A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
ORDERING THE FORMATION OF LANDSCAPE MAINTENANCE
DISTRICT NO. 23 AND THE LEVY AND COLLECTION OF
ASSESSMENTS FOR FISCAL YEAR 1993-94, PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972.

WHEREAS, by Resolution No. 93-183 , City Council approved the
Report of the Engineer as filed relating to the formation of City
of Redding LANDSCAPE MAINTENANCE DISTRICT NO. 23; and
WHEREAS, said Report described the improvements therein, and
gave notice of the time and place of the public hearing on the
question of formation of said district and the levy of assess-
ments for fiscal year 1993-94; and
WHEREAS, an illustration of the area encompassed by the
proposed district is attached hereto and incorporated herein by
I reference; and
WHEREAS, said public hearing, duly and properly noticed,
i commenced at the City Council Chambers, 1313 California Street,
Redding, California, on July 6 , 1993 , and was concluded prior to
the adoption of this Resolution; and
WHEREAS, at the public hearing the City Council gave every
interested person an opportunity to object to the proposed
improvements, the extent of the assessment district, and the
proposed assessment; and
WHEREAS, all legal prerequisites to the adoption of this
Resolution have occurred, including a public meeting held
June 15, 1993 , pursuant to Section 54954. 6 of the Government
Code;
NOW, THEREFORE, the City Council of the City of Redding does
hereby find, resolve, determine, and order as follows:

1. The matters set forth above are true and correct.
2. The owners of all land within the boundaries of the
proposed district have filed their consents to the
formation of the proposed district.
3 . The territory proposed to be formed into a Landscape
Maintenance District is described as follows:
All of that certain real property situate in the
City of Redding, Shasta County, California, being
Lots 1 through 35 inclusive and the park site on
Lynbrook Drive in Unit 1 and remaining parcels R1
j and R2 of the Stillwater Heights Subdivision as
shown on the map recorded December 22, 1992, in
Book 20 of Maps at page 99, Shasta County Records
(previously APN 111-140-06, 07, 08 , 14 and 16) ;
and
4. The improvements specified in the Engineer ' s Report on
file with the City Clerk are hereby ordered to be
completed.
5. Council has considered all oral statements and written
protests or communications made or filed by interested
persons at the public meeting of June 15, 1993 , and the
public hearing of July 6, 1993 , and finds that a
majority protest against the formation of the district
and the levy of assessments has not been filed.
6. Council hereby expressly overrules any and all protests
filed that object to the proposed improvements
specified in the Engineer ' s Report, or to the proposed
assessments to be levied.
7. City Council hereby orders the formation of the
Landscape Maintenance Assessment District described in
the Resolution initiating proceedings and in the
Engineer ' s Report for the installation or construction
of improvements and the maintenance or servicing, or
both, thereof, together with any and all incidental
expenses in connection therewith, including
j administrative costs, all as more particularly
authorized pursuant to the Landscaping and Lighting Act
of 1972 .
8. That said district shall hereafter be designated as
"LANDSCAPE MAINTENANCE DISTRICT NO. 23, " by which name
it shall hereafter be referred to in all subsequent
proceedings, including proceedings for the levy and
collection of assessments .
9. The City Council finds that the Engineer, in his

report, has fairly and properly apportioned the cost of
the improvements to each of Lots 1 through 35 inclusive
of Unit 1 and the remaining parcels R1 and R2 in said
District in proportion to the estimated benefits to be
received by each lot or remaining parcel, respectively,
from the improvement.
10. That the assessment diagram contained in the Engineer' s
Report, and the assessment of $81 . 08 for each of Lots 1
through 35 of Unit 1 and remaining parcels R1 and R2
located within said District, are hereby adopted and
confirmed, and that said assessments be and hereby are
levied for fiscal year 1993-94.
11. That the City Clerk shall forthwith transfer to the
Auditor and the Recorder/Assessor of Shasta County a
certified copy of this Resolution and a certified copy
of the assessment diagram contained in the Engineer' s
Report.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 6th day of July , 1993 , and was duly
adopted at said meeting by the following vote:
