PAST M OFFICIAL RECORDS SHASTA COUNTY,CALIF. 760 Parkview Ave. JAN 8 1991 Redding, CA. 96001 RESOLUTION NO. 9/- / ASSESSOR-RECORDS &E FEE I i I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A 10-FOOT-WIDE PUBLIC UTILITY EASEMENT THROUGH THE MIDDLE OF A NEW PARCEL LOCATED BETWEEN CHURN CREEK ROAD AND SCHOOL STREET, ABOUT 200 1 FEET NORTH OF SHIRLEY LANE. WHEREAS, a Map was recently recorded to combine six small parcels into one parcel between Churn Creek Road and School Street, about 200 feet north of Shirley Lane for the planned ! construction of three commercial buildings; and WHEREAS, new five-foot wide public service easements have i been offered for dedication along Churn Creek Road and School 1 Street; and WHEREAS, the original Subdivision Map of Shirley Subdivision, filed January 1966 in Book 13 of Map A7 , page 13 , I shows a 10-foot wide public utility easement through the middle of the newly-merged parcel; and i WHEREAS, letters from City Electric, PGandE, Viacom, and i ! Pacific Bell have expressed no objection to the abandonment of said 10-foot wide public utility easement; and ' WHEREAS, the Public Works Department of the City of Redding has duly investigated the proposed abandonment of said 10-foot wide public utility easement, which is more particularly shown on the map attached hereto and incorporated herein by reference, and i has advised the City Council that no present or future need for the 10-foot easement in the center of the new parcel is anticipated; and WHEREAS, it is , therefore, believed by and appears to the City Council of the City of Redding that the 10-foot wide public )z utility easement as described above and shown on the map attached 0 ' hereto is no longer necessary; and I ! rr r BOOK26/ 0 PAGE 363 • i WHEREAS, the City Council of the City of Redding elects to proceed in this matter under the provisions of the Public Streets, Highways, and Service Easements Vacation Law as the same j is set forth in Section 8300, et seq. , of the Streets and Highways Code of the State of California; NOW, THEREFORE, the City Council of the City of Redding hereby resolves and orders that: 1 . The 10-foot-wide public utility easement through the i middle of the new parcel more particularly described above and i shown on the map attached hereto and incorporated herein by reference is no longer necessary and is hereby vacated. 2 . The City Clerk of the City of Redding be and hereby is i directed to record a certified copy of this Resolution, attested { to by the City Clerk under seal of the City of Redding, in the office of the Shasta County Assessor/Recorder.
