RESOLUTION NO. 92-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AGREEMENT BETWEEN THE CITY OF REDDING AND SUNSET PLAZA
PARTNERSHIP PERTAINING TO THE CONDITIONS OF UP-62-87,
AMENDED; GPA-15-89; AND RZ-16-89.

IT IS HEREBY RESOLVED by the City Council of the City of Redding that the
City of Redding enter into the above-mentioned Agreement by and between the City
of Redding and the Sunset Plaza Partnership, a true copy of which is attached
hereto and incorporated herein by reference.
BE IT FURTHER RESOLVED that the City Manager of the City of Redding is
hereby authorized and directed to sign said Amendment and all other necessary
documentation in connection therewith on behalf of the City of Redding; and that
the City Clerk is hereby authorized and directed to attest the signature of the
City Manager and to impress the official seal of the City of Redding thereto.
I HEREBY CERTIFY that the foregoing Resolution was introduced and read at a
regular meeting of the City Council of the City of Redding on the 18th day of
February, 1992, and was duly adopted at said meeting by the following vote:

A G R E E M E N T
! THIS AGREEMENT is made and entered into by and between
SUNSET PLAZA PARTNERSHIP, hereinafter referred to as "Sunset, "
and the CITY OF REDDING, a Municipal Corporation, hereinafter
referred to as "City" ;
W I T N E S S E T H:
WHEREAS, Sunset applied for a general plan amendment and
zone change relative to property located on the southeast corner
!I of Eureka Way and Buenaventura Boulevard in the City; and
WHEREAS, City granted UP-62-87, amended; GPA-15-89; and
RZ-16-89 based upon Sunset meeting various conditions; and
WHEREAS, Sunset and City wish to implement those conditions;

NOW, THEREFORE, Sunset and City agree as follows:
1. Sunset shall pay to City the amount of $32, 500 . 00 as a —
1 signalization fee associated with the shopping center
development. Said fee may be paid by Sunset in two installments,
but in no event shall payment in full be made any later than 365
calendar days from the date of execution of this Agreement by
City. Sunset shall provide a payment bond or other security as
approved by City guaranteeing payment of this fee.
2. Sunset shall pay, at the time of issuance of building
permits, the following fees:
a. Eight Thousand Three Hundred Seventy Dollars
( $8 , 370. 00) representing traffic impact fees associated
with a fast-food restaurant presently designated as a
Dairy Queen.

b. A traffic impact fee, equal to the amount in effect at
the time of issuance of a building permit, for an
office building in the CO Zone adjacent to Buenaventura

Boulevard. In the event this fee exceeds the amount
established in item 10 of the CO-B40-F site-plan review
criteria associated with RZ-16-89, then that condition
shall be deemed satisfied.
3 . City shall not require the payment of any additional
fees associated with building permits issued to make tenant
improvements in existing shells of buildings associated with the

shopping center construction currently completed.
4. Sunset shall remove or cause to be removed within 48
hours of receiving notice any illegal signs placed or erected on
the property which is the subject of UP-62-87, GPA-15-89, and
RZ-16-89.
IN WITNESS WHEREOF, the parties hereto have hereunto
executed this Agreement on the days and year set forth below.
