be automatically revoked without further action if the activity or use for which the use permit was granted has not actively and substantially commenced within one year of the date of issuance or if an extension of time has not been granted. 3. Prior to issuance of a building permit, the map for the merger of Parcel Nos. 072-060-29 and 073-080-37 shall be recorded. 4. The requirements of the Building Official and the Uniform Fire Code are to be met. ' 5. Curb, gutter, and five-foot-wide sidewalk are to be installed along the Twin View Boulevard frontage of Parcel No. 72-060-29 consistent with the existing improvements on the parcel to the north. 6. The owner/developer shall prepare the subbase and furnish and place all required aggregate base and asphalt concrete between the gutter and the existing street section of Twin View Boulevard. In addition, the owner/developer shall be required to do any asphalt overlay work on the existing street section necessary to provide a uniform cross slope to the gutter. 7. Application for the abandonment of Twin View Boulevard shall be submitted prior to the issuance of a building permit. Parking is to be improved in accordance with Chapter 18.62 of the City Code with a minimum of 103 spaces, including 3 handicapped spaces. A maximum of 32 compact spaces may be utilized. 9. The driveway on Twin View Boulevard shall be no wider than 50 feet and shall be paved from the edge of Twin View Boulevard pavement for a distance of at least 30 feet. 10. Any entrance gates to the storage yard from the Twin View Boulevard frontage shall be set back a minimum of 20 feet from the property line. 11. All traffic surfaces of the storage yard shall be paved or graveled with a six-inch-minimum base. 12. The developer shall be responsible for acquisition of any necessary encroachment permits to utilize the State storm-drain system. 13. Dedication of any necessary utility or storm-drain easements. 14. Storm-drain improvements are to be constructed as specified by the Public Works Department. 15. Utilities, including electric, telephone, and cable television, are to be installed underground. 16. All electrical facilities, including street lights, are to be installed in accordance with the City Electric Department's service policy as delineated in Resolution 8542. 17. Due to the distance from existing fire hydrants on the street, fire hydrants are to be installed in accordance with the Uniform Fire Code. The location of the fire hydrants are to be approved by the Fire Department. The mains shall be designed to provide adequate fire flows. In no case shall this be less than six inches. 18. Fire-protection facilities, including all-weather access roads, shall be installed and remain serviceable prior to and during the time of construction. 19. The existing fire sprinkler system shall be extended to the storage addition on the south side of the main building. The system shall be brought into compliance to meet NFPA 13 requirements. The new building shall be evaluated for possible sprinkler system requirements. 20. Trash enclosures shall have masonry or steel corner posts, be constructed of material architecturally compatible with the main structure, and provide a solid visual screen. Continued on Page 3. i 0 UP-15-91/Enterprise Realty Page 3 21. A six-foot-high, chain-link fence with wood inserts shall be maintained around the perimeter of the storage yard. The southeast property line adjacent to the "R-1" Single Family Residential District shall be screened within 24 months of issuing a building permit or if the adjacent property ("R-1") develops before that time and shall be accomplished in one of the following manners: a. Incorporation of a 20-foot-wide, 4-foot-high earth-berm planter together with a 5-foot-high solid fence. b. Incorporation of an 8-foot-high planted berm. c. Incorporation of an 8-foot-high solid masonry wall . d. Incorporation of a 7-foot-high, block-post and wood-board fence with a 15-foot-wide planter consisting of hedge-type plants and evergreen trees. 22. The existing chain-link fence between the retail parking lot and the storage yard shall incorporate the use of slats for screening. 23. No merchandise or materials shall be stored which exceed the height of the perimeter fence within 30 feet of the fence or berm. Maximum fence height shall be 8 feet. 24. No repair, assembly, manufacturing or maintenance shall occur within any outside storage area. 25. A six-foot-high, block-post with wood-insert fence (or chain link with slats) shall be constructed along the Twin View Boulevard frontage adjacent to the storage yard. The fence shall be located behind the minimum ten- foot-wide landscaping strip along Twin View Boulevard. 26. Any night lighting is to be oriented so as to not glare onto adjacent residential areas or public rights-of-way of Twin View Boulevard or Interstate 5. 27. All mechanical or air-conditioning units shall be ground-mounted or surrounded by parapets or fencing to deflect noise upward and screen the equipment from public view. The method of parapet screening is to be approved by the Planning Department. 28. If a building permit has not been issued by July 1, 1991, the project shall be subject to the Redding Sign Code currently in effect (Chapter 18.90 of the Municipal Code) . The Sign Code would limit the number of pole signs on site to one. Continued on Page 4.
