A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIDDING
APPROVING ENTERING INTO AN AUTHORIZATION FOR PROFESSIONAL
SERVICES CONTRACT WITH MTI TESTING LABORATORY INC. FOR
MATERIALS-TESTING SERVICES RELATED TO THE BENTON LANDFILL
CLOSURE CAP PROJECT (JOB #2103, BID SCHEDULE 2836) , IN AN
AMOUNT NOT TO EXCEED $70,000; AND APPROPRIATING AN ADDITIONAL
$7,500 FOR CONTINGENCIES.
WHEREAS, on April 19, 1994, the City Council awarded a contract
for the construction of the Benton Landfill Closure Cap to Essayons-
Hardrock Joint Venture, and also approved the expenditure of $70,000
for materials testing and project-testing contingencies; and
WHEREAS, a request for proposal for the materials-testing
services—required by the California State Water Quality Control
Board—were mailed to three local materials-testing firms: MTI Testing
Laboratory Inc. , Kleinfelder, and Brown and Mills; and
WHEREAS, the request for proposal asked for hourly rates and unit
costs for specific tests, and stipulated that the selection of a
consultant would be by demonstrated professional competence and
experience only; and
WHEREAS, MTI and Kleinfelder submitted responsive proposals, which
were reviewed by staff; and
WHEREAS, MTI was judged to be the most qualified firm to provide
the materials testing, based on past experience and personnel; and
WHEREAS, for the reasons set forth in the accompanying Report to
City Council, staff is requesting approval of a contract with MTI not
to exceed $70,000 ; and that an additional $7 ,500 be provided as a
contingency for other testing that may be required by the State Water
Quality Control Board or other regulatory agencies during the course of
the project; and
WHEREAS, funds are available in the 1993 solid waste/corporation
yard revenue bonds to cover the requested $77 , 500 for the materials-
testing services for the Benton Landfill Closure Cap project;

NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF REDDING AS FOLLOWS:
1 . The foregoing recitals are true and correct.
2. The City Council approves entering into the Authorization for
Professional Services contract with MTI Testing Laboratory Inc. in
an amount not to exceed $70,000. A true copy of said contract is
attached hereto and incorporated herein by reference.
3 . The Mayor is authorized and directed to sign said contract on
behalf of the City; and the City Clerk is authorized and directed
to attest the signature of the Mayor and to impress the official
seal of the City of Redding thereto.
4. The City Council also approves appropriating an additional $7 ,500
as a contingency for other testing that may be required by the
State Water Quality Control Board or other regulatory agencies
during the course of the Benton Landfill Closure Cap project.

PROVISIONS
1. Authorization To Proceed
Signing this form shall be construed as authorization by client for MTI to
proceed with the work , unless otherwise provided for in the authorization.
2. Direct Expenses
MTI ' s direct expenses shall be those costs incurred on or directly for the
client' s project, including but not limited to necessary transportation costs
including mileage at MTI ' s current rate if its automobiles are used, meals ,
lodging and telephone charges. Expenses shall be on the basis of actual
charges furnished by commercial sources.
3. Outside Services
When technical or professional services are furnished by an outside source,
when approved by client, an additional 20% shall be added to the cost of these
services for MTI ' s administrative costs.
4. Professional Standards
MTI shall be responsible, to the level of competency presently maintained
by other practicing laboratories in the same type of work in the client' s
community, for the technical soundness and accuracy of all reports and other
work and materials furnished under this authorization. MTI makes no other
warranty, express or implied.
5. Legal Expenses
In the event legal action is brought by client or MTI against the other to
enforce any of the obligations hereunder or arising out of any dispute con-
cerning the terms and conditions hereby created, the losing party shall pay
the prevailing party such reasonable amounts for fees, costs and expenses as
may be set by the court. Any action brought to enforce or interpret the provisions
of the contract shall be brought in Shasta County, California.
6. Samples
All samples will be disposed of, or destroyed upon completion of testing
unless the client advises MTI otherwise. Upon request, the samples will be
delivered to client, charges collect, or MTI will store them for an agreed
charge.
7. Field Work
The presence of MTI field personnel will be for the purpose of providing
observation and field testing. Our work does not include supervision or
direction of the actual work of the contractor, his employees or agents.
The contractor for this project should be so advised. The contractor should
also be informed that neither the presence of MTI field personnel nor the
observation and testing by MTI shall excuse him in any way for defects dis-
covered in his work. It is understood that MTI will not be responsible for
job or site safety. Job and site safety will be the sole responsibility of
the client or contractor.
8. Payment of Compensation
Invoices for our services will be submitted at our option, but not more than
twice a month. Invoices are due and payable upon receipt. If payment by
client of any amount due MTI is not made within 30 days of invoice date, a
SERVICE CHARGE of 1-1/2% per month on the unpaid balance will be added until
paid in full.
