A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
DECLARING ITS INTENTION TO ABANDON A 30-FOOT BY 142-
FOOT SECTION OF THE DANA DRIVE RIGHT-OF-WAY ADJACENT TO
1045 DANA DRIVE (ON THE SOUTH SIDE OF DANA DRIVE, NORTH
OF STATE HIGHWAY 44, AND EAST OF THE CHURN CREEK ROAD
OVERCROSSING) (A-1-92) .
WHEREAS, certain real property, namely a 30-foot by 142-foot

section of the Dana Drive Right-of-Way adjacent to 1045 Dana
Drive (on the South side of Dana Drive, North of State Highway
44, and East of the Churn Creek Road overcrossing) , as described
in Exhibit A attached hereto and incorporated herein by
reference, has been heretofore dedicated to the City of Redding,
as the same is set forth on a map and/or plan on file in the
office of the City Clerk of the City of Redding, which right-of-
way is more particularly shown on the maps attached hereto and
incorporated herein by reference; and
1 WHEREAS, it is believed by and it appears to the City
4� Council of the City of Redding, subject to the conditions herein-
after set forth, that the 30-foot by 142-foot section of the Dana
Drive Right-of-Way adjacent to 1045 Dana Drive (on -the South side
of Dana Drive, North of State Highway 44, and East of the Churn
Creek Road overcrossing) , as described in Exhibit A and shown on
the attached maps, is not necessary; and
WHEREAS, the Director of Public Works of the City of Redding
has duly investigated the proposed abandonment of said portion of
street right-of-way, and has advised the City Council that,
subject to the conditions hereinafter set forth, there is no
indication that it will be required in the future; and
WHEREAS, the Planning Commission of the City of Redding has
held a public hearing regarding the abandonment of the above-
described portion of the Dana Drive Right-of-Way, and at the ,

conclusion of said hearing has recommended that said portion of
the Dana Drive Right-of-Way, as described in Exhibit A and shown 01
V
on the attached maps , be abandoned, subject to the conditions
hereinafter set forth; and

WHEREAS, the City Council of the City of Redding elects to
proceed in this matter under the provisions of the Public
Streets, Highways, and Service Easements Vacation Law as the same
is set forth in Section 8300, et seq. , of the Streets and
Highways Code of the State of California, with the provision that
this Resolution shall be deemed a Resolution of Intention;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Redding as follows:
1. That all of the foregoing recitals are true and
correct.
2. That City Council intends to and hereby declares its
intention to vacate and abandon said 30-foot by 142-foot section
'p of the Dana Drive Right-of-Way adjacent to 1045 Dana Drive (on
the South side of Dana Drive, North of State Highway 44, and East
of the Churn Creek Road overcrossing) , as described in Exhibit A
and shown on the attached maps, subject to the following
conditions:
( a) Retention of a 30-foot-wide public services easement
for existing utilities (per 82 O.R. 150) ; and
(b) Construction of tie-in paving, curb, gutter, and
sidewalk and landscaping along the property frontage of
the Red Robin parcel ( 1045 Dana Drive) at the time of
development under Use Permit UP-36-91 and Lot Split
LS-18-91.

Development of the property is also subject to the attached.
conditions for Use Permit UP-36-91, as approved by the Board
of Administrative Review.
BE IT FURTHER RESOLVED that all persons interested in or
objecting to the proposed abandonment will be heard on Tuesday,
June 2, 1992, at the hour of 7 :00 p.m. or as soon thereafter as
the matter may be heard, in the City Council Chambers and Police
Department Building located at 1313 California Street, Redding,
California.

1.3E IT FURTHER RESOLVED that the Director of Public Works of
the City of Redding be and hereby is instructed to post or cause
to be conspicuously posted, at points not more than 300 feet
apart in distance and along the line of property now proposed to
be abandoned, notices of this intention to vacate and abandon
said portion of street right-of-way. Said notices shall set
forth the passage of this Resolution of Intention, and shall set
forth the time and place of hearing as hereinabove set forth. At
least three such notices shall be posted in the manner set forth
above, and posting of said notices shall be completed not less
than 15 days prior to the date of the hearing.
BE IT FURTHER RESOLVED that the City Clerk shall certify to
the passage and adoption of this Resolution of Intention, and
shall cause the same to be published once in a newspaper of
general circulation in the City of Redding at least 15 days
before the date set for public hearing of protests to the afore-
said proposed vacation.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 5th day of May 1992, and was duly
adopted at said meeting by the following vote:

A strip of land 30 ' wide situate in Section 32 , Township 32
North, Range 4 West, M.D.M. , City of Redding, County of Shasta,
State of California more particularly described as follows:
COMMENCING at the West 1/4 corner of Section 32, being marked
by a 2 1/2" brass cap mkd R.C.E. 15159 set in concrete per Book 18
of Parcel Maps page 56, Shasta County Records; thence along the
mid-section line of said Section 32 South 88°51124" East 687. 06
feet to a point on the southerly right-of-way of Dana Drive as
shown on that certain map recorded in Book 29 of Parcel Maps, page
12 , Shasta County Records and the POINT OF BEGINNING; thence from
a tangent bearing of South 6404411811 East along a curve to the left
having a radius of 550. 00 feet, a central angle of 902415011 , and an
arc distance of 90. 37 feet; thence leaving said right-of-way line
and parallel with the above mentioned mid-section line North
88 °51124" West 142 . 00 feet; thence North 21038127" East 32 .00 feet
to a point on said mid-section line; thence easterly along said
