MacDonald Co. ,I RESOLUTION NO. q_1- LZq A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING AND AUTHORIZING EXECUTION OF A STEAM SOURCE MODIFICATION CONTRACT FOR THE REDDING POWER PLANT, TO BE ENTERED INTO BY AND BETWEEN THE CITY OF REDDING AND THE R.F. MacDONALD COMPANY, IN THE AMOUNT OF $1,647,250. WHEREAS, at its February 16, 1993 , regular meeting, the City Council rejected the original bid for auxiliary boilers, and authorized staff to negotiate for the necessary materials and services needed to optimize the economics of modifying the steam source for the Redding Power Plant; and WHEREAS, subsequent to said authorization, staff began negotiating with five potential suppliers of the necessary materials and services; and ,i WHEREAS, after extensive and intensive negotiations, the i) most complete proposal, offering the greatest flexibility for operations, the greatest operating economy, and the lowest price, was from the R.F. MacDonald Company in the amount of $1,647, 250. 00 as embodied in the attached draft contract in substantially final form; and WHEREAS, it is the recommendation of the Electric Department that the City enter into a contract with the R.F. MacDonald Company to design, furnish, and install the necessary materials ' and services to achieve the steam source modification required at the Redding Power Plant; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding that: 1 . The foregoing recitals are true and correct. 2. Council believes entering into a Steam Source -� Modification Contract with the R.F. MacDonald Company will w benefit City Electric Utility customers. ;I 'I 3 , The City Council of the City of Redding hereby awards the contract for the Redding Power Plant steam source modification to the R.F. MacDonald Company in the amount of $1,647,250 . 00, subject to approval by the City Attorney of the contract documentation in final form without substantive change. i 4. That the Mayor of the City of Redding is hereby authorized and directed to sign said Contract on behalf of the City of Redding; and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the 'I official seal of the City of Redding thereto. INSTRUCTIONS TO CONTRACTOR DRAB I A. 1 GENERAL. Contract is between the City of Redding, California, hereinafter referred to as the "Owner", and the R.F. MacDonald Company, hereinafter referred to as the "Contractor" . This contract is for steam source modification work which will be incorporated in the Owner's Redding Power Plant Steam Source Modification Project. Section lA of the contract documents defines the scope of the work to be included in the contract. The City shall have the right to approve or disapprove all subcontractors. A.2 CONTRACTOR QUALIFICATIONS. The Contractor may be required to demonstrate that they are qualified to satisfactorily perform the specified work. Upon request, the Contractor shall submit written evidence of his qualifications to the Owner in duplicate. Such evidence shall include all information necessary to certify that the Contractor: Is properly licensed under state of California statutes; Maintains a permanent place of business; Has available the construction plant and equipment to do the work; Has technical knowledge and practical experience in work of the type specified; Has available the organization and qualified manpower to do the work; Has adequate financial status to meet the financial obligations incident to the work; Has no just or proper claims pending against him or his work; and Has constructed other facilities of similar type and of equal or greater size and complexity. The evidence shall consist of a listing of the facilities indicating the owner's name, location, approximate dollar value, type of facilities, date of completion, and the size and operating conditions of major equipment. A.3 CONTRACT DOCUMENTS. All contract documents are the property of the Owner. A.3.1 Signatures. The Contractor shall sign the contract with an authorized signature and shall give his full business address. The Contractor's name stated on the contract shall be the exact legal name of the firm. The names of all persons signing shall also be typed or printed below the signature. Contract by a corporation shall be signed in the official corporate name of the corporation, followed by the signature and designation of the president, secretary, or other person authorized to bind the corporation. A contract by a corporation which is signed by a person who affixes to his SPECS\296 A-1 signature the word "president," "secretary," "agent," or other designation, without disclosing his principal, may be rejected. Satisfactory evidence of the authority of the officer signing in behalf of the corporation shall be furnished. Bidding corporations shall designate the state in which they are incorporated and the address of their principal office. A.4 Equipment and Materials. The Contractor shall submit all specifications, preliminary drawings, and similar descriptive information necessary to describe completely the equipment and materials he will furnish. i All equipment and materials to be supplied under this contract shall be new in I every respect. A.4.1 Contractor's Field Organization. The Contractor shall submit an organization chart showing the names of field management, supervisory, and technical personnel, and the details of the management, supervisory, and technical organization which he proposes to use for this project. The Contractor's organization will be subject to the review and acceptance of the Owner. The experience record of the Contractor's field superintendent shall also be submitted. A.5 LOCAL CONDITIONS. The Contractor has visited the site of the work and thor- oughly informed himself of all conditions and factors which would affect the prosecution and completion of the work, including, but not limited to, the arrangement and condition of existing or proposed structures affecting or which are affected by the proposed work; the procedure necessary for maintenance of uninterrupted operation; the availability and cost of labor; and facilities for transportation, handling, and storage of materials and equipment. I 'j It is understood and agreed that all such factors have been properly investigated and considered. No claims for financial adjustment to this contract will be permitted by the Owner which are based on the lack of such prior information or its effect on the cost of the work. Visits to the site shall be coordinated with the Owner by telephoning Mr. Phil 'I Heckenberg at (916) 245-7020. A.6 PRICING. The contract shall be firm priced in all respects. i A.7 TAXES, PERMITS, AND LICENSES. The Contractor shall be responsible for the applicable taxes, permits, and licenses at Contractor expense except for permits to operate the Redding Power Project. A.8 TIME OF COMPLETION. The time of completion of the work is of the essence of the contract. The contract shall be based upon completion of the work in accordance with the specified schedule. It will be necessary that the Contractor satisfy the Owner of his ability to complete the work within the stipulated time. In this connection, attention is called to the provisions of the General Conditions relative to delays and extensions of time. A.9 WORK SCHEDULE. The contract shall be based on a work schedule consisting of a single 8 hour shift, 5 days a week. A work schedule other than 5 day, 8 hour shifts may be necessary at the option of the Owner. The Contractor shall be responsible for determining the types of subsurface materials which will be found. ,I I' I SPECS\296 A-3 FTGENERAL DESCRIPTION AND SCOPE OF THE WORK A lA. l GENERAL. This section covers the general description scope e of the work, and supplementary requirements for the work included under this contract. 'I The Redding Power Project site is located at 17120 Clear Creek Road, Redding, California, 96001. The work covered by this contract will be to design, furnish and install i modifications to the existing Redding Power Plant steam boilers. 1A.2 PERFORMANCE GUARANTEES The Contractor guarantees that the boilers at the Redding Power Plant will achieve at least the operating characteristics described below: GUARANTEES OF PERFORMANCE FOR EACH BOILER i Burner heat input: 2 x 103.4(10)6 BTU/hr � Burner turndown: 8 to 1 NOx on natural gas: .043 ib/(10)6 BTU, 35 ppm j NOx on propane: .07 lb/(10)6 BTU, 60 ppm Steam production: 150,000 lbs/hr, 760 deg. F. , 625 psig at superheater outlet Feedwater temp. to economizer: 260 deg. F. Feedwater temp. from economizer: 388 deg. F. Flue gas temp. to economizer 731 deg. F. Flue gas temp. from economizer: 290 deg. F. Combustion efficiency of boiler on wood, 50% moisture: 74.7%, 40% excess air Combustion efficiency of boiler on gas: 85.0%, 12% excess air Overall efficiency on wood: 73.2 Overall efficiency on gas: 83.5 '! Natural gas supply: 50 psig LPG supply: 10 psig 'i 1A.3 WORK INCLUDED UNDER THIS CONTRACT. The work under this contract shall include all necessary design work and engineering; furnishing all necessary equipment and materials; providing all labor, supervision, administration, and management services, specifications, drawings, and other contract documents, except as specifically excluded under WORK NOT INCLUDED UNDER THIS CONTRACT. The contract shall include modifying the existing Riley-Stoker wood-fired boilers to burn natural gas, LPG and/or hogged wood fuel in such a manner that natural gas, LPG and hogged wood fuel can be utilized to generate steam. The work covered by these specifications includes design, procurement and installation and testing of all necessary materials and equipment including mechanical, electrical, controls and instrumentation as well as modifying and/or interfacing with existing facilities. 1 SPECS\296 1A-1 'I DESCRIPTION OF WORK DRJ I GENERAL The existing 40 MM BTU Coen burner in each boiler will be replaced with two Todd 103.4 MM BTU Low NOx burners. The existing bare tube economizer and air preheater will be bypassed with isolation dampers and the gases diverted to a new finned tube economizer for maximum efficiency. The existing fans will be reused as part of the base bid. Variable speed drives will be installed on existing induced and forced draft fans. The Bailey Net 90 controls will be modified to control the gas burners' variable speed fan drives. A flue gas recirculation fan will be installed to control superheat. BURNERS Each boiler will require two b ners in order to prevent flame impingement and provide a more uniform furnac heat release. One burner will be installed where the existing Coen burner is The other burner will be installed above the first burner. The burners will incorporate flue gas recirculation plenums. The plenums will be used primarily for recirculation of flue gases to maintain mass flow through the superheater. The burners will be fired in tandem, using one fuel train and gas control valve. The burners will be equipped for future conversion to independent firing. The air and fuel flow will be fully metered with oxygen trim for optimum control and efficiency. ECONOMIZER The existing air preheat exchanger and economizer will be bypassed and replaced with a rectangular finned tube economizer. This approach is taken to: 1) improve system efficiency on gaseous fuel by reducing the exit gas temperature to the minimum acceptable level; 2) reduce overall system pressure drop and reduce fan power requirements. The feedwater piping will be modified to accommodate the new economizer. Bypass, drain, vent and relief valves as required will be provided. The HP feedwater heater will be used with the new economizer to control exit gas temperature on low loads and on days with low ambient temperature. This allows selection of an economizer for maximum efficiency. FGR FAN The FGR fan will be used to maintain mass flow and heat transfer through the existing unmodified superheaters to reduce Nox formation. The FGR fan will recirculate flue gas from the boiler outlet to the burner FGR plenum at rates up to 45% mass flow. The Contractor may recirculate gases from the downstream side of the economizer, dropping the FGR fan HP from 125 HP to 75 HP. The Contractor may determine the most appropriate FGR flow scheme for maximum performance and efficiency. BAILEY NET 90 SYSTEM The existing Bailey Net 90 controls will be modified used to include control of the new gas burners and the variable speed fan drives. Existing control screens SPECS\296 1A-2 DRAFJ will be documented and then modified to incorporate control and monitoring of the new gas burners and variable speed fan drives. The Bailey hardware was inventoried and the additional I/O required for the burners will be installed. All changes to the. Bailey System, as the result of the work under this contract will be provided by the Contractor. BURNER MANAGEMENT SYS S TEM The existing Coen termination panel and BMS insert panel will be reused. The I Coen BMS will be modified to safeguard two tandem-fired burners. The wood burner j injection system capability of the existing Coen burner will not be used and will be removed. The Coen panel was inspected and found to be in excellent shape. BOILER FANS 'I The existing Buffalo Forge forced draft and induced draft fans will be used for gas firing. In order to improve system control on both gas and wood firing, extend equipment life, improve burner turndown and substantially reduce operating costs, Contractor will provide and install a variable speed control system on • both fans. Major components of the work under this contract for the Redding Power Plant shall include, but not be limited to, the following: 1. Design, furnish and install all interfaces with existing water, steam, air, electrical and flue gas systems. 2. Testing and startup supervision and training of Owner's employees or Owner's 0 & M contractor's employees for all Contractor-installed equipment and controls. 3. Air pollution control and monitoring equipment including flue gas recirculation systems. 4. Concrete mat, concrete foundations, pilings (if required) , floors and anchor bolts installed in place for all equipment furnished by Contractor. 5. All required structural steel for components, pipe support anchors, and enclosures. 6. Additions and/or modifications to the existing centralized control room Bailey Network 90 distributed control system including necessary hardware, software and configuration changes. 7. Local transducers, controllers, signal converters, gauges, and control devices mounted in cabinets, panels or installed in the process lines and interconnected with control room devices and controls. 8. All required connecting process piping and tubing, valves, ducts, dampers, expansion joints, specialties, and pneumatic tubing. I'1 SPECS\296 1A-3 9. Thermal and antisweat insulation for all piping and equipment provided under this contract. 10. Electrical equipment and material consisting of the following: a. Complete raceway system including manholes, underground duct bank, cable trays, con- duit, pull boxes, and junction boxes as necessary for Contractor's design. I b. Insulated wire and cable for 5 kV and 600 volt 'I power, control, instrumentation, and lighting. C. Plant grounding system modifications d. Required motor control centers, transformers, and necessary control and auxiliary equipment. Existing 4 kV equipment/motors shall be reviewed and reused where possible. 11. One complete set of special tools and devices required for service and maintenance of all equipment furnished under this contract: Such as dollies, hoists, rigging and carriages unique to the equipment and required for maintenance. 12. All equipment, components, piping and conduits for the following system modifications (if required) . a. Feedwater b. Main steam C. Boiler vents, drains, extraction and process steamlines d. Closed cooling water e. Station service air and control air f. LPG system must include a necessary equipment and controls to utilize LPG delivered to boiler site by others. As delivered LPG will be pumped from storage facility to location where natural gas line presently enters Boiler Building. Natural gas will be delivered to boiler site by others. The delivery location will be where the natural gas line presently enters the Boiler Building. The natural gas pressure will be not less than 50 psig. g. All other systems required for a complete natural gas/LPG-fired steam generation plant 'I 13. All equipment, components, hardware, materials, enclosures and 'I SPECS\296 1A-4 l 1; t 1 mechanical and electrical inter- and intra-connections to provide a complete, centrally controlled steam supply for the Redding Power Plant. 14. Temporary construction offices for Contractor. 15. A complete list with pricing of manufacturer's recommended spare parts for startup and the first year of operation. 16. Instruction, operation, and maintenance manuals for all equipment supplied. 17. If required, site qu , preparation including, but not limited to, surveying, subsurface investigations and geotechnical work, building design, grading, clearing, backfill, razing of existing structures, and licensed disposal of razed material. 19. Field service engineers for technical assistance during construction, testing, and startup. The above explanations and listings are intended to give a general definition of the scope of the Work under this contract, and shall not be construed to be an itemized listing of each element of work required. The Contractor shall be responsible for engineering, design, and construction of complete facilities, conforming in all respects to the details and requirements of the specifications, drawings, and other contract documents including any addenda or modifications thereto. All engineering shall be performed and certified by licensed professional engineers registered in the state of California. ;i The Contractor shall perform all work to completion and shall furnish a working supervisor for the duration of the work. The Contractor shall take title to and handle all waste material in accordance with all local, State and Federal guidelines and regulations. Where applicable, the Contractor shall dispose of chemical waste through recycling thus avoiding hazardous waste permits and identification numbers. The Contractor shall bear all costs for recycling. Waste material includes scrap metals, excavation debris, concrete, wood material, pipe insulation or any material generated as a result of the modification. The existing Coen gas burners are not to be considered waste material. The Coen gas burners and all related existing gas firing equipment will be removed intact and placed at ground level for disposal by the City of Redding. The above explanations and listings are intended to give a general definition of the scope of the work under these specifications, and shall not be construed to be an itemized listing of each element of work required. The Contractor shall be responsible for complete performance of all the activities under this Contract, conforming in all respects to the details and requirements of the j specifications, drawings, and other contract documents. 1A.4 SCOPE OF WORK The following outline highlights and provides detail for the scope of work covered in General Description 1A.3. The outline is broken down into three main areas, Engineering, Construction and Startup/Testing. The work identified below i SPECS\296 1A-5 • DR is not necessarily complete and the Contractor will be responsible for additional work as needed to provide a complete, operable and efficient gas-fired power plant conforming to owner specifications, NFPA 85C, ASME Pressure Vessel Code, ANSI Power Piping Code and other applicable codes and standards. I'I ENGINEERING i 1. Site inspection with structural, mechanical, electrical and controls engineers, pressure vessel inspector and boiler design engineer. II 2. Participate in owner's design conference. i� 3. Provide all pertinent construction drawings, equipment specifications and control system data. 'I 4. Make necessary field measurements for new equipment and required �I modifications-. 5. Download existing Bailey Net 90 system and generate existing or "as found" control configuration drawings. 6. Prepare complete boiler gas-firing system process and instrument diagrams including: I I a. Burner management system b. Main fuel piping C. Igniter fuel piping d. Combustion controls for gas only, wood only and gas/wood firing e. Propane vaporizer f. Economizer temperature control g. Variable speed drives for FD and ID fans _J 7. Prepare final FGR fan, burner, economizer, dampers, propane vaporizer, transformers, variable speed drive and other equipment design and construction details. 8. Prepare complete foundation design drawings for economizer supports, :! electrical equipment room, FGR fan and propane vaporizer. 9. Provide complete mechanical drawings for duct work layout and design, piping arrangement. 10. Provide complete electrical drawings for medium voltage system interface with existing power supply, transformers, variable speed drives, control instrument wiring. I 11. Provide complete boiler/burner setting drawings for tube wall modifications, refractory installation, stoker lay-up for gas firing, protection details for overfeed and overfire air ports, Front grate ash hoppers and all other unused furnace openings. 12. Prepare equipment operating and maintenance manuals. 'I 13. Prepare operating instruction manuals. SPECS\296 1A-6 I 14. Prepare operator training program. CONSTRUCTION I� 1. Purchase all major equipment pieces and expedite to assure timely delivery. 2. Modify furnace reinforcement, furnace pressure and fan controls to bring boiler into compliance with NFPA 85C. 3. Modify rear furnace waterwall tubes to accommodate the new TODD burners, including attachment of burner mounting plate. 4. Hydrostatic test boiler after completion of pressure vessel modifications and provide certified inspector from Hartford if owner's inspector desires. 5. Furnish and install ceramic fiber blanket and two (2) courses of refractory floor tile on stoker bed. 6. Seal and thermally protect overfeed, overfire air and all unused furnace openings. �I 7. Mount and seal weld TODD windbox to burner mounting plate. 8. Mount, pipe and wire new fuel gas valve train and igniter valve train. 9. Excavate, form and pour concrete foundations for FGR fans, economizers, and electrical room. 10. Set FGR fans in place. 11. Fabricate and install FGR duct from boiler outlet to fan inlet and from fan discharge to burner inlets. A flow control damper will be installed on the FGR fan discharge. 12. Set economizer support steel in place. 13. Set economizer on supports. I 14. Modify boiler house wall for new economizer inlet duct. 'i 15. Install economizer inlet duct and transitions from boiler outlet to economizer inlet. Duct to include access manway. i 16. Install manual isolation dampers in economizer and air preheater outlet duct with position limit switches. 17. Install economizer outlet transition and duct from economizer outlet to ID fan inlet. Duct to include access manway. 18. Install economizer inlet and outlet piping with isolation valves, drain and vent valves as required. 19. Install combustion air duct from existing air preheater to TODD burner SPECS\296 1A-7 i windbox inlet, complete with automatically controlled balancing/isolation damper for simultaneous wood/gas firing. li 20. Insulate new and modified feedwater piping to match existing. i 21. Insulate new FGR duct to match existing duct insulation. 22. Insulate economizer inlet duct to match existing. 23. Flash and seal building wall around economizer inlet duct and all other wall or roof penetrations made to accommodate or work. 24. Set, pipe and wire propane vaporizer system. 25. Install propane piping from vaporizer to new burner fuel trains. 26. Set electrical transformers and drivers in place. 27. Erect enclosure for new transformers and drivers. 28. Electrically connect motor drives to existing 4160v services. 29. Electrically connect motor drives to existing 4160v motors. 30. Install and connect new starters and controls for FGR fan motors to existing 480v service. 31. Prime and finish paint steel and bare pipe to match existing finish. 32. Develop and install control screens for new burner installation with all associated hardware. 33. Evaluate existing program logic related to existing aspects of the plant and make recommendations for improvements. 34. Install new gas trains and control valves and gas flow measurement equipment. 35. Install burner air flow measurement and air flow control damper. 36. Install economizer outlet gas temperature transmitter. 37. Install high temperature feedwater heater temperature control loop and control valve for economizer outlet stack temperature control. 38. Install manual damper supervisory switches on all dampers to prove position as required for safe operation of all fuels. 39. Install control loops for variable speed control on FD and ID fans. 40. Install steam blow line from turbine trip throttle valve to turbine building exterior for steam blows prior to startup. The Contractor will remove the steam blow line after steam blow is complete. SPECS\296 1A-8 STARTUP AND TRAINING 1. Startup of the LPG equipment will be by the OEM at contractor expense. 2. Startup of the fan variable speed drives will be by the OEM contractor expense. 3. Startup of the Bailey Net 90 System, as related to the new burner installation, will be by Larry Bergman of ABCS, acting as subcontractor to the Contractor. 4. Balance of equipment startup will be by contractor. S. Sixteen hours of classroom instruction, 8 hours of field instruction and forty hours of operator supervision on Bailey Net 90 System and burner operation. 6. Four hours of classroom instruction each for the variable drives and LPG equipment. 'i PERFORMANCE TESTS The following tests shall be performed and met by Contractor prior to acceptance of the Redding Power Plant modifications by the City of Redding. 1. Flame stability shall be tested by contractor and results approved by the City of Redding. The intent of this test is to assure the City of Redding that the boiler design and modification is safe to operate under adverse conditions and that the Plant can reliably operate and maintain the City of Redding's electrical system integrity under adverse operating conditions over which City of Redding has no control. A. With the boiler out of service and in a cold condition and all other i conditions pertaining to the safe testing satisfied, the burners shall be operated at 8:1 turndown ratio or 1 psig pressure, whichever is lower for natural gas or LPG. Maximum (100%) air flow through the burner at minimum fuel pressure shall not cause the flame to be "blown out" or pulled away from the burner front. .I B. With the boiler in service and in a hot condition and all other conditions pertaining to safe testing satisfied, the burners shall be operated at the specified ramping rate of 15,000 pounds of steam flow/minute/boiler change in steam flow rate both increasing from minimum heat input through maximum heat input and from maximum heat input to minimum heat input. At all times and at all levels of heat input, flame stability shall not be adversely impacted. Flame shall not flicker, change shape, be blown out, pulse or pull away from the burner front. C. The burners will be fired at maximum rated heat input 2 x 103.4 MM BTU for three tests of eight hours each. During these tests, the boilers must produce an average 150,000 pph each of steam flow at 625 psig, 760°F with Nox, CO and other emissions below guarantee SPECS\296 1A-9 i _3 limits. ;I D. The burners shall be operated at the burner turndown ratio of 8:1 for one eight-hour period. During this test, the flame will be stable and the combustion controls will function in the automatic mode within design limits. Flame instability or violation of ' emission limits will be cause for non-acceptance by the Owner. i� E. Stack emissions testing will be at the expense of the City of Redding. Contractor will perform all necessary adjustments to the !i modified steam generator and all its appurtenances to allow such tests to be performed and the conditions of the Authority to Construct as issued by the Shasta County Air Quality Management District to be satisfied. i F. The variable speed fan drives supplied by contractor shall be tested by contractor to assure that speed range, speed stability and electrical integrity are within the manufacturer's specifications. 1A.5 WORK NOT INCLUDED UNDER THIS CONTRACT. The following items of work will be furnished by the Owner. * Operating personnel, lubricants, fuels, power, water for startup and tests. * Provisions for venting or use of steam produced during startup and testing. This does not include the temporary steam blow line, page 1A-8, Item 40. * Emission compliance test. * Source of clean, dry instrument air. i Air pollution permit. Cleaning, maintenance, repair or replacement of existing equipment, controls, duct, piping, etc. that is intended to be reused and functional. * Propane tank, foundation, transfer pump and piping to inlet of vaporizer. 1A.6 COORDINATION MEETING. Representatives of the Contractor shall attend a coordination meeting at a time and place selected by the Owner to discuss matters relative to the execution of this Contract. The Contractor's representatives shall attend additional meetings as required by the Owner thereafter to expedite the work. 1A.7 SCHEDULE. The time of completion of the work is of the essence of the contract. It is necessary that the Contractor perform the activities shown on or before the dates indicated to avoid delay of the entire project. 1A.7.1 Activity Periods and Dates. The time periods and dates listed in the Schedule of Activities indicate the latest dates by which the listed activities shall be completed. Data, drawings, and lists for planning, engineering, and documentation may be submitted earlier than the indicated dates at the Contractor's option. i� SPECS\296 1A-10 I .i 1A.7.2 Modification Milestones. The Contractor shall submit a detailed schedule. The detailed schedule shall be based upon the dates specified in the schedule included herein. The schedule shall utilize the critical path method (CPM) of scheduling and shall be presented in bar-chart form. The Contractor is responsible for determining the sequence and time estimates of the detailed daily activities; however, the Owner reserves the right to require the Contractor to modify any portion of the schedule the Owner determines to be impractical, infeasible, or unreasonable, and as required to coordinate the Contractor's activities with those of other contractors, and to assure the completion of the work by the stipulated date. 'I I I 'I SPECS\296 1A-12 I Section 1B - ENGINEERING DATA ;I 1B.1 GENERAL. This section covers engineering data including manufacturer's drawings which the Contractor shall submit to the Owner for review. Timely submittal of engineering data is essential to the scheduled progress and d completion of the project and is of the essence of this Contract. The Owner will accept engineering data submittals from the Contractor only. !i 1B.2 CORRESPONDENCE. Correspondence forwarding engineering data shall be addressed to the Owner as follows. i The original and one copy to the Owner: a City of Redding, California 760 Parkview Avenue Redding, California 96001-3396 Attention: Phil Heckenberg Letters of transmittal shall accompany all submittals of engineering data and shall include a list of the data included in the transmittal. it SPECS\296 1B-1 DRAB Section 1C - SCHEDULE 1C.1 GENERAL. This section covers the schedule and scheduling requirements for performance and completion of the work included under this Contract. 1C.2 SCHEDULE. The time of completion is of the essence of the contract. The Contractor shall comply with the dates established in the detailed schedule agreed to by the Owner and Contractor. The Contractor and Owner agree that the Owner has the right to delay startup and test work for up to six months after completion of the balance of this contract without additional cost to the Owner. 1C.2.1 Milestone Dates. The milestone dates listed in Section 1A.7.3 of these specifications are associated only with the major items of work under this Contract or indicate key interface dates with the work of other contractors. The completion dates indicated are essential to the work under this Contract and to the coordination and continuity of all work at the site. '! The listing of activities and dates is not intended to be a complete or detailed listing of all work under this Contract or of all interfaces with the work of other contractors. It is understood and agreed that the dates shown in Section 1A.7 are the latest feasible completion dates and that earlier dates may be attained as agreed to by the Owner and Contractor. 1C.3 COORDINATION. The Contractor shall coordinate his work with that of other contractors and shall cooperate fully with the Owner in maintaining orderly progress towards completion of the work as scheduled. This section covers the requirements for temporary services to be provided by the Contractor and the Owner in the prosecution of the work. ! Temporary facilities and utilities provided by the Owner for the Contractor's use shall remain the property of the Owner and shall be returned to the Owner in satisfactory condition when the work is completed. The Contractor shall be responsible for the repair of damage to Owner-furnished temporary facilities when such damage has resulted from the activities under this Contract. y 1D.2 TEMPORARY FACILITIES. The Contractor shall furnish all utilities, temporary facilities, equipment, materials, and supplies required for prosecution of the work but which will not be incorporated in the completed work, unless otherwise specified herein. Prior to installation of any Contractor-furnished temporary facilities on the job site, proposals for such facilities shall be submitted to and written approval received from the Owner. I! All temporary structures and facilities furnished by the Contractor shall remain ;! the property of the Contractor and shall be maintained throughout the work. Any materials, equipment, or temporary structures installed or erected on the job ,I site or within permanent buildings by the Contractor shall be removed by him when so directed by the Owner to permit the execution of other work in connection with '! the project or at the completion of the Contractor's work. All Contractor-furnished temporary facilities shall be in first-class condition and shall be of the proper type and size to perform the work. The facilities shall be regularly and systematically maintained throughout the work to ensure proper, efficient operation. Temporary facilities which are inadequate or improperly maintained shall be promptly modified, repaired, or removed from the 'I site and replaced as directed by the Owner, and at the Contractor's expense. When the work is completed, all Contractor-furnished temporary facilities shall be removed from the site and the area shall be restored to its original condition to the maximum extent practicable. 'I All temporary facilities requiring use of wood shall be constructed of Class A Fire Retardant Pressure Impregnated Wood. Temporary structures for offices, change houses, warehouses, and other uses for the Contractor or his subcontractors shall be provided by the Contractor. Suitable construction trailers may be used in lieu of temporary structures. Such structures or trailers shall be placed only in the locations assigned by the Owner. The Owner will, at its expense, arrange for, develop, and maintain the utilities and services specified as Owner-furnished in the work area to meet the overall requirements of the project construction program. The Owner-furnished facilities will be concurrently used by others, and the Contractor shall not make unreasonable demands on such utilities and services. While reasonable efforts will be made to maintain supply continuity, continuity cannot be guaranteed. The Contractor shall have no claim against the Owner for any loss or inconvenience SPECS\296 1D-1 the Contractor may suffer because of supply interruption. DRA ff i 1D.3 TEMPORARY UTILITIES. Temporary utilities required for the prosecution of the work shall be provided by the Contractor or the Owner as herein specified. i 1D.3. 1 Telephones and Other Site Communication Requirements. The Contractor shall provide his own telephone and other site communications to meet his needs and shall pay all costs associated with such services. 1D.3.2 Compressed Air. The Contractor shall provide all air compressors, fuels, lubricants, hoses, piping, and other apparatus required for supplying compressed air required for prosecution of his work. 1D.3.3 Temporary Power. The Owner will furnish energy for electric power, welding, and temporary lighting at no charge. The use of electric power for heating will not be permitted except as otherwise accepted by the Owner, subject to the provisions of the article in this section entitled Heat. Power will be supplied at 480 volts, 3-phase and 120 volts, single-phase at the load terminals of fused disconnect switches in Owner-furnished load centers or industry standard devices. The Contractor shall connect to the load terminals of the disconnect switches and shall provide all disconnect switches, breakers, transformers, wiring, and other devices required to distribute power for his use and for the use of his subcontractors. Temporary power facilities shall conform with applicable safety and code requirements, shall be constructed to provide proper clearances and minimum interference with work activities, and shall be acceptable to the Owner. All temporary electrical installations must be scheduled by the Contractor and shall be submitted to the Owner in writing with drawings. Approval will only be given in writing. All temporary wiring shall conform with Article 305 - TEMPORARY WIRING of the National Electrical Code. Prior to mobilizing on the job site, the Contractor shall furnish the Owner his anticipated temporary power requirements and schedules. 1D.3.4. Lighting. The Owner will provide lighting for stairwells and walkways in permanent buildings. All other temporary lights required by law or ordinance or necessary for the proper protection of the public and workers or for the proper execution and inspection of the Contractor's work shall be furnished, placed, and maintained by the Contractor at his expense. Portable hand lamps shall be of molded construction. Brass shell, paper-lined lampholders shall not be used. Hand lamps shall be provided with a handle and a guard over the bulb. The guard shall be attached to the lampholder or the handle. Conductors shall be not less than 12 AWG copper and insulated for 600 volts. A fuse shall be provided for the protection of each circuit. 1D.3.5 Water. Water for construction use will be furnished by the Owner at no SPECS\296 1D-2 i DR— �- r charge and will be available at a location or locations designated by the Owner. The Contractor shall provide piping, valves, and hoses as required to distribute the water for his and his subcontractors' use. The Owner will provide a source of supply for sanitary drinking water. The Contractor shall provide sanitary drinking water facilities for his employees including coolers, ice, disposable cups, and a trash barrel at each water cooler. Each dispenser shall be emptied, cleaned, and refilled at the start of each day, it and personnel shall be assigned to assure maintenance of the water supply. i 1D.3.6 Heat. The Contractor shall provide all temporary enclosures and all heating facilities required for the efficient prosecution of the work and to prevent freeze damage during construction. Heating methods shall be submitted to the Owner for acceptance prior to use. Except as otherwise accepted by the Owner, the use of electrical energy for heating will not be permitted. When so approved, electrical energy for heating will be subject to charges as determined by the Owner. Salamanders, open fires, or other methods which constitute a hazard to personnel or property shall not be used. All heating equipment shall be provided with adequate safeguards. 1D.3.7 Sanitary Facilities. The Contractor shall furnish and maintain sanitary facilities, including chemical toilets, for the use of his personnel. Chemical toilets shall be furnished in numbers and locations as required to adequately and conveniently serve the needs of all of the Contractor's personnel and shall meet the requirements of applicable regulations of the appropriate State and local health agencies. Maintenance of the chemical toilets shall include daily inspection, cleaning, and replenishment of chemicals. Construction personnel will not be permitted to use the permanent plant toilet or washroom facilities. 1D.3.8 Access Roads, Parking, and Storage Areas. The Owner will provide access roads, parking, and storage areas. The Owner will assign parking and storage areas for the Contractor's use. j 1D.3.9 Security. The Contractor shall be responsible for all security affecting the prosecution of his work. The Owner will provide and maintain site perimeter fencing. The Contractor shall furnish, install and relocate temporary fencing and barriers as required. All Contractor personnel, except those expressly authorized by the Owner, shall park in areas designated by the Owner. Contractor personnel shall enter and exit the work site from these designated parking areas through control points. Contractor personnel shall be subject to search by the Owner's security personnel at the security personnel's discretion. 1D.3.10 First Aid. The Contractor shall provide for his own first aid requirements. �i 1D.3.11 Fire Protection. The Contractor shall be responsible for fire protection. SPECS\296 1D-3 i 1D.3.12 Trash Collection and Disposal. The Contractor shall be responsible for the cleanliness of his work areas. The Contractor shall provide his own trash collection and disposal services. Trash shall be separated into combustible, noncombustible, and rubble (broken masonry and concrete) materials. Trash shall be hauled to an offsite landfill area for disposal. All petroleum products, thinners, solvents, or other items considered hazardous materials shall be disposed of by the Contractor by means of a hazardous material handling process which meets State of California and Federal requirements. 1D.3.13 Scaffolding. The Contractor shall furnish all scaffolding, staging, ladders, flooring, runways and any other temporary construction required for the execution of his work. All scaffolding, runways, and other temporary construction shall be self- supporting throughout and shall be rigidly built so as to support safely the weight of all materials, apparatus, equipment, and construction personnel to be placed thereon as required by Federal, State and local laws. 1D.3.14 Welding Facilities. The Owner will furnish electric energy at 480 volts, 3-phase as described in Article 1D.3.3 for welding in the central plant area. The Contractor shall furnish all welding machines and other welding facilities required for his work. The Contractor may furnish diesel generator welding machines at his option. i I a -4 SPECS\296 1D SECTION 1E. 1 CONTRACTOR RESPONSIBILITIES 1E.1. 1 This work shall be performed according to the "Standard Specifications for Public Works Construction", except as modified by the Contract Documents. .I 'I SECTION 7 The third paragraph is modified to read as follows: ' In accordance with the Labor Code, the City has on file in the office of the City Clerk of the City of Redding the prevailing wage rate determination made by the Director of Industrial Relations in accordance with the provisions of Sections 1770, 1773, and 1773.1 of the California Labor Code for the types of work to be done under the Specifications. The Contractor shall pay not less than these rates. Attention is directed to Section 1735 of the Labor Code, which reads as follows: No discrimination shall be made in the employment of persons upon public works because of the race, religious creed, color, national original, ancestry, physical handicap, medical condition, marital I status, or sex of such persons, except as provided in Section 1420, and every contractor for public works violating this section is subject to all the penalties imposed for a violation of this chapter. I 1E.1.2 PAYROLL RECORDS - RETENTION AND INSPECTION. Contractor and subcontractor shall keep an accurate payroll record, showing the name, address, social security number, work classification, straight time and overtime hours worked each day and week, and the actual per diem wages paid to each journeyman, apprentice, worker, or other employee employed by him or her in connection with the public work. The payroll record shall be certified and shall be available for inspection at all reasonable hours at the principal office of the Contractor. A certified copy of all payroll records shall be made available for inspection or furnished upon request. 1E.1.3 HOLD HARMLESS: 1. The Contractor shall defend, indemnify, save and hold harmless, the City of Redding, its officers, agents and employees, from any loss demands, claims, suits damages, or actions that may be brought by third persons on account of bodily injury or death; personal injury; damage to property or personal interest; or violation of any law, regulation or ordinance; where the third person's loss, demand, claim, suit, damages or action arises in whole or part out of any negligent or other act or omission of the contracting agency or its officers, employees, and agents, while performing the services agreed to save and except those actions arising out of the sole negligence of the City. SPECS\296 1E.1-1 I ' j :I 1F.1 CONTRACT REQUIREMENTS FOR BONDS, LIQUIDATED DAMAGES, LIABILITY AND WORKERS' COMPENSATION INSURANCE, AND PERMITS I (Excerpted from Part I, General Provisions Plus Modifications) Contract Bonds Before execution of the contract by the City, the Contractor shall file with the City surety bonds satisfactory to the City in the amounts and for the purposes noted below. Bonds shall be duly executed by a responsible corporate Surety, I authorized to issue such bonds in the State of California and secured through an authorized agent with an office in California. Bonds shall be issued by a surety who is listed in the latest revision of U.S. Department of Treasury Circular 570, is authorized to issue bonds in California, and whose bonding limitation shown in said circular is sufficient to provide bonds in the amount required by the Contract. The Contractor shall pay all bond premiums, costs, and incidentals. 'i Each bond shall incorporate, by reference, the contract and be signed by both the Contractor and Surety and the signature of the authorized agent of the Surety shall be notarized. The Contractor shall provide two good and sufficient surety bonds. The "Payment Bond" (Material and Labor Bond) shall be for not less than 100 percent of the contract price, to satisfy claims of material suppliers and of mechanics and laborers employed by it on the work. The bond shall be maintained by the Contractor in full force and effect until the Work is accepted by the City, and until all claims for materials and labor are paid, and shall otherwise comply with the Civil Code. I The "Performance Bond" shall be for 100 percent of the contract price to guarantee faithful performance of all work, within the time prescribed, in a imanner satisfactory to the City, and that all materials and workmanship will be free from original or developed defects. In addition, the Performance Bond shall include a one-year Maintenance Bond which shall begin upon acceptance of work. The amount of the Maintenance Bond shall be for 50 percent of the final contract price. The Maintenance Bond shall be submitted on the form contained in these specifications or on a form which conforms to it within ten ( 10) days after acceptance of the work. Should any bond become insufficient, the Contractor shall renew the bond within ten ( 10) days after receiving notice from the City. Should any surety at any time be unsatisfactory to the Board, notice will be given the Contractor to that effect. No further payments shall be deemed due or will be made under the contract until a new Surety shall qualify and be accepted by the Board. Changes in the Work, or extensions of time, made pursuant to the contract, shall in no way release the Contractor or Surety from their obligations. Notice of such changes or extensions shall be waived by the Surety. SPECS\296 1F-1 Liquidated Damages Failure of the Contractor to complete the Work within the time allowed will result in damages being sustained by the City. Such damages are, and will continue to be, impracticable and extremely difficult to determine. For each consecutive calendar day in excess of the time specified for completion of the Work the Contractor shall pay to the City, or have withheld from monies due it, the sum of $250, unless otherwise provided in the specifications. I Execution of the Contract shall constitute agreement by the City and Contractor that $250 per day is the minimum value of the costs and actual damage caused by failure of the Contractor to complete the work within the allotted time, that such sum is liquidated damages and shall not be construed as a penalty, and that such sum may be deducted from payments due the Contractor if such delay occurs. Liability Insurance The Contractor shall procure and maintain for the duration of the contract insurance against claims for injuries to persons or damages to property which may arise from or in connecting with the performance of the work hereunder by the Contractor, his agents, representatives, employees, or subcontractors. The Contractor shall furnish the City a policy or certificate of liability insurance with original endorsements effecting coverage required by this subsection. The endorsements are to be signed by a person authorized by that insurer to bind coverage on its behalf. All endorsements are to be received and approved by the City before work commences. The City shall be named as an additional insured with the Contractor. Notwithstanding any inconsistent statement in the policy or any subsequent endorsement attached thereto, the City shall be the insured or named as an additional insured covering the work, whether liability is attributable to the Contractor or the Cit The City,y, its officers, officials, employees, and agents are to be covered as insureds for general liability and automobile liability as respects: liability arising out of activities performed by or on behalf of the Contractor; products and completed operations of the Contractor; premises owned, occupied or used by the Contractor; or automobiles owned, leased, hired or borrowed by the Contractor. The coverage shall contain no special limitation on the scope of protection afforded to the City, its officers, officials, employees, or agents. The Contractor may file insurance acceptable to the City covering more than one project. The coverage shall provide the following minimum scope and limits: 1. Insurance Services Office Commercial General Liability coverage (occurrence form CG 0001) in the amount of $5,000,000 per occurrence for bodily injury, personal injury, and property damage. A combined single limit policy with general aggregate limits in the amount twice the required occurrence limit or limits which apply separately to this project/location will be considered equivalent to the required minimum limits. 2. Insurance Services Office Automobile Liability Code 1 (any auto) (form CA 0001, ED 1/87) in the amount of $1,000,000 per accident for bodily injury and property damage. s SPECS\296 1F-2 DRAFT 3. Course of construction insurance providing coverage for "all risks" of loss in the amount of the completed project value. Insurance is to be placed with insurers with current A.M. Best's rating of no less than A:VII. Any deductibles or self-insured retentions must be declared to and approved by the City. At the option of the City, either: the insurer shall reduce or eliminate such deductibles or self-insured retentions as respects the City, its officers, officials, employees, and agents; or the Contractor shall procure a .i bond guaranteeing payment of losses and related investigations, claim administration and defense expenses. i The Contractor shall save, keep and hold harmless the City, its officers, officials, employees, and agents from all damages, costs or expenses in law or equity that may at any time arise or be set up because of damages to property, J or of personal injury received by reason of or on the course of performing work, which may be caused by any willful or negligent act or omission by the Contractor, any of the Contractor's employees, or any subcontractor. The City will not be liable for any accident, loss or damage to the Work prior to its completion and acceptance. All liability policies shall bear an endorsement or shall have attached a rider whereby it is provided that: i) 1. For any claims related to this project, the Contractor's insurance coverage shall be primary insurance as respects the City, its officers, officials, it employees, and agents. Any insurance or self insurance maintained by the 'I City, its officers, officials, employees, and agents shall be excess of the Contractor's insurance and shall not contribute with it. I 2. Any failure to comply with reporting or other provisions of the policies including breaches of warranties shall not affect coverage provided to the City, its officers, officials, employees, or agents. 3. The Contractor's insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability. 4. In the event of expiration or proposed cancellation of such policies for any reason whatsoever, the City shall be notified by registered mail return receipt requested, giving a sufficient time before the date thereof to comply with any applicable law or statute but in no event less than thirty li days before expiration or cancellation is effective. If the "accord form" Certificate of Insurance is used, the cancellation i clause must be modified as follows: "Should any of the above described policies be cancelled before the ;I expiration date thereof, the issuing company will ¢0¢104)io�/-vo mail 30 days written notice to the certificate holder and the City of Redding, California, Ij Course of construction policies shall bear an endorsement or shall have attached I SPECS\296 1F-3 a rider whereby it is provided that: 1. The City shall be named as loss payee. 2. The insurer shall waive all rights of subrogation against the City. The Contractor shall include all subcontractors as insureds under its policies or shall furnish separate certificates and endorsements for each subcontractor. All coverages for subcontractors shall be subject to all of the requirements stated herein. The cost of this insurance shall be included in the Contractor's Bid. Workers' Compensation Insurance Before execution of the Contract by the City, the Contractor shall file with the City the following signed certification: "I am aware of the provisions of Section 3700 of the Labor Code which require every employer to be insured against liability for workers' compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions of that code, and I will comply with such provisions before commencing the performance of the work of this contract." Said certification is included in the contract by reference, and signature and return of the contract shall constitute signing and filing of the said certificate. The Contractor shall also comply with Section 3800 of the Labor Code by securing, paying for, and maintaining in full force and effect for the duration of the contract Workers' Compensation Insurance, with limits as required by the Labor Code of the State of California and Employee's Liability, with limits of $5,000,000 per accident. The Contractor shall furnish a Certificate of Insurance to the City before execution of the Contract. The agency, its officers, ,i officials, employees, and agents, will not be responsible for any claims in law or equity occasioned by failure of the Contractor to comply with this paragraph. All compensation insurance policies shall bear an endorsement or shall have attached a rider whereby it is provided that, in the event of expiration or proposed cancellation of such policies for any reason whatsoever, the City shall be notified by registered mail not less than thirty days before expiration or cancellation is effective.
