RESOLUTION NO. 94-�
A RESOLUTION INITIATING PROCEEDINGS OF THE CITY COUNCIL OF THE
CITY OF REDDING TO:
(1) CONSOLIDATE EXISTING LANDSCAPE MAINTENANCE DISTRICTS 16,
17, AND 22 INTO ONE DISTRICT TO BE KNOWN AS LANDSCAPE
MAINTENANCE DISTRICT "C";
( 2) ANNEX ADDITIONAL TERRITORY, NAMELY GOLD HILLS SUBDIVISION,
UNIT 3A, R1, AND R2 (AREA 4) ; MONTEREY SPRINGS
SUBDIVISION, UNIT 2 (AREA 5) ; AND POTTER MANOR SUBDIVISION
(AREA 6) INTO LANDSCAPE MAINTENANCE DISTRICT "C"; AND
( 3) LEVY AND COLLECT ASSESSMENTS IN LANDSCAPE MAINTENANCE
DISTRICT "C" FOR FISCAL YEAR 1994-95.
WHEREAS, the City Council has heretofore ordered the formation of
Landscape Maintenance Districts 16, 17 , and 22 under authority granted by
the Landscaping and Lighting Act of 1972, as set forth in Part 2 of
Division 15 of the Streets and Highways Code of the State of California;
and
WHEREAS, staff has recommended that the above-mentioned Landscape
Maintenance Districts be consolidated into one district, to be known as
Landscape Maintenance District "C" ; and
WHEREAS, on April 22, August 22, 1993 , and November 16, 1993,
respectively, Petitions and Consents for the annexation of additional
territory into Landscape Maintenance District "C" and to the levy and
collection of assessments therein pursuant to the Landscaping and
Lighting Act of 1972, signed by the owners of the lands as shown on the
last equalized County assessment roll—or entitled to be shown as owners
on the next County assessment roll—or where any of said property is
subject to a recorded written agreement of sale, are shown therein as
purchasers—were filed with the City Clerk of the City of Redding
pursuant to the Landscaping and Lighting Act of 1972, Division 15, Part
2 (commencing with Section 22500) , of the Streets and Highways Code of y
the State of California, and especially Section 22608 thereof; and
WHEREAS, the territories proposed to be annexed into Landscape
Maintenance District "C" are described as follows: U
Firstly (April 22, 1993 , Petition and Consent) : All of that certain
real property situate in the City of Redding, Shasta County,
California, being Lots 1-22 inclusive of the Potter Manor
Subdivision as shown on the Map recorded July 9, 1993 , in Book 21 of
Maps at page 18, Shasta County Records (previously A.P. Nos. 110-
150-09 and 110-150-16) ;
Secondly (August 22, 1993 , Petition and Consent) : All of that
certain real property situate in the City of Redding, Shasta County,
California, being Lots 1 through 49 inclusive in Unit 2 of the
Monterey Springs Subdivision as shown on the Map recorded
October 21, 1993 , in Book 21 of Maps at page 29, Shasta County
Records (previously A.P. Nos. 117-250-15 and 117-270-07) ; and
Thirdly (November 16, 1993 , Petition and Consent) : All of that
certain real property situate in the City of Redding, Shasta County,
California, being Lots 1 through 8 inclusive in Unit 3A of the Gold
Hills Subdivision as shown on the Map recorded February 24, 1994, in
Book 21 of Maps at page 39 , Shasta County Records (previously A.P.
Nos. 73-290-03 and 73-290-04) , and Remaining Parcels R1 and R2;
and
WHEREAS, the purpose of landscape maintenance districts is to
provide maintenance to those landscaping improvements required within the
public rights-of-way by the conditions of development approval of the
respective subdivisions; and
WHEREAS, no costs for the original improvements in the additional
territories proposed to be annexed into Landscape Maintenance District
"C" will be assessed against said District; all such costs of
improvements being conditions of development of the Gold Hills
Subdivision, Unit 3A, R1, and R2 (Area 4) ; the Monterey Springs
Subdivision, Unit 2 (Area 5) ; and the Potter Manor Subdivision (Area 6) ;
and
WHEREAS, only costs for the maintenance of landscaping, repairs to
the irrigation system, electric and water charges, replacement of
vegetation as necessary, and any and all incidental expenses, including
administrative costs, in connection therewith will be assessed; and
WHEREAS, no new improvements or substantial changes in existing
improvements are proposed for fiscal year 1994-95; and

WHEREAS, the City Council intends to levy the special assessment for
fiscal year 1994-95 upon the land equally amongst all the lots and
remaining parcels which encompass Landscape Maintenance District "C" ;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Redding as follows:
1 . That the foregoing recitals are true and correct.
2. That pursuant to the Landscaping and Lighting Act of 1972, the City
Council proposes to consolidate Landscape Maintenance Districts 16,
17 , and 22 into one district to be known as Landscape Maintenance
District "C" ; and to annex the Gold Hills Subdivision, Unit 3A, Rl,
and R2 (Area 4) ; the Monterey Springs Subdivision, Unit 2 (Area 5) ;
and the Potter Manor Subdivision (Area 6) into said District. Maps
and a detailed description of the properties within proposed
Landscape Maintenance District "C" are attached hereto and
incorporated herein by reference.
3 . That JAMES KING, Senior Planner, is designated the Engineer for
Landscape Maintenance District "C" ; and is hereby directed to file
an Annual Report with the City Clerk in accordance with Streets and
Highways Code Chapter 1, Article 4 (commencing with Section 22565) ,
of Part 2—Landscaping and Lighting Act of 1972.
I HEREBY CERTIFY that the foregoing Resolution Initiating
Proceedings was introduced, read, and adopted at a regular meeting of the
City Council on the 17th day of May. , 1994 , by the following vote:
