A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AWARDING JOB NO. 9325 TO MDS ENGINEERING IN THE AMOUNT OF $78,320.00 FOR PHASE II OF THE SENIOR CITIZENS HALL ADDITION. I�I AND WHEREAS, in accordance with the requirements of Redding Municipal Code Section 4.22, Public Projects, Phase II of the Senior Citizens Hall Addition was bid out under informal procedures based upon the engineer' s estimate of $73, 500. 00. AND WHEREAS, the bid opening was held April 8, 1993 (Job No. 9325) . j AND WHEREAS, the low bid from Burr Construction was determined to be non-responsive as it failed to provide a i bidder' s bond in the minimum amount required by the contract specifications. AND WHEREAS, the second low and responsible bid from MDS Engineering in the amount of $78, 320.00 exceeds the budgeted funds by $3, 320 . 00 . AND WHEREAS, funds to make up this difference, and for contingencies as set forth below, are available from Park Development Funds. ii AND WHEREAS, Section 4 .22.070 F. of the Redding Municipal Code states.: j "If all bids received are in excess of $75,000 . 00, or it as that amount may from time-to-time be amended, the city council may, by passage of a resolution by a four- fifths vote, award the contract, at $80,000. 00 or less, to the lowest responsible bidder if council determines. that the cost estimate of the city was reasonable." AND WHEREAS, of the bids received for the project, the three lowest bids were separated by only $222. 00; this very narrow 4 spread would indicate that the bid prices received were reasonable. AND WHEREAS, the engineer' s estimate was between 6. 3% and 6.6% below the three lowest bidders, which margin is within acceptable limits of standard engineering practices. AND WHEREAS, it is the recommendation of the Public Works Department and the Recreation and Parks Department that Council: I I I ( 1) Award the project to MDS Engineering in the amount of $78, 320 . 00; and ( 2) Authorize the appropriation of $11,500.00 from Park Development Funds for the following purposes: ( a) the shortage of budgeted funds for the project in the amount of $3 ,320 .00. (b) $4,280.00 to cover the cost of architectural services. (c) $3 ,900. 00 to cover the cost of contract change orders. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding that: 1. The foregoing recitals are true and correct. 2. The bid received from Burr Construction (Job No. 9325) is hereby rejected. 3 . The project be awarded to MDS Engineering in the amount of $78,320. 00 . 4. That the appropriation of $11, 500. 00 from Park Development Funds is hereby approved for the following purposes: the shortage of $3 , 320 .00 in order to award the project; $4,280. 00 to cover the cost of architectural services; and $3,900. 00 to cover the cost of contract change orders. 5. That the City Manager is hereby authorized to sign contract change orders up to the maximum appropriation of $11, 500. 00.
