A7Nfit PAST--!U CITY OF REDDING FEB 5 1993 RESOLUTION NO. 3�'7 3 �• AstEEEOa•WECOaoca FEE El i® FEE A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING FINDING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF AN EASEMENT INTEREST IN THE REAL PROPERTY OWNED BY JUNE SYKES, COMMONLY REFERRED TO AS ASSESSOR'S PARCEL NUMBER 011-630-15, FOR THE PURPOSES OF PUBLIC IMPROVEMENTS, NAMELY THE BUCKEYE WATERLINE PROJECT. BE IT RESOLVED by the City Council of the City of Redding as follows: Section 1. The City Council of the City of Redding finds and determines that public convenience and necessity require the extension by the City of Redding of public improvements, namely the Buckeye Waterline Project, by the City of Redding, and the acquisition of an easement across the real property, owned by June Sykes (Assessor' s Parcel No. 011-630-15) , for said public improvements. Section 2. Government Code Section 37350.5 authorizes the City to acquire the necessary real property interests for said public improvements by eminent domain. Section 3 . The City Council finds and determines that the subject Project has been planned and is to be located in the manner that will be most compatible with the greatest public good and the least private injury. Section 4. A Final Environmental Assessment has been prepared and a Finding of No Significant Impact has been approved by the Bureau of Reclamation for this Project. Section 5. The City Council also finds and determines that the acquisition of the real property interests depicted in Exhibits "A" and "B" attached hereto, situate in the County of Shasta, State of California, are necessary for the construction and maintenance of the aforesaid public improvements, and that the taking of said real property interests is necessary therefor. Section 6. The City Attorney of the City of Redding is hereby 70 authorized, empowered and directed to perform as follows: a. Commence an action or actions in eminent domain in the II � v a © � ��N,� 9b3 , 5'73 II �� Superior Court of the State of California, County of Shasta, in the name of the City of Redding to acquire the necessary real property interests. b. To incur in the name of the City of Redding, and on behalf thereof, all obligations and expenses necessary to acquire the above-mentioned real property interests. Section 7 . The City Clerk of the City of Redding is hereby directed to cause a certified copy of this Resolution to be recorded in the office of the Shasta County Assessor/Recorder. Sykes • ' Parcel #011-630-15 SDA Job #90.297 September 8, 1992 EXHIBIT "A" 4 LEGAL DESCRIPTION WATER LINE EASEMENT i A parcel of land 33.00 feet wide, measured at right angles situate in Section 24 Township 32 North, Range 6 West M.D.M., in the County of Shasta, State of California, lying easterly of the following described line. Commencing at the northeast corner of Section 24, which is marked by a std. G.L.O. (General Land Office) monument being a 2" iron pipe with a 3 1/2" brass cap, from which the East one-quarter corner of said Section 24, bears S00°5710' E, 2976.77 feet; thence from said point of commencement S20°17'38" W, 2,043.73 feet to the northeast corner of that certain parcel of land conveyed to June Sykes, recorded in Book 2458 Official Records, page 604, Shasta County Records; thence southwesterly along the north line of said parcel } S85°12'54" W, 33.16 feet to a point on the westerly line of that certain 33 foot road and utility easement recorded in Book 500 Official Records, page 399, Shasta County Records and the Point of Beginning; thence southerly along said westerly line, S00°49'38" W, 243.13 feet more or less to the northline of Rock Creek Road and the Point of Termination. Together with: A temporary construction easement with the right and privilege to enter upon and use for the placing of or piling thereon of earth, materials and machinery, and for other purposes useful or necessary in connection with the construction of said water pipeline adjacent thereto: Said temporary construction easement, being a 17 foot wide strip of land, containing approximately 4,407 square feet, and described as follows: A 17.00 foot wide strip of land lying westerly of and adjacent to the above described permanent easement. The easterly line of said temporary construction easement shall be coincident with the westerly line of said permanent easement. Said temporary easement is to begin on the north line and terminate on the south line of said Sykes parcel. Said temporary construction easement shall terminate upon recordation of a Notice of Completion by the City of Redding.
