RESOLUTION APPROVING SECOND AMENDED REPORT AND ORDERING i ACQUISITION OF COMPLETED "SERIES B" IMPROVEMENTS COLLEGE HIGHLANDS ASSESSMENT DISTRICT NO. 1989-4 The City Council of the City of Redding resolves: This Council has taken a series of actions preliminary to ordering the acquisition of improvements in College Highlands Assessment District No. 1989-4, City of Redding, Shasta County, California, and now makes the following findings and orders: 1. The City Council adopted a map showing the boundaries of the land benefited by the proposed improvement. A copy of the boundary map was filed in the office of the County Recorder of the { County of Shasta in the Book of Maps of Assessment and Community Facilities Districts. 2 . The City Council adopted its Resolution of Intention, as later amended, to order the improvement described therein under the Municipal Improvement Act of 1913, and directed Sharrah Dunlap and Associates, as the Engineer of Work for the assessment district, to i prepare the report required by Section 10204 of the Streets and Highways Code. The improvements are briefly described as follows: I. The acquisition of Series A completed work and improvements as follows: Shasta View Drive Intersection improvements at Chancellor Blvd. and Shasta View Drive from curb return to curb return including earthwork, asphalt paving, curb gutter and sidewalk, striping, and all appurtenances. A S i CA ORKHNAL Chancellor Boulevard Approximately 750 LF of road improvements including earthwork, asphalt paving, curb gutter and sidewalk, sanitary sewer system, underground electric utilities and all necessary appurtenances. Edinburgh Way & Edinburgh Place Approximately 580 LF of road improvements including earthwork, asphalt paving, curb gutter and sidewalk, sanitary sewer system storm drain and underground electrical utilities with all appurtenances. College View Drive (For Simpson College) i Approximately 1650 LF of College View Drive including asphalt paving, striping, signage and curb and gutter with all appurtenances. Sanitary Sewer (For Simpson College) Approximately 1900 LF of 8" diameter sanitary sewer pipe and all necessary appurtenances. Miscellaneous Approximately 1800 LF of underground electric line in Shasta View Drive at Hacienda Heights. Electric line extensions within the College. Installation of approximately 3500 LF of 8" sanitary sewer from College Highlands to Churn Creek. II. The acquisition of completed "Series B" work and improvements as follows: Shasta View Drive Approximately 1760 if of road improvements including earthwork, asphalt paving, curb, curb & gutter, sidewalk, relocation of power poles, storm drainage, underground utilities, and all necessary improvements. Chancellor Boulevard Approximately 1000 if of road improvements including earthwork, asphalt paving, curb, gutter & sidewalk, sanitary sewer system storm drainage, underground electric utilities, and all necessary appurtenances. Princeton Way (East and West) 2 9 Approximately 900 if of road improvements including earthwork, asphalt paving, curb, gutter and sidewalk, sanitary sewer, storm drainage, and underground electrical utilities with all appurtenances. Palacio Drive Intersection improvements at Chancellor Blvd, and Palacio Drive from curb return to curb return including earthwork, asphalt paving, curb, gutter and sidewalk, striping, and all appurtenances. College View Drive (@ Shasta View Drive) Approximately 1600 if of College View Drive including asphalt paving, striping, signage, and curb & gutter with all appurtenances. 3 . The basic legal proceedings for this assessment district were completed prior to issuance of the Series A bonds, with the public hearing on April 17, 1990, and concluded on that date by adoption of Resolution No. 90-280, entitled "Resolution Approving Amended Report and Ordering Improvement" . 4. On June 20, 1990, Series A of bonds were delivered, and the completed "Series All improvements have been acquired with the proceeds. 5. Now, the "Series B" improvements have been completed, and the Engineer of Work has prepared and filed with this Council a Second Emended Engineer's Report which incorporates the following: a. ) modifies the cost estimate B2 to reflect the actual costs for the Series B improvements, reducing the total cost and expense from $805, 280. 60 per the June, 1990, Amended Engineer's Report to the reduced total for Series B of $686,795.43 ; 3 b. ) amends the assessment diagram to reflect the fact that i the two parcels originally identified as Assessment Nos. i 15 and 16 have been subdivided, and they are now identified as Assessment Nos. 19-40, inclusive, with 15 and 16 being eliminated from the numbering system; and c. ) other conforming modifications related to (a. ) and (b. ) above. Pursuant to Section 10352 of the California Streets and Highways Code, this Council approves said Second Amended Engineer's Report without notice or hearing. 6. The Council finds that the Engineer of Work, in the Second Amended Engineer's Report, has fairly and properly apportioned the cost of the improvement to each parcel of land in the assessment district in proportion to the estimated benefits to be received by each parcel, respectively, from the improvement. The Council hereby confirms and levies each individual assessment as stated in the Second Amended Engineer's Report. 7. This Council orders the acquisition of the "Series B" improvements described in paragraph 2 above and as detailed in the Second Amended Engineer's Report. 8. Series B of serial bonds representing the unutilized portion of unpaid assessments, in the amount of $686,795.43, and bearing interest at a rate not to exceed twelve percent (120) per annum, will be issued in the manner provided by the Improvement 4 1 i Bond Act of 1915 (Division 10, Streets and Highways Code) , and the last installment of the bonds shall mature on the second day of September, 2005. I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the City Council of the City of Redding, Shasta County, California, at a regular meeting thereof, held on the 15th day of January, 1991.
