Z 31.3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ESTABLISHING A POLICY REGARDING CREDIT FOR PLAN CHECK FEES ON RESUBMITTAL OF EXPIRED BUILDING PERMITS. WHEREAS, the City Council of the City of Redding is charged with the responsibility of establishing municipal policies to j guide the various functions of the City and, where necessary, to establish procedures by which functions are performed; and WHEREAS regulatory Policies established by the City Council are usually adopted by Ordinance and included in the Municipal Code. However, other policies are also established, which by their nature do not require adoption by Ordinance; these policy statements adopted b Resolution of the City Council, need to be P Y consolidated in a reference document for easy access; and WHEREAS, on August 4, 1987, by Resolution No. 87-261, City Council adopted a Council Policy Manual to achieve said v ob 'ecti es - and WHEREAS, City Council wishes to adopt a policy regarding credit for plan check fees on resubmittal of expired building permits; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: I 1. That all of the above recitals are true and correct. S' 2. That the Policy attached hereto be and hereby is adopted as the Council Policy establishing a policy for credit for plan check fees on resubmittal of expired building permits. i 3 . That said Policy be incorporated in the Council Policy I ! DATE ON RESUBMITTAL OF EXPIRED BUILDING PERMITS 1602 -6-7-92 1 of 1 BACKGROUND Sometimes building permits are issued and, for one reason or another, construction does not commence. On occasion, these applications are resubmitted. According to the Building Code, "in order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan-review fee." If the application is resubmitted within one year, the building fees shall be one-half the amount required for a new permit. After one year,the building permit fee shall be the full amount if the plans are resubmitted. The Building Code is silent on the amount of fees to be paid for plan check. PURPOSE i The purpose of this policy is to clarify the City's policy regarding payment of plan check fees upon the resubmittal it of building permit application after a permit has expired. POLICY It is the policy of the City that the Building Official may give a credit of 80 percent of the plan check fee on the resubmittal of a building permit if all of the following facts are in evidence: .I 1. The plans are resubmitted within three months of expiration of the building permit. I 2. The Building Codes have not changed. 3. The building plans,specifications, and location have not changed and the architect's and engineer's licenses are valid. I 4. State laws related to construction have not changed. 5. The building complies with all other applicable laws in effect at the time the permit is resubmitted, and the developer pays all applicable fees in effect at the time a new building permit is issued. I 6. This is a one-time-only occurrence. .i IMPLEMENTATION This policy shall be implemented by the Building Division when the above criteria are found to be in evidence. I i i 1 CR 0049 I II
