AUESSCR41CORDZ F£E S _ EE A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A PORTION OF THE UPPER CHURN CREEK SEWER ASSESSMENT DISTRICT SEWER EASEMENT (DEEDED TO THE CITY BY SEPARATE INSTRUMENTS) AS IT AFFECTS UNIT 1 OF THE MONTEREY SPRINGS SUBDIVISION RECORDED IN BOOK 19 OF MAPS AT PAGE 88, SHASTA COUNTY RECORDS (APN 072-240-02 AND 072-260-06) . i WHEREAS, the hereinafter-described portion of the Upper Churn Creek Sewer Assessment District sewer easement (hereinafter referred to as "Easement" ) as it affects Unit 1 of the Monterey Springs Subdivision recorded in Book 19 of Maps at page 88, Shasta County Records (Assessor' s Parcel Nos. 072-240-02 and 072- 260-06) , was deeded to the City by separate instruments; and WHEREAS, said Easement is more particularly described in Exhibit A and shown on Exhibit B attached hereto and incorporated herein by reference; and WHEREAS, the Public Works Department of the City of Redding has duly investigated abandoning said Easement, inasmuch as the Easement has been replaced by a sewer line located in Olympic Street in Unit 1 of the Monterey Springs Subdivision; and WHEREAS, said Department has advised the City Council that there are no public facilities located in, over, along, upon, under, or across said Easement due to the relocation, and that there is no indication the Easement will ever be required; and WHEREAS, it is therefore believed by and appears to the City Council of the City of Redding that said Easement is no longer necessary; and WHEREAS, the City Council of the City of Redding elects to proceed in this matter under the provisions of the Public Streets, Highways, and Service Easements Vacation Law as the same ti V Gv sooK286 PAGE274 f is set forth in Section 8300, et seq. , of the Streets and Highways Code of the State of California; NOW, THEREFORE, the City Council of the City of Redding hereby resolves and orders: 1 . That the portion of the Upper Churn Creek Sewer Assessment District sewer easement described in Exhibit A and shown on Exhibit B attached hereto is no longer necessary and is hereby vacated. 2. That the City Clerk of the City of Redding is hereby directed to record a certified copy of this Resolution, attested to by the City Clerk under seal of the City of Redding, in the office of the Shasta County Assessor/Recorder.
