',?S A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING BYPASSING THE FORMAL BIDDING PROCESS PURSUANT TO REDDING MUNICIPAL CODE SECTION 4.20.080(A) (4) , AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND SIGN A i THREE-YEAR CONTRACT WITH EPPERSON BROTHERS AUCTION FOR f THE DISPOSAL OF CITY SURPLUS AND OBSOLETE PROPERTY. WHEREAS, in past years a great deal of staff time was required to dispose of the City' s surplus and obsolete property j (Property) . j AND WHEREAS, effective July 1, 1988, the City entered into a two-year contract with Epperson Brothers Auction for the disposal of Property, which has proven beneficial to the City and cost- effective. AND WHEREAS, it has been determined by staff that Epperson Brothers Auction is the only area auctioneer currently capable of handling the auction program. AND WHEREAS, it has been determined that it would be in the best interests of the City of Redding to renew its contract with Epperson Brothers for a period of three years, with the following percentages to be paid by the City: (a) On the sale price of all vehicles, heavy equipment, and I lots of items with an estimated value from: $ 500 to $ 4,000: 100 4,001 to 6 ,000: 80 6,001 to 10,000 : 5% 10,001 and over: 3% s (b) On the sale price of all other merchandise: 200. AND WHEREAS, the City Manager has requested that the bidding process be dispensed with, pursuant to Redding Municipal Code Section 4.20 .080(A) ( 4) , as the proposed services do not constitute a public works project. AND WHEREAS, City Council has carefully studied the afore- said matter, and has determined that said recommendation is in the best interests of the City. AND WHEREAS, it has been determined that this matter is categorically exempt from the provisions of the California iEnvironmental Quality Act. ! NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of f' the City of Redding as follows: i 1. That the foregoing recitals are true and correct. 2. That, pursuant to Redding Municipal Code Section 4.20 . 080(A) ( 4) , the formal bidding process is hereby bypassed, I and the City Manager is authorized to negotiate a renewal of the Epperson Brothers Auction contract for a period of three years i commencing August 1, 1991 , at the percentages set forth above. 3 . That the City Manager is hereby authorized and directed to execute the necessary documentation on behalf of the City of Redding, and the City Clerk is hereby authorized to attest the signature of the City Manager and to affix the seal to the documentation when appropriate. I HEREBY CERTIFY that the foregoing Resolution pertaining to 2 j the Epperson Brothers Auctioneer contract was introduced and read i at a regular meeting of the City Council of the City of Redding on the 2nd day of July 1991, and was duly adopted at said meeting by the following 4/5ths vote of Council: AYES: COUNCIL MEMBERS: Arness, Buffum, Fulton, Moss & Dahl NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: None.
