LOTS 1-59, CANDLEWOOD ESTATES SUBDIVISION, UNIT 2 LOTS 1-25, RAVENWOOD ESTATES SUBDIVISION, UNIT 10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE ANNEXATION OF ADDITIONAL TERRITORY, NAMELY RAVENWOOD ESTATES SUBDIVISION, UNIT 10, INTO LANDSCAPE MAINTENANCE DISTRICT NO. 3, AND THE LEVY AND COLLECTION OF ASSESSMENTS FOR FISCAL YEAR 1993-94, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972. WHEREAS, by Resolution No. 93-143 , City Council approved the Report of the Engineer as filed relating to the formation of City of Redding LANDSCAPE MAINTENANCE DISTRICT NO. 3; and WHEREAS, said Report described the improvements therein, and gave notice of the time and place of the public hearing on the question of annexing additional territory into said district and the levy of assessments for fiscal year 1993-94 ; and WHEREAS, an illustration of the area encompassed by the district is attached hereto and incorporated herein by reference; and WHEREAS, said public hearing, duly and properly noticed, commenced at the City Council Chambers, 1313 California Street, Redding, California, on July 6 , 1993 , and was concluded prior to the adoption of this Resolution; and WHEREAS, at the public hearing the City Council gave every interested person an opportunity to object to the proposed annexation of additional territory and the proposed assessment; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred, including a public meeting held June 15, 1993 , pursuant to Government Code Section 54954.6; and a WHEREAS, the City Council has considered the Update of the Engineer' s proposed assessment, a copy of which is attached , hereto as Exhibit 1 and made a part hereof by reference; NOW, THEREFORE, the City Council of the City of Redding does t� hereby find, resolve, determine, and order as follows: .(002�pa�E��9 1. The matters set forth above are true and correct. 2. With respect to LANDSCAPE MAINTENANCE DISTRICT NO. 3 as it currently exists, Council has considered all oral statements and written protests or communications made or filed by interested persons at the public meeting of June 15, 1993 , and the public hearing of July 6, 1993 , and hereby expressly overrules any and all protests filed objecting to the proposed assessments to be levied. 3 . With respect to the additional territory proposed to be annexed into the District: A. The owner of all land within the boundaries of the additional territory proposed to be annexed into the District has filed its consent to said inclusion. B. Said territory is described as follows: All of that certain real property situate in the City of Redding, Shasta County, California, being Lots 1 through 25 inclusive Unit 10 of the Ravenwood Estates Subdivision as shown on the Map recorded September 17, 1992, in Book 20 of Maps at page 93 , Shasta County Records (previously APN 77- 280-14 and 15) . C. The improvements as specified in the Engineer' s Report on file with the City Clerk are hereby ordered to be completed. D. Council has considered all oral statements and written protests or communications made or filed by interested persons at the public meeting of June 15, 1993 , and the public hearing of July 6, 1993 , and finds that a majority protest against the annexation and levy of assessments has not been made. Council expressly overrules any and all protests filed objecting to the proposed annexation or assessments to be levied. E. City Council hereby orders the annexation of said additional territory into LANDSCAPE MAINTENANCE DISTRICT NO. 3 for the installation or construction of improvements and the maintenance or servicing, or both, thereof, together with any and all incidental expenses in connection therewith, together with administrative costs, all as more particularly authorized pursuant to the Landscaping and Lighting Act of 1972. 2 4. The City Council finds that the Engineer, in his Update amending the proposed assessment, has fairly and properly apportioned the cost of the improvements to each lot/parcel of land in said District in proportion to the estimated benefits to be received by each lot/parcel, respectively, from the improvement. 5. That the assessment diagram contained in the Engineer' s Report, and the following assessments for each lot/ parcel located within said District, are hereby adopted and confirmed, and that said assessments be and hereby are levied for fiscal year 1993-94: Lots 1-60 , Candlewood Estates Subdivision, Unit 1 : $ 0. 00 Lots 1-59 , Candlewood Estates Subdivision, Unit 2: 0. 00 Lots 1-25, Ravenwood Estates Subdivision, Unit 10 50. 15. 6. That the City Clerk shall forthwith transfer to the Auditor and the Recorder/Assessor of Shasta County a certified copy of this Resolution and a certified copy of the assessment diagram contained in the Engineer' s Report.
