RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE
FIRST AMENDMENT TO LEASE BETWEEN THE CITY OF REDDING
AND AIRBORNE FREIGHT CORPORATION, DBA AIRBORNE EXPRESS,
FOR LEASE OF ADDITIONAL SPACE IN THE PASSENGER TERMINAL
AT REDDING MUNICIPAL AIRPORT.
IT IS HEREBY RESOLVED by the City Council of the City of
Redding as follows:
1 . That the City Council of the City of Redding hereby
approves the First Amendment to Lease between the City of Redding
and Airborne Freight Corporation, dba Airborne Express, a true copy
of which is attached hereto and incorporated herein by reference.
2 . That the Mayor of the City of Redding is hereby autho-
rized and directed to sign said First Amendment to Lease on behalf
of the City of Redding, and the City Clerk is hereby authorized and
directed to attest the signature of the Mayor and to impress the
official seal of the City of Redding thereto.
3 . That the City Manager of the City of Redding is hereby
authorized and directed to sign all future amendments to said Lease,
if any, on behalf of the City of Redding; and that the City Clerk is
hereby authorized and directed to attest the signature of the City
Manager and to impress the official seal of the City of Redding on
said amendments, when appropriate.
I HEREBY CERTIFY that the foregoing Resolution was introduced
and read at a regular meeting of the City Council of the City of
Redding on the 4th day of February 1992 , and was duly adopted at
said meeting by the following vote:

FIRST AMENDMENT TO LEASE
THIS FIRST AMENDMENT TO LEASE is made and entered into by
and between the CITY OF REDDING, a Municipal Corporation and
General Law City, hereinafter referred to as "LESSOR, " and
AIRBORNE FREIGHT CORPORATION, dba AIRBORNE EXPRESS, hereinafter
referred to as "LESSEE" :
W I T N E S S E T H:
WHEREAS, LESSOR and LESSEE entered into a Lease commencing
March 1, 1991, for the purpose of constructing and maintaining
thereon a small package air cargo activity within the Municipal
Airport passenger terminal building; and
WHEREAS, LESSEE has requested that their Lease be amended to
include the additional space as depicted in Exhibits "A" and "B"
attached hereto and incorporated herein by reference, to which
LESSOR has agreed; and
WHEREAS, LESSOR and LESSEE wish to amend said Lease pursuant
to the terms and conditions of this First Amendment to Lease;
NOW, THEREFORE, it is agreed by and between the parties
hereto as follows:
1. Effective February 5, 1992, the Description of Premises
as specified in paragraph 1 of said Lease is hereby amended and
will be as depicted in the new Exhibits "A" and "B" attached
hereto and incorporated herein by reference.
2. Effective February 5, 1992, paragraph 6a of said Lease
is hereby deleted, and the following substituted therefor:
6. FEES AND CHARGES.
a. LESSEE will pay to LESSOR for the Permit, license, and
privileges herein granted the following monthly fees
and charges:
i. Should LESSEE operate its own aircraft in
conjunction with its small package air cargo
service: Commercial aircraft landing fees at the
rate established by City Council Resolution.
LESSEE will report in writing to LESSOR by the
fifth day of each and every month the total
number of aircraft landing with a Certified
Maximum Gross Takeoff Weight (CMGTW) over 12,500
pounds during the previous month.
ii. The sum of Four Hundred Thirty-one Dollars and
Fifty-nine Cents ($431.59) for its terminal space
fee, based on 394.5 square feet of area as
depicted in Exhibits "A" and "B" attached hereto
and incorporated herein by reference.
iii. The sum of Two Hundred Eight Dollars and Eighty
Cents ($208.80) for its proportional share of the
terminal maintenance and operational costs and
for the area depicted in Exhibits "A" and "B"
attached hereto. "Maintenance and operational
costs" provided by LESSOR are defined as electri-
cal, air conditioning, heating, water, garbage,
and janitorial services for the shared public
areas; LESSEE is to pay for all other utilities
required in its operations.
iv. The sum of Fifty-five Dollars and Sixty-one Cents
($55.61) for its proportional share of terminal
security costs.
3. All other terms and conditions of said Lease which
commenced March 1, 1991, shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this
First Amendment to Lease in the presence of their respective
officers duly authorized in that behalf on the days and year set
forth below.
