HomeMy WebLinkAboutReso 94-103 - Approve entering into agreement with the Shasta County Regional Transportation planning agency regarding expansion, use and operation of the County-wide traffic model RESOLUTION NO. 94-_jL3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING ENTERING INTO AN AGREEMENT WITH THE SHASTA COUNTY REGIONAL TRANSPORTATION PLANNING AGENCY REGARDING THE EXPANSION, USE, AND OPERATION OF THE COUNTY-WIDE TRAFFIC MODEL; AND AUTHORIZING THE MAYOR TO SIGN ON BEHALF OF THE CITY. WHEREAS, the Shasta County Regional Transportation Planning Agency (RTPA) has requested that the City—the hub of Shasta County—accept the role of the traffic model operator on behalf of all the agencies within the County of Shasta; and WHEREAS, growth issues throughout the County are of concern as additional traffic, at some point, will impact the various services provided by the City; and WHEREAS, it will ultimately be in the best interests of the City to operate the computer-based traffic model; and WHEREAS, funding for this work will flow from the RTPA on an annual basis to assure no financial impact on the City; NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of Redding hereby approves entering into the "Agreement between the County of Shasta County Regional Transportation Planning Agency and the City of Redding Regarding the Expansion, Use, and Operation of the County-wide Traffic Model," a true copy of which is attached hereto and incorporated herein by reference. BE IT FURTHER RESOLVED that the Mayor of the City of Redding is hereby authorized and directed to sign said Agreement on behalf of the City; and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding thereto. HA S, City Attorney 2 0 • AGREEMENT BETWEEN THE SHASTA COUNTY REGIONAL TRANSPORTATION PLANNING AGENCY AND THE CITY OF REDDING REGARDING THE EXPANSION, USE AND OPERATION OF THE COUNTY WIDE TRAFFIC MODEL PURPOSE This agreement is to address the parties' intentions concerning the expansion, maintenance and use of the computerized traffic model for Shasta County currently operated by the City of Redding, hereafter called City, and funded in part by the Shasta County Regional Transportation Planning Agency, hereafter called RTPA. BACKGROUND In 1990, the City established a computer traffic model within their sphere of influence utilizing MINUTP software. In 1991 the RTPA entered into an agreement with the City to expand the model limits to the urban boundaries of the County. The City maintains and operates the model to analyze City and County project impacts relating to p.m. peak traffic movements from development within the urban area. OBJECTIVE As a result of the Congestion Management Program and the desire of the various governmental agencies involved with the RTPA, it is now desirable to update the model to reflect actual 1994 and predict future traffic demands, expand the model limits to include the entire County of Shasta, analyze both a.m. and p.m. peak impacts on the system, project mode splits based on land use, interface with the Air Quality Management District's accepted software as it relates to vehicle emissions and merge data files with the computerized mapping program maintained by the City. To this end, the following outlines the responsibilities of each agency. TERM AND MODIFICATION This agreement shall remain in force until terminated by either party or by mutual agreement. This agreement may be modified by mutual consent of the parties. RTPA AGREES 1 . Provide agency coordination for the receipt of all necessary information required to upgrade the model as outlined in this agreement. 2. Provide funding to the City in the amount of $171 ,000.00 to accomplish the tasks established in the "Request For Proposal - Revision of Shasta County Travel Demand Model" issued by the RTPA on February 15, 1994, and incorporated herein by reference. 3. Unless otherwise specified by a supplemental agreement, to provide City adequate funding annually in the Overall Work Program to maintain and operate the traffic model in support of all RTPA member agencies with regard to CMP project analysis required for annual submission, for so long as the RTPA determines that funding is available for this purpose and desires to have City maintain and operate the traffic model as provided herein. CITY AGREES 1 . Prepare, solicit, administer a contract to expand the existing Urban Area traffic model to meet the objectives listed in this agreement. 2. Provide staff and equipment to perform the traffic model runs required to meet the CMP annual submittals for the various RTPA member agencies for each year that RTPA funding is provided. 3. Develop a procedure to complete additional model runs as requested by the RTPA, its member agencies or developers in concurrence with the approval of member agencies at a time and material rate in effect at the time of request during the course of any given fiscal year either by internal staff or by consultant. 4. Update the traffic model database annually from information supplied by the RTPA member agencies. 5. Maintain complete procedure manuals, copies of all model runs and catalog all assumptions utilized in the development of any request for information. 6. Develop a policy regarding the use and distribution of the databases and mapping developed in conformance with the member agency funded tasks. PARTIES MUTUALLY AGREE 1 . Neither RTPA nor any officer or employee thereof shall be responsible for any damage of liability occurring by reason of anything done or omitted to be done by City under or in conjunction with City's performance of this agreement. It is also agreed that, pursuant to Government Code Section 895.4, RTPA shall fully indemnify and hold City harmless from any liability imposed for injury (as defined by Government Code section 810.0) occurring by reason of anything done or omitted to be done by RTPA under or in connection with RTPA work under this agreement. 2. Neither City nor any officer or employee thereof shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by RTPA under or in conjunction with RTPA's performance of this agreement. It is also agreed that, pursuant to Government Code Section 895.4, City shall fully indemnify and hold RTPA harmless from any liability imposed for injury (as defined by Government Code section 810.0) occurring by reason of anything done or omitted to be done by City under or in connection with City work under this agreement. 2 Both City and RTPA have vested interests in the traffic model. City shall possess and maintain and operate the model for the mutual benefit of both parties using equipment, software and consultant services funded in part by RTPA. This agreement is entered into this day of 1994, by and between the Shasta County Regional Transportation Planning Agency and the City of Redding.
