A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING INITIATING PROCEEDINGS FOR THE FORMATION OF TERRITORY INTO A LANDSCAPE MAINTENANCE ASSESSMENT DISTRICT TO BE KNOWN AS LANDSCAPE MAINTENANCE DISTRICT NO. 12; AND TO THE LEVY AND COLLECTION OF ASSESSMENTS THEREIN FOR FISCAL YEAR 1992-93, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972. WHEREAS, on March 24, 1992, a Petition and Consent for the Formation of Territory into a Landscape Maintenance District, and to the Levy and Collection of Assessments Therein Pursuant to the Landscaping and Lighting Act of 1972 signed by the owner of the land as shown on the last equalized County assessment roll, or entitled to be shown as owner on the next County assessment roll, or, where any of said property is subject to a recorded written agreement of sale, are shown therein as purchaser, of all of the territory more particularly hereinafter described, was filed with the City Clerk of the City of Redding, pursuant to the Landscaping and Lighting Act of 1972 as set forth in the Streets and Highways Code of the State of California, commencing with Section 22500 ; and WHEREAS, the territory proposed to be formed into LANDSCAPE MAINTENANCE DISTRICT NO. 12 is described as follows: All of that certain real property situate in the City of Redding, Shasta County, California, being Lots 1 through 11 inclusive of Unit 3 of the Lancer Hills Subdivision as shown �� on the map recorded January 8 , 1992, in Book 20 of Maps at page 68, Shasta County Records (previously APN 077-150-09) ; and WHEREAS, the purpose of the proposed district is to provide maintenance to those landscaping improvements required within the public right-of-way by the conditions of development approval of Unit 3 of the Lancer Hills Subdivision; and WHEREAS, upon formation of LANDSCAPE MAINTENANCE DISTRICT NO. 12, City Council intends to levy the special assessment upon the land equally amongst the 11 lots of Unit 3 of the Lancer Hills Subdivision, which will encompass said District; and WHEREAS, no costs for the original improvements will be assessed against land within the proposed District; all costs of improvements being a condition of the development of said i Subdivision; and WHEREAS, only costs for maintenance of landscaping, repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, and any and all incidental expenses, including administrative costs, in connection therewith will be assessed; and WHEREAS, no new improvements or substantial changes in existing improvements are proposed for fiscal year 1992-93 ; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: 1. That the foregoing recitals are true and correct. 2 . That the District Engineer is hereby ordered to file the Report required by Article 4 (commencing with Section 22565) 2 Ii of Chapter 1 of the Landscaping and Lighting Act of 1972.
