A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
DECLARING THAT AN EMERGENCY SITUATION EXISTS; AUTHORIZING THE
BYPASS OF THE FORMAL BIDDING PROCESS; AUTHORIZING THE PURCHASE
OF ADDITIONAL AUTOMATED REFUSE CONTAINERS FROM TOTER, INC.
(SINGLE VENDOR) , AND AUTHORIZING THE CITY MANAGER TO SIGN THE
NECESSARY DOCUMENTATION
i WHEREAS, as part of the 1989-90 Equipment Lease Program,
j Council approved the purchase of approximately 8 ,600 automated
refuse containers from Toter, Inc. , for residential collection; and
WHEREAS, record growth has depleted the reserve supply of
containers and delivery of one truckload ( 405 automated refuse
containers) is needed as soon as possible to replenish reserves and
service container requests until the 1991-92 budget year; and
WHEREAS, delivery can be expected with three weeks from
Council approval; and
WHEREAS, in order to standardize the City' s automated refuse
containers to the highest quality possible, it is necessary to
purchase the containers from a single vendor, Toter, Inc. , at
$59. 00 per container, for a total cost of approximately $25 ,800 . 00 ;
and
WHEREAS, revenue to cover these costs is generated from the
$8. 00 monthly residential garbage rate and the $3 . 00 monthly rate
for additional containers; and
WHEREAS, pursuant to Redding Municipal Code Section
4 . 20. 080 A. 1 and 2 , staff recommends that a contract be awarded to
Toter, Inc. , for said containers, in the amount of $25 ,800. 00; and
WHEREAS, the City Council has carefully studied the aforesaid

matter,
and has determined that said recommendation is in the best

interests of the City; and t

WHEREAS, it has been determined that this matter is
categorically exempt from the provisions of the California
Envionmental Quality Act;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Redding, as follows:
1 . That the foregoing recitals are true and correct.
2 . That, pursuant to Redding Municipal Code §4. 20. 080 A. 1
and 2 , the formal bidding process be bypassed, and a contract
awarded to Toter, Inc. , in the amount of $25,800. 00 for the
' purchase of automated refuse containers.
3 . That the City Manager is hereby authorized and directed
to execute the necessary documentation on behalf of the City of
Redding, and the City Clerk is hereby authorized to attest the
signature of the City Manager and to affix the seal to the
documentation when appropriate.
I HEREBY CERTIFY that the foregoing Resolution was introduced
and read at a regular meeting of the City Council of the City of
Redding on the 19th day of February, 1991, and was duly adopted at
said meeting by the following vote of Council:
