HomeMy WebLinkAboutReso 93-180 - LMD No. 22 Forest Hills Estates Subdivision formation of territory into LMD and to Levy & Collect Assessments for FY 1993-94 RESOLUTION NO. 93-6_'O LANDSCAPE MAINTENANCE DISTRICT NO. 22 FOREST HILLS ESTATES SUBDIVISION LOTS 1-20 OF UNIT 1, AND REMAINING PARCELS R1 (UNIT 2) , R2 (UNIT 3) , AND R3 (UNIT 4) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING INITIATING PROCEEDINGS FOR THE FORMATION OF TERRITORY INTO A LANDSCAPE MAINTENANCE DISTRICT TO BE KNOWN AS LANDSCAPE MAINTENANCE" DISTRICT NO. 22; AND TO THE LEVY AND COLLECTION OF ASSESSMENTS THEREIN FOR FISCAL YEAR 1993-94, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972. WHEREAS, on October 23, 1992, and following, Petitions and Consents for the Formation of Territory into a Landscape Maintenance District, and to the Levy and Collection of Assessments Therein Pursuant to the Landscaping and Lighting Act of 1972, were signed by the owners of the land as shown on the last equalized County assessment roll--or entitled to be shown as owners on the next County assessment roll--or, where any of said property is subject to a recorded written agreement of sale, are shown therein as purchasers--of all of the territory more particularly hereinafter described; and WHEREAS, said Petitions and Consents were filed with the City Clerk of the City of Redding pursuant to the Landscaping and Lighting Act of 1972 as set forth in the Streets and Highways Code of the State of California, commencing with Section 22500; and WHEREAS, the territory proposed to be formed into a landscape maintenance district, to be designated LANDSCAPE MAINTENANCE DISTRICT NO. 22, is described as follows: All of that certain real property situate in the City \ of Redding, Shasta County, California, being Lots 1 through 20 inclusive of Unit 1 and remaining parcels R1, R2 and R3 of the Forest Hills Estates Subdivision U` i C� I A as shown on the map recorded January 29, 1993 , in Book 21 of Maps at page 3 , Shasta County Records (previously !I APN 110-030-07 , 08 , 11, 12, 13 , and 15) ; and WHEREAS, the purpose of the proposed district is to provide maintenance to those landscaping improvements required within the public right-of-way by the conditions of development approval of Unit 1 and remaining parcels R1, R2 and R3 of the Forest Hills Estates Subdivision; and WHEREAS, upon formation of LANDSCAPE. MAINTENANCE DISTRICT NO. 22, City Council intends to levy the special assessment upon the land equally amongst Lots 1 through 20 inclusive of Unit 1 and remaining parcels R1, R2 and R3 of the Forest Hills Estates Subdivision, which will encompass said district; and WHEREAS, no costs for the original improvements will be assessed against land within the proposed district; all costs of improvements being a condition of the development of said Subdivision; and WHEREAS, only costs for maintenance of landscaping, repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, and any and all incidental expenses, including administrative costs, in connection therewith will be assessed; and WHEREAS, no new improvements or substantial changes in existing improvements are proposed for fiscal year 1993-94; NOW, 'HEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: 1. That the foregoing recitals are true and correct. 2. That the City Council proposes to form LANDSCAPE MAINTENANCE DISTRICT NO. 22 pursuant to the Landscaping and Lighting Act of 1972 (Section 22500 and following, Streets and Highways Code) for the purposes set forth above. 3 . That JAMES KING, Senior Planner, is designated Engineer for the purpose of these proceedings, and is hereby directed to prepare and file a Report with the City Clerk in accordance with 2 i . i Streets and Highways Code Chapter 1, Article 4 (commencing with Section 22565) , of Part 2--Landscaping and Lighting Act of 1972. I HEREBY CERTIFY that the foregoing Resolution was introduced and read at a regular meeting of the City Council of the City of Redding on the 4th day of D7ay , 1993, and was duly adopted at said meeting by the following vote: AYES: COUNCIL.
