HomeMy WebLinkAboutReso 94-149 - Approve entering into agreement between COR & County of Shasta for repair of county roads in connection with installation of City Waterlines RESOLUTION NO. 94- /` 9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING ENTERING INTO AN AGREEMENT BETWEEN THE CITY OF REDDING AND THE COUNTY OF SHASTA FOR REPAIR OF COUNTY ROADS IN CONNECTION WITH INSTALLATION OF CITY WATERLINES, AND AUTHORIZING THE MAYOR TO SIGN ON BEHALF OF THE CITY. IT IS HEREBY RESOLVED that the City Council of the City of Redding hereby approves entering into an Agreement between the City and the County of Shasta for repair of County roads in connection, with the Buckeye Water Treatment Plant and Transmission Projects. A true copy of said Agreement is attached hereto and incorporated herein by reference. BE IT FURTHER RESOLVED that the Mayor of the City of Redding is hereby authorized and directed to sign the Agreement on behalf of the City; and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding thereto. 'HAAS, City Attorney AGREEMENT BETWEEN COUNTY OF SHASTA AND CITY OF REDDING FOR REPAIR OF COUNTY ROADS IN CONNECTION WITH INSTALLATION OF CITY WATERLINES This agreement is entered into between the County of Shasta (County) and the City of Redding (City) for the purpose of overlaying the County roads which are impacted due to the construction of the Buckeye Water Treatment Plant and the installation of appurtenant waterlines. 1. Responsibilities of City The City shall be responsible for the purchase of 5,700 tons of asphalt concrete mix for use by the Shasta County Department of Public Works for overlaying the following roads in connection with the Buckeye Water Treatment Plant and Transmission Projects: A. Area disturbed by waterline: 1. Overlay of 11,700 feet of Rock Creek Road. 2. Overlay of 900 feet of Iron Mountain Road. 3. Overlay of 6,000 feet of Keswick Dam Road. 4. Overlay on Benson Drive from Rock Creek Road to Plant Site Road (600 feet). The purchase price for the asphalt concrete mix shall be the price established in the annual purchase contract for such product of the City or County. The source for the product shall be the contract which represents the lowest price. 2. Responsibilities of County The County shall overlay, with its personnel and equipment, the above roads listed in Section 1 A. using the asphalt concrete mix purchased by the City. The referenced overlays shall be completed by October 1, 1995. County shall also issue encroachment permits to City and contractors for a) Buckeye Water Treatment Plan Project, and b) Transmission Main Project (copies of plans attached). 3. Term of Agreement This agreement shall commence on the date of signing and shall terminate after completion of the Buckeye Water Treatment Plant Project and all conditions of agreement have been met. Either party may terminate this agreement on 90 days' written notice. 4. Entire Agreement: Modification This agreement constitutes the entire understanding of the parties hereto. No changes, amendments or alterations shall be effective unless in writing and signed by both parties. 5. Indemnification -1- City shall hold harmless and indemnify County, its elected officials, officers, and employees, against all claims, suits, actions, costs, counsel fees, expenses, damages, judgments or decrees by reason of any person's or persons' bodily injury, including death, or property being damaged by City or any person employed by City or in any capacity during the progress of the work, whether by negligence or otherwise, but only for that proportion of such claims, costs, suits, and damages which reflects the percentage of negligence of the City compared to the total negligence of all persons, firms, or corporations which results in said damages to the County. County shall hold harmless and indemnify City, its elected officials, offices, and employees, against all claims, suits, actions, costs, counsel fees, expenses, damages, judgments or decrees by reason of any person's or persons' bodily injury, including death, or property being damaged by County or any persons employed by County or in any capacity during the progress of the work, whether by negligence or otherwise, but only for that proportion of such claims, costs, suits, and damages which reflects the percentage of negligence of the County compared to the total negligence of all persons, firms, or corporations which results in said damages to the City. 6. Notices Any notice required to be given pursuant to the terms and provisions of this agreement shall be in writing and shall be sent first class to the following addresses: If to County: Director of Public Works County of Shasta 1855 Placer Street Redding, CA 96001 If to City: Director of Public Works City of Redding P.O Box 496071 Redding, CA 96049-6071 Notices shall be deemed to be effective two days after mailing. -2- In witness whereof, County and City have executed this agreement on the day and year set forth below.
