A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING OF
RESCINDING RESOLUTION NO. 91-98, AND DECLARING ITS INTENTION
TO BEGIN LEGAL PROCEEDINGS OF ABATEMENT UNDER CHAPTER 9.36 OF
THE REDDING MUNICIPAL CODE ON CERTAIN REAL PROPERTY IN THE
CITY OF REDDING LOCATED AT 1801 WILLIS STREET (1814/1818 GRACE
AVENUE) , OWNED BY JON MALCOLM BENOIST (AS TO AN UNDIVIDED 1/2
INTEREST) , ROBERT JOE GOLENOR AND CLAUDETTE E. GOLENOR, HIS
WIFE (AS TO AN UNDIVIDED 1/2 INTEREST) .
WHEREAS, Resolution No. 91-98 adopted on March 5 , 1991, and

recorded on March 14, 1991, in Book 2697 at page 589 , Shasta County
i
Records, contains inaccurate information as to the correct property
owner and legal description of the real property on which the
substandard building to be abated is located; and
WHEREAS, the purpose of this Resolution is to commence
abatement proceedings against the correct parcel of property on
which the substandard building is located, and to identify the

correct owners of such property; and
WHEREAS, the provisions of Chapter 9. 36 of the Redding
Municipal Code provide that all buildings or structures located
within the City of Redding which are structurally unsafe or are
dilapidated from old age, neglect, decay or other causes which
constitute a fire menace or are dangerous to human life or a likely
resort for vagrant or dissolute persons, may be declared a nuisance
by the City Council of the City of Redding and thereafter abated as

WHEREAS, the Fire Marshal of the City of Redding has made an
inspection of the building located on real property as hereinafter
described and has declared it to be unsafe and/or a hazard to
safety, health and public welfare; and
WHEREAS, it has been determined that this matter is categor-
ically exempt from the provisions of CEQA;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Redding that Resolution No. 91-98 adopted March 5 , 1991, and
recorded on March 14, 1991, in Book 2697 at page 589 , Shasta County
Records is hereby rescinded.
BE IT FURTHER RESOLVED that it is the intention of this City
Council by adopting this Resolution to begin legal proceedings of
` abatement under Chapter 9 . 36 of the Redding Municipal Code on the

property described in Exhibit "A" attached hereto and made a part
hereof, owned by Jon Malcolm Benoist ( as to an undivided 1/2
interest) and Robert Joe Golenor and Claudette E. Golenor, his wife
( as to an undivided 1/2 interest) .
BE IT FURTHER RESOLVED that said building mentioned herein-
above is hereby declared to be a public nuisance as provided by

Chapter 9 . 36 of the Redding Municipal Code and is hereby ordered to
be abated by repair, rehabilitation, demolition or removal.
BE IT FURTHER RESOLVED that the Fire Marshal and the Board of
{ Appeals of the City of Redding are hereby directed to take all
proceedings provided in Chapter 9 . 36 of the Redding Municipal Code.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Redding be and hereby is authorized and directed to forward a
certified copy of this Resolution to the Shasta County Recorder for

recordation.
I HEREBY CERTIFY that the foregoing resolution was introduced
and read at a regular meeting of the City Council of the City of
Redding on the 16th day of April , 1991, and was duly
adopted at said meeting by the following vote:

EXHIBIT "A"
That real property situate in the County of Shasta, City of
Redding, State of California, and is described as follows:
The Southeasterly one-half of Lot 2 and all of Lot 3, Block 2 of
Lee's Addition to Redding, as per map filed July 23 , 1901 in Book
1 of Maps at page 56, Shasta County Records.
Said Southeasterly one-half of Lot 2 being measured along Willis
Street and Grace Avenue.
