AUTHORIZATION TOR� OCEED: Signing this form shall be construed as authorization by Client for Lawrence d Associates to proceed with the work unless otherwise provided herein. 2. DIRECT EXPENSES: Lawrence i Associates' direct uses shall be those costs insured on or directly for the Client's Project, including but not limited to, necessary transportation costs, including mileage, meals and lodging, laboratory tests and analyses, computer services, telephone, printing and binding charges. Reimibursement for these expenses shad be an the basis of the attached Schedule of Fees. Statements for services are due five days after being mailed to the client. 3. OUTSIDE SERVICES: When technical and professional services and subcontracted labor and equipment are furnished by an outside source, reimbursement for these expenses shall be an the basis of the attached Schedule of Fees. PROFESSIONAL STANDARDS: Lawrence L Associates shall be responsible to the level of competency presently maintained by other practicing professional engineers in the same type of work in Client's coaminity, for the professional and technical sourness, accuracy and adequacy of all designs, drawings. I specifications and other work and materials furnished under this Authorization. Lawrence i Associates and/or David A. Lawrence make no other warranty, express or implied. S. TERMINATION: Either Client or Lawrence i Associates may terminate this Authorization by giving 30 days' written notice to the other party. In such event, Client shalt forthwith pay Lawrence i Associates in full for all work previously authorized and performed prior to the effective date of termination. If no notice of termination is given, relationships and obligation created by this Authorization shall be terminated upon completion of all applicable requirements of this Authorization, except for the provisions of paragraphs 4, 6, 7 and 8, which shall continue in effect as provided by Law. 6. ARBITRATION: All claims, disputes and other matters in question arising out of, or relating to, the work performed hereurder, this Authorization, or the breach thereof, shalt be decided by arbitration in accordance with the rules of the American Arbitration Association then obtaining. Either Client or Lawrence i Associates may initiate a request for such arbitration. no arbitration arising out of, or relating to, this Authorization may include, by consolidation, joinder or in any other manner, any additional party not a party to this Authorization unless agreed to in writing by both parties. 7. HOLD HARMLESS: Client agrees at all times to defend, indennify, hold harmless and provide alt legal defense and related services to David A. Lawrence, lne., Lawrence S Associates and/or David A. Lawrence (hereinafter collectively •Lawrence"), their officers, associates, agents and/or employees for any and atl claims, expenses, demands, causes of action, liability, loss or injury regardless of their nature or character in any manner whatsoever arising out of (1) any third person's use or reliance on the work performed under this Agreement; (2) any alleged or proven act or omission of Lawrence: Or (3) any Litigation or arbitration, or the like, regarding the work performed under this Agreement involving third persons not parties to this Agreement. 8. LITIGATION: Liability for damages proximately caused by David A. Lawrence, Inc., Lawrence i Associates and/or David A. Lawrence, or their agents, officers or employees shall be limited to cancellation of the sum due and owing or recovery of the suers already paid to Lawrence i Associates by Client. In the event the Client makes a claim against David A. Lawrence Inc., Lawrence i Associates and/or David A. Lawrence, at Law or otherwise, for any alleged error, omission or other act arising out of performance of our professional services, and the Client fails to prove such claim, then the Client shalt pay all costs incurred by Lawrence i Associates and/or David A. Lawrence in defending itself against the claim. PROPOSAL FOR SERVICES This proposal describes the scope of work necessary to complete and submit the final closure plan and final postclosure maintenance plan. Listed below are anticipated outlines of the plans. The outlines follow the legislation in Title 14, CCR, Chapter 3, Article 7.8 and Chapter 5, Article 3 .4. Article 7.8 includes technical requirements for specific closure tasks. Article 3 .4 presents outlines for preliminary and final plans, method of submittal, and a description of the review process. Some of the items required for the Final Plan have already been prepared for the earlier versions of the Closure Plan, although much of the text will have to be rewritten for clarity and to reflect changes in the Plan, and some of the figure and maps will have to be redone. Specific additions to the Final Plan are described below. 1) A gas-control system will be designed and gas-control implementation will be detailed in the Closure Plan as a contingency plan, in case the placement of the prescriptive- standard cover increases the concentrations of methane in the gas-monitoring network. 2) Deeper, multiple-probe gas-monitoring wells will be required to be sampled along the northeast boundary of the landfill. 3) A detailed Construction Quality Assurance Plan has to be prepared, replacing the existing CQA plan, reflecting the placement of a prescriptive standard, detailing all laboratory and field testing. 4) Construction drawings and specifications will be provided. 5) An updated, detailed schedule of closure operations will be furnished. 6) Contractors capable of performing phases of closure work will be identified. 1 7) The Regional Board is requiring that the barrier layer of the final cover have a maximum permeability of 5 x 10-7 cm/sec. Testing conducted during the preparation of the preliminary closure plan does not conclusively demonstrate that untreated local cover-material sources can achieve this permeability standard. It is proposed that soil samples be collected from the interim cover, screened of +1" material, mixed with varying percentages of bentonite, and laboratory-tested using the triaxial-shdar-test apparatus (EPA method 9100) . 8) It is proposed to drill a series of boreholes in the existing cover of the landfill to determine the in-place thickness of the existing cover, and to density-test the existing cover for relative compaction. This information will allow a determination of available borrow materials for the landfill cover, and determine density of in-place cover. This information is important as the cap is required to be compacted to approximately 90% of maximum density under current State regulations. In addition, volumes of borrow materials currently covering the waste cells need to be quantified, as the designated borrow areas near the landfill alone may not provide sufficient volumes of material for the cap design required by State regulations. Therefore, 30 boreholes will be drilled through the existing cover, standard penetration tests will be performed in some of the drill holes, and the existing cover will be tested using a nuclear-density gauge and supplemented by sand-cone density tests. The cost estimate presented below is based on the City of Redding providing a dozer or loader to blade away soil so that subsurface density measurements may be obtained on the cover.
