A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
ORDERING THE VACATION AND ABANDONMENT OF A PORTION OF
OPEN SPACE EASEMENT ON LOT 35 (2614 DAWNRIDGE DRIVE)
DEDICATED TO THE CITY OF REDDING WITH THE RECORDING OF
UNIT 5 OF THE COUNTRY HEIGHTS SUBDIVISION (A-12-92)

WHEREAS, proceedings have been duly conducted and held in
accordance with the provisions of California Government Code
Section 51090, et seq. ; and
i! WHEREAS, the City Council of the City of Redding finds and
determines that the hereinafter described portion of open space
easement on Lot 35 dedicated to the City of Redding with the
recording of Unit 5 of the Country Heights Subdivision should not
have been so designated;
NOW, THEREFORE, the City Council of the City of Redding

hereby finds, resolves, and orders as follows:
i 1. The City Council makes the following findings in
'I
connection herewith:
( a) That no public purpose described in Section 51084
will be served by keeping the land as open space;
and
(b) That the abandonment is not inconsistent with the
purposes of Article 4, Termination of an Open-
space Easement, of California Government Code
Section 51090, et seq. ; and
(c) That the abandonment is consistent with the
Redding General Plan; and
(d) That the abandonment is necessary to avoid a
substantial financial hardship to the landowner
due to involuntary factors unique to it.
2. The City Council hereby ratifies the Negative
Declaration prepared for this project showing that it has no
substantial impact upon the environment and that an environmental
impact report is not necessary.

3 . That certain real property in the City of Redding,
County of Shasta, State of California, being open space easement
'I
dedicated to the City of Redding with the recording of Unit 5 of
the Country Heights Subdivision as the same is more particularly
described in the legal description and appurtenant map attached
hereto as Exhibits A incorporated herein by reference, be and the
same is hereby vacated and abandoned as open space, SUBJECT to
the following condition:
( a) That this abandonment shall not become effective
until the abandonment fee, if any, that the
property owner must pay to the County Treasurer
has been paid in full.

4. When the above condition has been met, the City Clerk
of the City of Redding is directed to record a certified copy of
,i this Resolution, attested to by the City Clerk under the seal of
the City of Redding, in the office of the Shasta County Assessor/
Recorder.

I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of

the City of Redding on the 16th day of February 1993 , and was
ij adopted at said meeting by the following vote:

Lot 35 Country Heights Subdivision
A parcel of land situate in Section 15 of the P. B. Reading Grant in the City of Redding, Shasta
County, California, being that portion of the "Open Space Easement" within Lot 35 of the country
Heights Subdivision, Unit 5, as shown on that certain map recorded in Book 19 of Maps, Page 93,
and corrected by Certificate of Correction, recorded in Book 2786 Official Records, Page 344,
Shasta County Records, lying Southwesterly of the following described line:
Commencing at the Southernmost corner of said Lot 35; thence along the Southerly line thereof,
S87°47'01"E, 180.00 feet; thence N58051518"E, 50.00 feet, to the Point of Beginning; thence,
leaving said Southerly line of Lot 35, N70000'00"W, 65.00 feet; thence N46°26'30"W, 140.26 feet,
more or less, to a point on the Northwesterly line of said Lot 35 and the Point of Termination.
