IT IS HEREBY RESOLVED by the City Council of the City of Redding that the City of Redding enter into "Contract Amendment No. 3 to Client-Consultant Agreement for City Administration and Police Building Study," by and between the City of Redding and Nichols, Melburg, and Rossetto, Consultants, a true copy of which is attached hereto and incorporated herein by reference. BE IT FURTHER RESOLVED that the Mayor of the City of Redding is hereby authorized and directed to sign said Amendment and all other necessary documentation in connection therewith on behalf of the City of Redding; and that the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding thereto. HAYS, ity Attorney CLIENT-CONSULTANT AGREEMENT FOR CITY ADMINISTRATION AND POLICE BUILDING STUDY Contract Amendment No. 3 THIS AGREEMENT, made and entered into this day of , 1991, by and between the CITY OF REDDING, a municipal corporation of the State of California, hereinafter referred to as "City" and the firm of Nichols, Melburg, and Rossetto, hereinafter referred to as "Consultant" for the following professional services for the project known as the Civic Center/City Administration Building Study. WHEREAS, City and Consultant entered into an agreement (Exhibit 1) for professional services on September 29, 1987, to develop schematic plans for Police and City Administration Buildings and a Civic Center; and WHEREAS, City and Consultant amended Sections III, IV, V, VI, and Vlll of the agreement (Exhibit 2) pursuant to Section XI of the Agreement on October 3, 1989, and amended Sections 111, IV, and V on February 5, 1991 ; NOW, THEREFORE, City and Consultant wish to amend the professional service agreement as shown for those sections listed below. All other sections of the agreement remain in effect as written. i SECTION Ill. SCOPE OF WORK Task No. 1 - Project Initiation - No change, completed. i Task No. 1A - Site Selection Work - No change, completed. Task No. 2 - Civic Center Concept - The City Council has selected the Parkview properties to locate both the Administration and Police Buildings. The Administration Building is to be located from Akard Street to the ACID Canal on City property excluding the area needed to be retained for existing administrative operations. With this determination, this task is amended to finalize site plans for the Police and Administration Building as per the work program described on Exhibit C. Task No. 3 - Programming - No change, completed. Task No 4 - Schematic Design - Administration Building and Council Chambers - The size of the Administration Office and Council Chambers Building is to be 133,520 square feet. The building will incorporate parking beneath the building depending on soil construction that would be half in and half out of the ground. The building would be a three-story building with the ground floor larger than the second floor and the second floor larger than the third floor. The building would have a peaked roof. Task No. 5 - Schematic Design - Police Building - No change. Task No. 6 - Preliminary Cost Estimate - No change. SECTION IV. COMPENSATION Payment is based on completion of the tasks as set forth above and for the amounts as follows unless a written amendment to the contract is first approved. Task Not-to-exceed Cost No. 1 - Project Initiation No change No. 1 A - Site Selection Work No change No. 2 - Civic Center Concepts and Concept Selection No change No. 3 - Programming for Administration and Public Safety Buildings No change No. 4 - Schematic Design of Administration Building and Council Chambers $185,000 The design cost for the work is to be based on $1.25 per square foot for the gross floor area of the Administrative Offices and $0.34 per square foot for the parking beneath the building. If the City proceeds with Task 5 ! within six months of the date this amendment is executed by both parties, it shall receive a credit on the design of Task 5 equal to the cost of design of the parking beneath the Administration Building. Note, of the $199,900 shown for the task, $12,600 has already been paid prior to this amendment. No. 5 - Schematic Design of Police Building No change No. 6 - Preliminary Cost Estimate to Construct Building(s) identified Task No. 4. No change All out-of-pocket and reimbursable expenses are included in the above costs. The Consultant is to note that tasks shall be completed in the following order: Task 1, Task 3, j Task 2, Tasks 4 and 5, and Task 6. Work shall not begin on a task until the preceding task has ! been completed and approved by the City Council or its designee. Additional Services Not to Exceed Perspectives of the Administration Building and Council Chambers $2,250 ea Perspectives of the Police Building 2,000 Perspectives of interior of the main lobby and the Council Chambers 3,500 Model of Administration Building and/or Council Chambers 6,000 Model of Property between the ACID Canal and the River 4,000 Model of Public Safety Building(s) 3,000 Perspectives of Civic Center 3,500 Additional services will only occur upon direction of the City Council or the Council subcommittee appointed to control the work. 2 SECTION V. Task No. 4 As shown on Exhibit B2, except the dates are changed to reflect a start time with this amendment. Task No. 5 No change. Task No. 6 No change. Exhibit A - Substitute Exhibit Al, dated December 12, 1990, for Exhibit A. Exhibits B and B1 - Substitute Exhibit B2, attached hereto, for Exhibits B and B1. SECTION IX. RESPONSIBILITY Billing shall be the responsibility of Anshen + Allen.
