HomeMy WebLinkAboutReso 93-002 - Rescinding Reso 90-498 & requesting the local agency formation Commission to take proceedings for annexation to the COR of uninhabited Territory designated COR Annexation 90-9 (Kisling Rd Area) RESOLUTION NO. 13-2- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING RESCINDING RESOLUTION NO. 90-498 AND REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE ANNEXATION TO THE CITY OF REDDING OF UNINHABITED TERRITORY DESIGNATED CITY OF REDDING ANNEXATION NO. 90-9 (KISLING ROAD AREA). WHEREAS, on October 16, 1990, the City Council of the City of Redding adopted Resolution No. 90-498 requesting the Local Agency Formation Commission to take proceedings for the annexation to the City of Redding of uninhabited territory designated City of Redding Annexation No. 90-9; and WHEREAS, on May 19, 1992, the City Council of the City of Redding requested that the Local Agency Formation Commission continue consideration of pending annexations, including Annexation 90-9, for the purpose of allowing the City of Redding the opportunity to ascertain the feasibility of forming Mello-Roos districts for the annexing territories to assist in providing funding for certain City services; and WHEREAS, on May 21, 1992, the Local Agency Formation Commission continued 1 consideration of Annexation 90-9 to a date uncertain; and I WHEREAS, on November 3, 1992, the City Council of the City of Redding adopted Resolution No. 92-447, proposing to establish a community facilities district and levy a special tax in order to facilitate the processing of Annexation 90-9; and WHEREAS, on December 15, 1992, the City Council of the City of Redding conducted a public hearing and election to consider formation of Community Facilities District No. 1992-1; and WHEREAS, a majority protest was not made at the public hearing and the election results recorded unanimous support of the landowners within the district and, therefore, the City Council adopted Resolution No. 92-493, thereby forming Community Facilities District No. 1992-1; and WHEREAS, minor modifications in the proposed boundary of Annexation 90-9 are required to make the annexation boundary generally coterminus with the boundary of Community Facilities District No. 1992-1; and WHEREAS, the City of Redding desires to initiate proceedings pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code, for the annexation to the City of Redding of the uninhabited territory designated City of Redding Annexation No. 90-9 (Kisling Road Area); and WHEREAS, the territory proposed to be annexed is uninhabited and a description of the boundaries of the territory is set forth in Exhibit "A" and depicted in Exhibit "B" attached hereto and by this reference incorporated herein; and WHEREAS, this proposal is consistent with the sphere of influence of the City of Redding; and WHEREAS, it is desired to provide that the proposed annexation be subject to the following terms and conditions: None; and r7 I WHEREAS, the reason for this proposed annexation is the advantage to property owners within this territory of the availability of certain City services; and 4 WHEREAS, a plan for providing services within the affected territory is set forth in Exhibit "C" attached hereto and incorporated herein by reference, as required by Government Code Section 56653; NOW, THEREFORE, BE IT RESOLVED, that this resolution is hereby adopted and approved by the City Council of the City of Redding, and the Local Agency Formation Commission of Shasta County is hereby requested to take proceedings for the annexation of territory as described in Exhibit "A," according to the terms and conditions stated above and in the manner provided by the Cortese-Knox Local Government Reorganization Act of 1985. Water lines will be extended by property owners, in accordance with the Master Water Plan, through an assessment district or individual owner financing when they want service. As depicted on the attached map, several waterline improvements are planned in conjunction with the development of the City's Airport Industrial Park, which is located between the annexation and Airport Road. The improvements are expected to be complete by the end of May 1993. The attached map depicts the location of existing and planned City water lines in relationship to the annexation. Sewer - Within the Regional Sewer Service boundary, sewer service will be provided by the City of Redding in accordance with adopted policies, standards, and charges. The annexation is tributary to the Stillwater Treatment Plant. Sewer service is presently available to the annexation through the Clover Creek Sewer Assessment District. The Clover Creek Trunk Line traverses the property on a north-south axis, as depicted on the attached map. A 12-inch collector is planned to be constructed along Devere Drive immediately north of the annexation within the next two years by the U.S. Forest Service to serve their facility needs north of the airport. Other sewer lines will be extended by property owners in accordance with the Master Sewer Plan through formation of an assessment district or individual'owner financing when they want service. ! M Solid Waste - Solid-waste collection will be provided to existing residents after five years as per State law as long as the existing provider matches the City's rates and level of service or when the existing collector chooses to discontinue service. New customers will be serviced by the City, which utilizes the Shasta County West Central Landfill through a joint-use agreement. It is anticipated that the City will utilize the County's landfill for a period of 30 years. In addition, the City is pursuing the development of a solid-waste transfer and recycling facility in northeast Redding on Abernathy Lane, adjacent to the planned City corporation yard. Construction is expected to be complete by the end of 1994. Streets - Existing streets shown on the County Road log will be maintained by the City only to the extent they are presently improved. New dedicated public streets will be constructed according to City standards and maintained by the City accordingly. At the time of development of the property, all adjoining streets will be improved by the owner to City standards, and all necessary right-of-way will be dedicated. Police and fire - Upon annexation, police and fire services will be available to the property. New development will occur in a manner to maintain the City's fire rating. The area is primarily served by City Fire Station No. 7, located at the Municipal Airport, Fire Station No. 5, located at the intersection of Hartnell Avenue and Churn Creek Road, and Fire Station No. 4, located on South Bonnyview Road. In addition, the City and the California Department of Forestry have entered into a Mutual Threat Zone Agreement that provides that CDF will assist in fire suppression, especially wildland fire, within the "mutual threat zone" around the City. The mutual threat zone is a ribbon of land roughly one-half to one-mile wide both inside and outside the City limits. Conversely, under the agreement, if a fire occurs outside the City limits in the County, but inside the mutual threat zone, the City will assist in fighting the fire. The City has also entered into an Automatic Aid Agreement with the Shasta County Fire Department for structure fires. Attached is a map that depicts the location of the City's fire stations in the area. Electric - It is the policy of the City of Redding to be the sole provider of electric service to electric utility customers within the City limits. City electric service is made available when electric facilities can be purchased from PG&E and/or City lines are extended into the area in accordance with adopted policies, standards, and charges of the City of Redding and based on a logical extension of the City's electric distribution system. In this case, there are three homes south of Devere Drive. It is not feasible to serve the most westerly home in the foreseeable future without paying costly severance costs to PG&E. It would be more practical to serve this home when the area around the parcel develops and City lines are extended to the area to serve the new development. This structure may be removed when Eagle Crest Subdivision is developed. Service to the remainder of the annexation, which is currently undeveloped, can be provided by extending City lines from City facilities along the east side of Airport Road and along the south side of Meadowview Drive. Also, future feeder circuits would need to be routed from Airport 115/12kV Substation through the undeveloped property and would`go directly south of Airport 115/12kV Substation and along the northerly boundary of the annexation and then south adjacent to the PG&E line which runs parallel to Kisling Road. Development of this property will accelerate the need for a second 115/12kV transformer and 12kV feeder circuit at the City's Airport Substation. If development occurs immediately after annexation, then this substation increase probably will be required by 1995. To accommodate the future 115kV transmission line needs and allow future City electric service to the Stillwater Sewer Treatment Plant and the east side of the Municipal Airport, the City requested that Shasta County place a condition on the approval of the Eagle Crest Subdivision Map for the property, requiring dedication of a 40-foot- wide right-of-way through the property for the overhead transmission line. The request was granted and the condition placed upon the map. The preliminary route of this overhead 115/12kV line is depicted on the attached map as are existing and proposed City lines and existing PG&E lines serving the area. In October 1992, the City hired a consultant to prepare an environmental impact report and routing study for the transmission line. The total cost of acquiring PG&E facilities in this annexation is estimated at $10,000.
