A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING AN AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF REDDING AND SALVATION ARMY FOR THE HOMELESS SHELTER, AND AUTHORIZING THE MAYOR TO SIGN SAME. WHEREAS, the City of Redding and the Salvation Army entered into an Agreement dated August 18, 1992 for the provision of a Homeless Shelter for the poor and disadvantaged citizens of Redding; and WHEREAS, during the period from 1990 through 1992, the City assigned $23,700 in Community Development Block Grant Funds to be used for this purpose; and WHEREAS, the additional CDBG funds in the amount of$19,540 were assigned in the 1992- 93 fiscal year to be used for this purpose; and WHEREAS, the City of Redding and the Salvation Army wish to amend the Agreement; and WHEREAS, it is in the best interest of the City of Redding to amend the Agreement; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Redding as follows: 1. Amendment No. 1 to the Agreement between the City of Redding and the Salvation Army amending the Agreement to provide that all costs, chairs and other fixed assets acquired with funds from this Agreement, shall revert to the City if the Salvation Army no longer operates a Homeless Shelter, is hereby approved. 2. The Mayor of the City of Redding is hereby authorized and directed to sign all necessary documents on behalf of the City of Redding, and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding on the aforesaid documents. 3. A true copy of Amendment No. 1 to the Agreement referred to herein is attached hereto and made a part hereof. HA S, ty Attorney AMENDMENT NO. 1 TO AGREEMENT BETWEEN CITY OF REDDING AND THE SALVATION ARMY FOR OPERATION OF A HOMELESS SHELTER This Amendment No. 1 to Agreement with the Salvation Army for a Homeless Shelter is made and entered into by and between the CITY OF REDDING, a municipal corporation, hereinafter referred to as "CITY" and the SALVATION ARMY, a California non-profit corporation, hereinafter referred to as "PROVIDER" WITNESSETH: WHEREAS, CITY has provided grant funds for a Homeless Shelter; and WHEREAS, the City Council approved an Agreement with PROVIDER for the provision of a Homeless Shelter for a term of six months from November 1, 1992 through April 30, 1993; and WHEREAS, CITY and PROVIDER agree to amend this Agreement to provide for the return of assets to the CITY under certain conditions; NOW, THEREFORE, BE IT RESOLVED as follows: Section IV. The last sentence under REVERSION OF ASSETS shall read as follows: Any cots, chairs or other fixed assets acquired with funds from this Agreement shall revert to CITY if PROVIDER no longer operates a Homeless Shelter as defined in this Agreement.
