HomeMy WebLinkAboutReso 92-301 - Approve & Authorize the CM to sign the Agreement between COR & Shasta County Womens Refuge to provide rape crisis intervention serv for 07/01/92 through 06/30/93 RESOLUTION NO. q,2-5C A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING AND AUTHORIZING THE CITY MANAGER TO SIGN THE AGREEMENT BETWEEN THE CITY OF REDDING AND THE SHASTA COUNTY WOMEN' S REFUGE TO PROVIDE RAPE CRISIS INTERVENTION SERVICES FOR THE PERIOD JULY 1, 1992, THROUGH JUNE 30, 1993. IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: 1 . That the City Council of the City of Redding hereby approves the above-mentioned Agreement between the City of Redding and the Shasta County Women' s Refuge, a true copy of which is attached hereto and incorporated herein by reference. 2. That the City Manager of the City of Redding is hereby authorized and directed to sign said Agreement on behalf of the City of Redding; and the City Clerk is hereby authorized and directed to attest the signature of the City Manager and to impress the official seal of the City of Redding thereto. HAYS, Ci y Attorney �I I� E M E N T .j ,i y THIS AGREEMENT is made and entered into, effective July 1, 1992, by and between the CITY OF REDDING, a Municipal Corporation and General Law City, hereinafter called "CITY," and SHASTA i COUNTY WOMEN'S REFUGE, hereinafter called "SCWR" : W I T N E S S E T H: WHEREAS, it is the desire of CITY' s Police Department ,I (hereinafter called "RPD" ) to have professional consultants available to render rape crisis intervention services to victims needing such assistance; and WHEREAS, SCWR is an organization especially qualified for such rape crisis intervention services, having Counselors who '.j possess special training and experience in this field, and WHEREAS, SCWR has provided said services to the CITY since i 1988; and WHEREAS, it has been determined that this matter is not subject to the provisions of the California Environmental Quality Act; i NOW, THEREFORE, IT IS AGREED by and between the parties hereto as follows: 1. The term of this Agreement shall be for one ( 1) year, commencing July 1, 1992, and terminating June 30, 1993 . 2. SCWR shall remain on call twenty-four ( 24) hours a day ii during the term of this Agreement; and when called by the RPD a will report as quickly as possible, but in no event later than one hour after being contacted by the RPD. 3 . All SCWR Counselors assigned to work with the RPD shall meet the qualifications listed in the Client Services Coordinator i I� �I Job Title attached hereto as Exhibit "A" and incorporated herein by reference. 4. All SCWR Counselors assigned to work with the RPD are I required to attend an orientation meeting with the Crimes Against Persons Investigators and the Investigations Unit Supervisor. " 5. SCWR covenants and agrees that all of its Counselors { will agree to accept and package the Sexual Assault Kit evidence according to Department of Justice procedures. 6. SCWR will only charge CITY for Counselor-time spent for II evidence collection, victim interviews, follow-up interviews at the request of an investigator, and Court appearances, as necessary. 7. SCWR will be compensated by CITY for rendering such aid to victims at the rate of Fifteen Dollars ($15. 00) per hour, with a minimum of two (2) hours per call-out, payable by CITY upon receipt of SCWR' s billing approved by the Chief of Police. 8. In the performance of this Agreement, SCWR and its Counselors are independent contractors of professional counseling p services, and not employees of CITY. I� 9. This Agreement is granted upon the express condition that CITY, its officers, officials, employees, agents, and volunteers, shall be free from any and all liability and claims for damages for personal injury, death, or property damage in any way connected with SCWR' s services under this Agreement, including claims of SCWR, its officers, agents, employees, and counselors. SCWR shall indemnify and save harmless CITY, its officers, officials, employees, agents, and volunteers, from any and all liability, loss, cost, or obligation on account of or arising out of any such injury, death, or loss caused by the negligence or other legal fault of SCWR or its officers, agents, employees, and counselors. 10. The SCWR shall procure and maintain for the duration of this Agreement the following insurance against claims for injuries to persons or damages to property which may arise from or in connection with the performance of the services hereunder 2 n i iI '! by the SCWR, its officers, officials, employees, agents, and ii volunteers. The cost of such insurance shall be borne by the SCWR. i� Minimum Scope of Insurance Coverage shall be at least as broad as: i� 1. Insurance Services Office Commercial General Liability coverage (occurrence form CG 0001) . Claims-made form is also acceptable. 2. Workers' Compensation insurance as required by the State of California and Employers' Liability Insurance. 3 . Insurance Services Office Form number CA 0001 (Ed.1/87) covering Autobomile Liability, owned, non-owned, and hired, if applicable. Minimum Limits of Insurance The SCWR shall maintain limits no less than: 1. General Liability: $1,000,000 per occurrence for bodily injury, personal injury, and property damage. If Commercial General Liability Insurance or other form with a general aggregate limit is used, the general aggregate limit shall be twice the required occurrence limit. i 2. Employer' s Liability: $1,000,000 per accident for bodily injury or disease. 3 . Automobile Liability: $1,000,000 per accident for ,I bodily injury and property damage. Deductibles and Self-Insured Retentions Any deductibles or self-insured retentions must be declared to and approved by the City. At the option of the City, either: the insurer shall reduce or eliminate such deductibles or self- insured retentions as respects the City, its officers, officials, employees, agents, and volunteers; or the SCWR shall procure a bond guaranteeing payment of losses and related investigations, claims administration, and defense expenses. Other Insurance Provisions The general liability policy is to contain, or be endorsed to contain, the following provisions: 3 't II 1 . The City, its officers, officials, employees, agents, a and volunteers are to be covered as insureds as respects: liability arising out of activities performed by or on behalf of the SCWR; products and completed operations of the SCWR; premises owned, occupied, or used by the SCWR; or automobiles owned, leased, hired or borrowed by SCWR. The coverage shall contain no special limitations of the scope of protection afforded to the City, its officers, i officials, employees, agents, or volunteers. 2. The SCWR' s insurance coverage shall be primary insurance as respects the City, its officers, 'I officials, employees, agents, and volunteers. Any insurance or self-insurance maintained by the City, its officers, officials, employees, agents, or volunteers shall be excess of the SCWR' s insurance and shall not i contribute with it. 3 . Any failure to comply with reporting or other provisions of the policies, including breaches of warranties, shall not affect coverage provided to the City, its officers, officials, employees, agents, or volunteers. 4. The SCWR' s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer' s liability. 'I !; 5. Each insurance policy required by this clause shall be endorsed to state that coverage shall not be suspended, voided, cancelled by either party, reduced in coverage or in limits except after thirty (30) days' prior written notice has been given to City. �4 Acceptability of Insurers Insurance is to be placed with insurers with a current A.M. Best' s rating of no less than A:VII . a Verification of Coverage The SCWR shall furnish the City with Certificates of Insurance and original endorsements effecting coverage required by this clause. The endorsements are to be signed by a person authorized by that insurer to bind coverage on its behalf. All endorsements are to be received and approved by the City prior to July 1, 1992, the commencement date hereunder. 4 .I I - II 11. Either party hereto may cancel this Agreement by giving thirty ( 30) days' notice in writing to the other party of its intention to do so. 12. This is a part time position with flexible hours. DUTIES: 1. Answer crisishones p providing crisis it intervention and referrals. 2. Attend additional trainings and monthly inservice meetings as scheduled by the Client Services Coordinator. 3. Perform advocacy services as required 4. Complete and turn in required forms and documentations. 5. Related duties as assigned. ,i G. Maintain confidentially of client information and of the shelter location. QUALIFICATIONS: 1.
