DPW-28 (1-81) PROVISIONS 1.Authorization to Proceed Signing this form shall be construed as authorization by Client for Lawrence&Associates to proceed with the work unless otherwise provided for herein. 2. Direct Expenses Lawrence & Associates'direct expenses shall be those costs incurred on or directly for the Client's Project, including but not limited to necessary transportation costs including mileage, meals and lodging, laboratory tests and analyses, computer services, telephone, printing and binding charges. Reimbursement for these expenses shall be on the basis of the attached Schedule of Fees. 3. Outside Services When technical and professional services and subcontracted labor and equipment are furnished by an outside source, reimbursement for these expenses shall be on the basis of the attached Schedule of Fees. Lawrence& Associates may require the client to contract for, and pay for, these services directly. i 4. Professional Standards Lawrence&Associates shall be responsible to the level of competency presently maintained by other practicing professional engineers in the same type of work in Client's community, for the professional and technical soundness,accuracy, and adequacy of all designs,drawings, specifications, and other work and materials furnished under this Authorization. Lawrence&Associates and/or David A. Lawrence makes no other warranty,express or implied. 5. Terminallon Either Client or Lawrence&Associates may terminate this Authorization by giving 30 days written notice to the other party. In such event, Client shall forthwith pay Lawrence&Associates in full for all work previously authorized and performed prior to effective date of termination. If no notice of termination is given, relationships and obligations created by this Authorization shall be terminated upon completion of all applicable requirements of this Authorization, except for the provisions of paragraph 4, 6, 7 and 8, which shall continue in effect as provided by law. 6.Arbitration All claims disputes,and other matters in question arising out of,or relating to,this Authorization or the breach thereof may be decided by arbitration in accordance with the rules of American Arbitration Association then obtaining. Either Client or Lawrence&Associates may initiate a request for such arbitration. No arbitration arising out of, or relating to this Authorization may include, by consolidation,joinder,or in any other manner,any additional party not party to this Authorization. 7. Hold Harmless Client agrees at all times to defend, indemnify, hold harmless and provide all legal defense and related services to Lawrence&Associates and/or David A. Lawrence, its officers,agents and/or employees (hereinafter collectively "Lawrence") for any and all claims,expenses, demands, causes of action, liability,loss or injury regardless of their nature or character in any manner whatsoever arising out of(1)any third persons use or reliance on the work performed under this agreement,(2)any alleged or proven act or omission of Lawrence,or(3)any litigation or arbitration or the like regarding the work performed under this agreement involving third persons not parties to this agreement and Lawrence&Associates and/or David A. Lawrence. 8. Litigation Liability for damages proximately caused by Lawrence&Associates and/or David A. In the event the client makes a claim against Lawrence& Associates and/or David A. Lawrence, at law or otherwise, for any alleged error,omission or other act arising out of performance of our professional services,and the client fails to prove such claim,then the client shall pay all costs incurred by Lawrence&Associates in defending itself against the claim. The proposed work will be performed in conformance with the Cleanup and Abatement Order (Order) from the Regional Water Quality Control Board, dated April 28, 1993 (Attachment C). The Order requires that a plan must be submitted to the Regional Board by May 30, 1993, describing how the City intends to upgrade current leachate and storm-water conveyance systems. In discussions with the Regional Board, the following tasks have been identified to meet the requirements of the Order. It is assumed that these items will be addressed in the work plan in a conceptual manner so that the Regional Board and City may request changes prior to formal design. The scope of work for design, inspection, and the construction report are described following the tasks. TASKS (1) Eliminate runoff from greenwaste area from entering leachate system It will be the responsibility of the City to determine the most appropriate means to eliminate runoff from the greenwaste area. Lawrence & Associates will provide assistance, as needed, on a time and expense basis to help make this determination. i _ - Ms. Sue Hanson Attachment A City of Redding May 12, 1993 Page 2 of 16 If the City chooses to install a retention pond by the greenwaste area, Lawrence & Associates will determine the total runoff for the area provided by the City, for a 100-year 24-hour storm event. The option chosen by the City will be drafted onto a site map and shown as part of the storm- water runoff improvements in the work plan submitted to the Regional Board. (2) Shorten or remove laterals beneath the floor of the pond at the toe of the landfill Two leachate-collection laterals extend outward from the manhole at the toe of the landfill (Figure Al and Figure A3, photos 9 and 10). A dual purpose of the laterals is to drain residual water out of the pond. However, on March 23, 1993 the leachate collection system backed-up creating pressure within the laterals. The hydraulic pressure on the north end of the northern lateral caused piping in the soil beneath the containment berm. As a result, the fines were washed out of the soil beneath the berm creating a conduit for migration of leachate into Linden Creek. Although the point of leakage was temporarily patched, runoff next winter will likely wash the patch away allowing stream water to enter the leachate collection system, or allow leachate to leave the system into the Creek (depending on the relative water levels). Lawrence & Associates will describe in the work plan and preliminary design how the laterals will be excavated and inspected and the decision process for deciding whether to shorten or remove the laterals and then how to backfill the trench to prevent further piping. Lawrence and Associates will also incorporate repair of the containment berm into the erosion repair and energy dissipator pool construction as described in tasks below. Lawrence & Associates will provide inspection of the excavation to determine whether to remove or shorten the leachate-collection pipes. I I I Ms. Sue Hanson Attachment A 'i City of Redding May 12, 1993 Page 3 of 16 ' (3 and 4 ) Repair damaged embankment and excavate and replace remaining embankment Piping caused by leach pipes, along with erosion from the stream channel along the b embankment face (Figure A2, photos 4 and 5), has damaged the embankment around the pond to the degree that its integrity for holding water and resistance to failure have been compromised. Therefore, the affected portions of the embankment must be removed down to native soil and replaced with properly compacted soil. The drainage along the south side of the landfill up to Starlight Drive, has downcut between the pond embankment and the bank of native soil to the south creating a vertical-walled gully approximately 10 feet deep by 8 feet wide (Figures Al and A2, photo 8). This is due primarily to the drainage channel being undersize to accommodate the recent storm event. The embankment for the pond has been undercut and is susceptible to failure. In a letter from Mr. Clayton Coles of Lawrence & Associates to Mr. Ron Masin ale of the Yt g City of Redding, item 4 recommended testing of the undamaged portions of the embankment to assure it meets compaction requirements. A subsequent inspection of the soil indicates that is contains far too much rock to test by a neutron densimeter and is poorly suited for testing by the sand-cone method. The original construction of the pond is composed primarily of cobbles and is not competent material for the existing embankment construction. Coupled with the need to excavate for the removal of leachate-collection pipes, this embankment should be removed to native soil and replaced with properly compacted material. Lawrence & Associates will develop a final configuration for the re-built pond based on volume requirements for collecting runoff. The final configuration will be developed to maximize volume and minimize erosion. The conceptual design along with volume and flow calculations, and embankment excavation and construction requirements will be presented in the work plan. i l _ Ms. Sue Hanson Attachment A City of Redding May 12, 1993 Page 4 of 16 (5) Provide for adequate spillway The spillway overflow pipes from the containment pond are inadequate to carry expected flows from a 100-year event (Figure Al and Figure A3, photos 6 and 7). Re-sizing and design of this over-flow will be incorporated into the repair of the drainage structure and energy dissipator as described in the tasks below. (6) Reconfigure manhole inlet to allow a maximum of 0.7 mg/d A concern of the sewer department has been that the 0.7 million-gallons-per-day (mg/d) capacity of the sewer line down Linden Canyon will be exceeded, therefore, a restrictor valve was installed on the sewer line. During the March 23 storm, the sewer line became clogged at the restrictor valve causing leachate to back up into the leachate-collection system, leading to the failure of the system. To prevent this occurrence in the future, the restrictor valve must be left open and/or the entry of surface water into the system must be designed to be debris free. To accomplish this, it is recommended that the inlet to the system should be reconfigured to allow a maximum of 0.7 mg/d minus the maximum expected flow of leachate. This would be done by sizing the inlet pipe to allow a regulated flow. The configuration would also require a trash rack to minimize clogging. Lawrence & Associates will proved a design for this system in the work plan. I (7) Replace the culvert along the north edge of the toe of the landfill to Closure standards The culvert which drains Linden Creek along the north side of the toe of the landfill is of insufficient capacity for a 100-year storm event, as was demonstrated during the March 23 storm when the inlet was overtopped and severe gully erosion occurred on both sides of the culvert completely exposing the culvert along part of its reach. (Figure Al and Figure A2, photos 1 through 3). Th prevent this from occurring again, it is recommended that the drainage be upgraded to closure-regulation standards. ' I j Ms. Sue Hanson Attachment A City of Redding May 12, 1993 Page 5 of 16 The closure plan had originally included leaving the existing 36-inch culvert in place and adding a concrete overflow channel. However, because the soil was washed away from the culvert and was subsequently replaced with uncompacted fill, the adequacy to withstand further erosion has been reduced. This was demonstrated by a flow of several gallons per minute (May 7, 1993) which entered the culvert but did not exit the bottom of the culvert, which would indicate some degree of piping is occurring around the pipe. Failure of the culvert would most likely result in failure of the proposed adjacent overflow channel because of an inadequate foundation for the overflow channel; therefore, either the existing culvert must be removed and replaced using proper construction practices, and then the proposed overflow channel be installed, or preferably, the existing culvert be removed and replaced with a larger culvert(s). Because the existing culvert must be removed in any case, it is recommended that a larger pipe be installed and the spillway eliminated. The larger culvert would be placed north of the existing culvert in undisturbed native soil. Lawrence & Associates will provide a conceptual design in the work plan. Preliminary and final design will be performed after approval of the work plan. DESIGN Design will include the following tasks: A. Prepare preliminary survey for topography and construction control Because the culvert area has been regraded, the existing topographic maps are not adequate for design of construction, Lawrence & Associates will provide a revised topographic survey of the culvert area. The survey coverage will include (1) channel and headworks at the crest of landfill, (2) profile and cross-sections along proposed location of new drainage, (3) topographic data of lower containment pond and embankment, and (4) locations of all improvements such as wells, sewer lines and improvements. Prepare preliminary design for storm damage repair (1) Perform calculations for sizing of drainage structures and facilities along the north and south sides of the landfill from the crest of the landfill to the natural drainage to the east of the pond, and the energy-dissipation pool at the base of the fill in the natural channel. (2) Prepare project overview and plan and profile drawings of proposed design for City of Redding and RWQCB review. (3) Provide typical sections of proposed drainage facilities and lower pond levee repair. (4) Provide preliminary engineer's estimate for project construction. C. Meet with the City of Redding and RWQCB officials to review preliminary design (1) Incorporate changes agreed to by the City and RWQCB. (2) Reach concurrence on design concepts and proposal for final design, and items of work to be included in the current construction contract. D. Complete construction drawings and specifications (1) Provide approximately 6 sheets of construction drawings, including plan and profile sheets of drainage facilities, headwall and energy dissipator details, typical cross-sections of drainage and embankment construction details, and final grading plan. E. Review final design and contract package with City of Redding and RWQCB officials and obtain necessary approvals i (1) Submit final drawings and specifications to the City of Redding for contract action. F. Construction Engineering (1) Provide construction inspection or monitoring of construction items to insure conformance toplans and specifications. (2) Review and approve any changes proposed by the contractor or the City during construction. i (3) Perform material sampling for compliance with technical specifications. (4) Prepare final construction report and as-built drawings for the completed project indicating final locations, elevations, and incorporate any changes approved during construction. CONSTRUCTION INSPECTION Lawrence & Associates will provide inspection of the following items: (1) Excavation and shortening or replacement of the leachate-collection laterals. Inspection of concrete will include slump, water/cement ratio and admixtures of each truck. I (4) Installation of the spillway including concrete inspection as described above. I Acceptance of this proposal is contingent upon Lawrence & Associates providing construction inspection and field testing of backfill/embankment densities and other appropriate tests. Inspection would be provided by either a registered civil engineer or a certified engineering l geologist. AS-BUII,TS AND CONSTRUCTION REPORT After completion of the work Lawrence & Associates will develop a construction repot including as-built plans, quality assurance/quality-control testing (meeting closure requirements), and a narrative description of the construction methods, practices, and variances from design.
