HomeMy WebLinkAboutReso 93-432 - Approve Second Amended Engineer's Report (Shasta View Extension Assessment Dist No 1990-2 - Phase II) RESOLUTION NO. 02J L RESOLUTION APPROVING SECOND AMENDED ENGINEER'S REPORT (Shasta View Extension Assessment District No. 1990-2 - Phase II) The City Council of the City of Redding resolves as follows: WHEREAS, this City Council has taken a series of actions preliminary to ordering improvements in Shasta View Extension Assessment District No. 1990-2, City of Redding, Shasta County, California; and WHEREAS, by its Resolution No. 90-586, adopted on December 4, 1990, this City Council previously authorized issuance of Series A of improvement bonds in the principal amount of $1, 719, 345. 62 representing the Phase I unpaid assessments in this assessment district. WHEREAS, the work on Phase II of the improvements has now been completed and the Engineer's of Work has prepared and filed with the City Clerk a Second Amended Engineer's Report. A general description of the Phase II improvements in this assessment district is as follows: The construction of approximately 2900 lineal feet of sanitary sewer main, removal of existing lift station and all necessary appurtenances. NOW THEREFORE BE .IT RESOLVED AND ORDERED, the City Council approves the Second Amended Engineer's Report and each component part of it, including each exhibit incorporated by reference in the report; and BE IT FURTHER RESOLVED AND ORDERED, the Council finds that the Engineer of Work, in the Second Amended Engineer's SF2-25055.1 Report has fairly and properly apportioned the cost of the improvements to each parcel of land and the assessment district in proportion to the estimated benefits to be received by each parcel, respectively, from the improvements. The Council hereby confirms and levies each individual assessment as stated in the Second Amended Engineer's Report; and BE IT FURTHER RESOLVED AND ORDERED, the Council orders the acquisition of the completed Phase II improvements described above and as detailed in the Second Amended Engineer's Report; and BE IT FURTHER RESOLVED AND ORDERED, the Council authorizes the issuance of Series B of bonds representing the Phase II unpaid assessments, and bearing interest at a rate not to exceed twelve percent (12%) per annum in the manner provided by the Improvement Bond Act of 1915 (Division 10, Streets and Highways Code) , and the last installment of the bonds shall mature on September 2, 2011. The Series B bonds shall be on a parity with the Series A bonds for all purposes. The Phase I improvements which are the subject of this report are briefly described as follows: Shasta View Drive The construction of approximately 5500 lineal feet of Shasta View Drive, necessary widening on Rancho Road, common utility trench, storm drain, striping, together with appurtenant work and facilities and the acquisition of necessary rights-of-way. Serial bonds representing unpaid assessments, and bearing interest at a rate not to exceed twelve percent (12%) per annum, shall be issued in the manner provided by the Improvement Bond Act of 1915 (Division 10, Streets and Highways Code) , and the last installment of the bonds shall mature not to exceed twenty-four (24) years from the 2nd day of September next succeeding twelve (12) months from their date. EXHIBIT D-1 - A statement of the method by which the undersigned determined the amount proposed to be assessed against each parcel, based on benefits to be derived by each parcel, respectively, from the improvements for Phase I. EXHIBIT D-2 - A statement of the method by which the undersigned determined the amount proposed to be assessed against each parcel, based on benefits to be derived by each parcel, respectively, from the improvements for Phase II. EXHIBIT E - A list of the names and addresses of the owners of real property within this assessment district, as shown on the last equalized assessment roll for taxes, or as known to the Clerk. From these observations, the following method of assessment was derived: Shasta View Drive Parcels 1-3 will each be responsible for the curb, gutter and sidewalk which fronts on their property. Parcels 4-45 will each be responsible for equal shares of the curb, gutter and sidewalk in front of Highland Oaks Unit 1 Subdivision. Parcels 47-88 will each be responsible for equal shares of the curb, gutter and sidewalk in front of Highland Oaks Unit 2 and 3 Subdivision. The remaining improvements and incidentals were spread between Parcels 1-116 based on the number of household equivalents assigned to each parcel. Each parcel was assigned a number of household equivalents that would contribute flow to the lines. This was based on Tentative Maps/Site Plans currently in process. If no Tentative Map/Site Plan currently exists, the number of household equivalents assigned to each parcel was based on the maximum density allowable based on the current General Plan. Rancho Road The improvements for Rancho Road were spread between Parcels 1-116 based on the number of household equivalents assigned to each parcel.
