HomeMy WebLinkAboutReso 93-183 - LMD No. 23 Stillwater Heights Subdivision A reso of intention to order the formation of territory into LMD and to Levy & Collect Assessments for FY 1993-94 i RESOLUTION NO. c3- 3 I LANDSCAPE MAINTENANCE DISTRICT NO. 23 STILLWATER HEIGHTS SUBDIVISION LOTS 1-35 AND PARK SITE ON LYNBROOK DRIVE, UNIT 1, AND REMAINING PARCELS R1 (UNIT 2) AND R2 (UNIT 3) A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF REDDING TO ORDER THE FORMATION OF TERRITORY INTO A LANDSCAPE MAINTENANCE' DISTRICT, TO BE KNOWN AS LANDSCAPE MAINTENANCE DISTRICT NO. 23, AND TO LEVY AND COLLECT ASSESSMENTS THEREIN FOR FISCAL YEAR 1993-940, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972. WHEREAS, on this date the City Council adopted a Resolution initiating proceedings for the formation of LANDSCAPE MAINTENANCE DISTRICT NO. 23 and the levying of assessments for fiscal year "I 1993-94, and directed the filing of an Engineer' s Report; and WHEREAS, the Engineer for the proceedings has filed his Report with the City Clerk, setting forth a full and detailed description of the improvements, the boundaries of the proposed assessment district and any zones therein, any bonds or notes to be issued, and the proposed assessments upon assessable lots and parcels of land within the proposed district; and WHEREAS, the purpose of the proposed district, which is generally located between old 44 and State Route 44, east of Airport Road, is to provide maintenance to those landscaping improvements required within the public right-of-way and the park site on Lynbrook Drive by the conditions of development approval of the Stillwater Heights Subdivision; and WHEREAS, City Council intends to levy the proposed special assessment upon the land equally amongst Lots 1 through 35 inclusive of Unit 1 and remaining parcels R1 and R2 of the Stillwater Heights Subdivision, which, together with the park site on Lynbrook Drive, encompass the proposed district; and WHEREAS, no costs for the original improvements will be assessed against land within the proposed district; all costs of improvements being a condition of the development of said 'I Subdivision; and WHEREAS, only costs for maintenance of landscaping, repairs aj to the irrigation system, electric and water charges, replacement } I i of. vegetation as necessary, and any and all incidental expenses, including administrative costs, in connection therewith will be assessed; and WHEREAS, a public meeting will be held June 15, 1993, j pursuant to Section 54954.6 of the Government Code; NOW, THEREFORE, IT IS Rev RESOLVED by the City Council of the City of Redding as follows: 1. That the above recitals are true and correct. 2. That the City Council hereby approves the Report of the Engineer, as filed, containing a full and detailed description of the improvements; the boundaries of proposed LANDSCAPE MAINTENANCE DISTRICT NO. 23 and any zones therein; any bonds or notes to be issued; and the proposed assessments upon assessable lots/parcels within said district. i 3 . That a public hearing will be held on Tuesday, July 6 , 1993, at the hour of 7 : 00 p.m. or as soon thereafter as the matter may be -heard, in the City Council Chambers located at 1313 California Street, Redding, California, to address the formation of said district and the levy of assessments for fiscal year 1993-94. 4. That the City Clerk shall give notice of said hearing by causing this Resolution to be published, posted, and mailed as provided in Section 22556 of the Streets and Highways Code.
