HomeMy WebLinkAboutReso 93-294 - Rescinding Reso No. 88-362 & 89-228 as of 12/31/93 & establish new Wastewater Rates & Connection Charges Eff 01/01/94 RESOLUTION NO. 93-_,�?� '.i A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING RESCINDING RESOLUTION NOS. 88-362 AND 89-228 AS OF MIDNIGHT, DECEMBER 31, 1993; AND ESTABLISHING NEW WASTEWATER RATES AND CONNECTION CHARGES EFFECTIVE JANUARY 1, 1994. WHEREAS, Section 14. 16.200 of the Redding Municipal Code provides that the City Council may from time-to-time and at its discretion, by Resolution, fix, alter, change, amend, or revise any connection charges, sewer service fees, and other fees related to the publicly-owned treatment works (POTW) of the City of Redding; and '! WHEREAS, the existing fees and charges were established by Resolution Nos. 88-362 and 89-228; and WHEREAS, the Wastewater Utility operating expenses have exceeded operating revenues due to mandates beyond the City' s control, which were not included in the previous 1988 revenue program; and WHEREAS, the City Council, has examined the Wastewater Utility budget deficit and the need for wastewater rate' and connection fee increases; and WHEREAS, the proposed increase in connection fees is a minor adjustment recommended by the adopted 1992 Master Sewer Plan to include the new Stillwater Service Area in a City-wide uniform fee structure, and to account for the increase in construction costs based on the Engineering News Record; and WHEREAS, the City Council has determined that the existing wastewater service rates and connection charges do not produce sufficient revenue to pay all the costs associated with these services, and to balance the Wastewater Utility budget; and WHEREAS, the City Council deems it to be in the best interests of the City and its citizens that new schedules of wastewater service charges and wastewater connection charges be established, as set forth in Exhibits "A" and "B" respectively attached hereto and incorporated herein by reference; and t\ WHEREAS, the proposed increase in the wastewater service ) charges schedule as set forth in Exhibit "A" shall be used to t offset the increased costs of providing these services; and '�� 1 WHEREAS, the proposed increase in the wastewater connection charges schedule as set forth in Exhibit "B" shall be used solely for the wastewater system improvements as outlined in the City' s 1987 and 1992 Master Sewer Plans; and WHEREAS, staff has reviewed the requirements of the California Environmental Quality Act (CEQA) Guidelines under Section 15273 as it relates to the wastewater service charges and wastewater connection charges, and is of the opinion that the proposed increases are not subject to CEQA, with said findings being based on the following: Said increases may be used to: - meet operating expenses, wages, and employee benefits; - allow repair and replacement of the existing system; - increase capacity within existing service areas as a product of continuing growth and more efficient use of land; - provide for reconstruction and replacement of sub- standard portions of the system; - make emergency repairs as the need arises; - pump, transmit, and treat wastewater originating from existing service areas; - obtain services and supplies; - plan and manage the system; and - process payments; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: 1 . THAT for any property for which an application for a building permit has been completed prior to January 1, 1994, the connection charges shall be as set forth in Resolution Nos. 88- 362 and 89-228 . 2. THAT Resolution Nos. 88-362 and 89-228 be rescinded as i of midnight, December 31, 1993 . 3 . THAT pursuant to Section 14. 16. 200 of the Redding Municipal Code and Government Code Section 66001 , the City Council does hereby approve and adopt, effective January 1 , 1994: (a) the schedule for wastewater service rates as set forth in Exhibit "A, " and (b) the rates for wastewater connection charges as set forth in Exhibit "B. " 4. THAT the City Council shall make findings once each fiscal year with respect to any portion of the connection charges remaining unexpended or uncommitted in its account five or more years after deposit of the fee to identify the purpose to which the fee is to be put and to demonstrate a reasonable relationship between the fee and the purpose for which it was charged; THAT 2 i the findings need only be made for moneys in the possession of the City of Redding, and need not be made with respect to letters of credit, bonds, or other instruments taken to secure payment of the fee at a future date commencing five years following the first collection of wastewater connection charges; AND THAT any unexpended or uncommitted funds shall be subject to refund in accordance with Chapter 5 of Title 7 , Division 1, of the Government Code. Class IB, Multiple-family Users, see Table 2. CLASS II: USERS THAT DISCHARGE A WASTEWATER SIMILAR IN STRENGTH TO THAT OF DOMESTIC WASTEWATER Class IIA and Class IIB users charged on the basis of water consumption, see Table 4. Class IIB users charged on the basis of household equivalents, see Table 3 . CLASS III: USERS THAT DISCHARGE A WASTEWATER GREATER THAN DOMESTIC WASTEWATER IN STRENGTH Class IIIA: Restaurants are the only users in this class, based on the measured strength of their wastewater. For restaurants charged on the basis of water consumption, multiply the appropriate amount from Table 4 by 1. 24. For restaurants charged on the basis of household equivalents, multiply the appropriate amount from Table 3 by 1 .24. Class IIIB users shall be assessed a fee per household equivalent discharged as shown in Table 3 , with the household equivalents determined by the monitoring of flow and wastewater strength. I 2 of 2 i EXHIBIT "B" 'i CITY OF REDDING WATER UTILITY WASTEWATER CONNECTION CHARGES The following rates shall be paid to the City of Redding prior to the issuance of any wastewater connection permit, or any physical connection to a publicly-owned treatment works (POTW) , for the premises to which the charges apply. The City Council of the City of Redding hereby finds and declares that the purpose of the connection charges is to provide for wastewater conveyance and treatment. The charges will be used to finance the facilities identified in the 1987 and 1992 Master 'I Sewer Plans. The wastewater conveyance and treatment is needed to service both the existing demand in the City of Redding and future increases in demand due to growth in residential ,i development and commercial activity. The wastewater conveyance and treatment facilities to be financed by the connection charges are the necessary means for servicing these demands for wastewater treatment. The 1987 and 1992 Master Sewer PlansY re ared b Pace P P Engineering, and the facts and evidence presented, establish that there is a reasonable relationship between the need for the described public facilities and the impacts of all types of development which increase the demand for additional household equivalents of wastewater conveyance and treatment; and that there is also a reasonable relationship between the use of the charges and the types of development for which the fees are charged. The cost estimates for the facilities financed by these charges are reasonable cost estimates for constructing these facilities; and the charges expected to be generated by new development will not exceed the total of these costs. A. CONNECTION CHARGE FOR SYSTEM IMPROVE4ENT. A connection charge for system improvement of $ 950. 00 effective 1/1/94 978. 00 effective 7/1/94 1 ,008. 00 effective 7/1/95 per household equivalent as defined in the Redding Municipal Code shall be paid as a condition precedent to any sewer connection into the wastewater system. This sewer connection charge represents the computed reasonable contributive share of the cost of construction of the trunk sewers, interceptors, and pumping facilities. 1 of 2 1 . jl CONNECTION CHARGE FOR SYSTEM IMPROVEMENT, continued: This charge shall not apply, and an exemption shall be given, for properties in the Clover Creek Assessment District. (The Clover Creek Assessment District is an area served only by the regional facility at Stillwater; properties in the District will not make use of or benefit from the system improvements financed by this connection charge. ) i B. CONNECTION CHARGE FOR TREATMENT PLANT EXPANSION. I A connection charge of $1, 100. 00 effective 1/1/94 1 , 133 . 00 effective 7/1/94 1 , 167. 00 effective 7/1/95 per household equivalent as defined in the Redding Municipal Code shall be paid as a condition precedent to any wastewater connection into the POTW. This sewer connection charge represents the computed reasonable contributive share of the cost of construction of the next planned expansions I of the Clear Creek and Stillwater treatment facilities. ,j C. FRONT FOOTAGE CHARGE. For each wastewater connection made into a lateral which has not been constructed or financed by means of a local assessment district, or through any other means in which the applicant or his predecessor-in-interest obtained a vested interest, there shall be paid by the applicant a front footage charge for lateral connection computed at the rate of $14. 00 per foot of street frontage of the premises to be connected. The premises front footage shall be calculated as set forth in the Redding Municipal Code. D. LINE TAP CHARGE. When a wye or "T" branch is not available for a wastewater connection, the applicant for the wastewater connection shall pay a line-tap charge as follows: 6" x 4" "T" Branch $ 90.00 6" x 6" "T" Branch 90. 00 8" x 4" "T" Branch 115.00 8" x 6" "T" Branch 115. 00. i When tapping sewer mains 10" or larger, the applicant will be required to make a hot tap on the sewer main at the applicant' s expense. The City of Redding will be notified in advance so as to be able to inspect the tap. In the event of a hot tap, the normal line-tap fee will be waived. 2 of 2 .I
