HomeMy WebLinkAboutReso 94-129 - Consolidate existing LMD's 2,4,10,15,18,19,20, & 23 to be known as LMD "B" RESOLUTION NO. 94-_Z29 A RESOLUTION INITIATING PROCEEDINGS OF THE CITY COUNCIL OF THE CITY OF REDDING TO: (1) CONSOLIDATE EXISTING LANDSCAPE MAINTENANCE DISTRICTS 2, 4, 10, 15, 18, 19, 20, AND 23 INTO ONE DISTRICT TO BE KNOWN AS LANDSCAPE MAINTENANCE DISTRICT "B"; (2) ANNEX ADDITIONAL TERRITORY, NAMELY HIGHLAND OAKS SUBDIVISION, UNIT 4 AND R1 (AREA 7) , AND RAVENWOOD ESTATES SUBDIVISION, UNITS 11-16 (AREA 10) , INTO LANDSCAPE MAINTENANCE DISTRICT "B"; AND (3) LEVY AND COLLECT ASSESSMENTS IN LANDSCAPE MAINTENANCE DISTRICT "B" FOR FISCAL YEAR 1994-95. WHEREAS, the City Council has heretofore ordered the formation of Landscape Maintenance Districts 2, 4, 10, 15, 18, 20 , and 23 under authority granted by the Landscaping and Lighting Act of 1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California; and WHEREAS, staff has recommended that the above-mentioned Landscape Maintenance Districts be consolidated into one district, to be known as Landscape Maintenance District "B" ; and WHEREAS, on March 31, 1993, and December 7, 1993 , respectively, PE!titions and Consents for the annexation of additional territory into Landscape Maintenance District "B" and to the levy and collection of assessments therein pursuant to the Landscaping and Lighting Act of 1972, signed by the owners of the lands as shown on the last equalized County assessment roll—or entitled to be shown as owners on the next County assessment roll—or where any of said property is subject to a recorded written agreement of sale, are shown therein as purchasers—were filed with the City Clerk of the City of Redding pursuant to the Landscaping and Lighting Act of 1972, Division 15, Part 2 (commencing with Section 22500) , of the Streets and Highways Code of the State of California, and especially Section 22608 thereof; and WHEREAS, the territories proposed to be annexed into Landscape Maintenance District "B" are described as follows: S Firstly (March 31, 1993 , Petition and Consent) : All of that certain real property situate in the City of Redding, Shasta County, California, being Lots 1-25 in Unit 11, Lots 1-17 in Unit 12, Lots 1-28 in Unit 13 , Lots 1-18 in Unit 14, Lots 1-34 in Unit 15 , and Lots 1-26 in Unit 16, inclusive, of the Ravenwood Estates Subdivision as shown on the Maps recorded April 7, August 4, and September 23 , 1993 , in Book 21 of Maps at pages 11, 20, and 26 , Shasta County Records (previously A.P. Nos. 077-500-01/36/38/42/44/ 55/57; 077-510-01/28; 077-520-01/31; and 077-530-01/36) . Secondly (December 7, 1993 , Petition and Consent) : All of that certain real property situate in the City of Redding, Shasta County, California, being Lots 1 through 27 inclusive in Unit 4 of the Highland Oaks Subdivision as shown on the Map recorded January 13 , 1994, in Book 21 of Maps at page 36, Shasta County Records (previously A.P. Nos. 54-08-20) , and Remaining Parcel Rl; and WHEREAS, the purpose of landscape maintenance districts is to provide maintenance to those landscaping improvements required within the public rights-of-way by the conditions of development approval of the respective subdivisions; and . WHEREAS, no costs for the original improvements in the additional territories proposed to be annexed into Landscape Maintenance District "B" will be assessed against said District; all such costs of improvements being conditions of development of the Highland Oaks Subdivision, Unit 4 and Remaining Parcel R1, and the Ravenwood Estates Subdivision, Units 11-16; and WHEREAS, only costs for the maintenance of landscaping, repairs to the irrigation system, electric and water charges, replacement of vegetation as necessary, and any and all incidental expenses, including administrative costs, in connection therewith will be assessed; and WHEREAS, no new improvements or substantial changes in existing improvements are proposed for fiscal year 1994-95; and WHEREAS, the City Council intends to levy the special assessment for fiscal year 1994-95 upon the land equally amongst all the lots and remaining parcels which encompass Landscape Maintenance District "B" ; NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Redding as follows: 1 . That the foregoing recitals are true and correct. 2 . That pursuant to the Landscaping and Lighting Act of 1972, the City Council proposes to consolidate Landscape Maintenance Districts 2, 4 , 10, 15, 18, 20, and 23 into one district to be known as Landscape Maintenance District "B" ; and to annex the Highland Oaks Subdivision, Unit 4 and Remaining Parcel R1, and the Ravenwood Estates Subdivision, Units 11-16, into said District. Maps and a detailed description of the properties within proposed Landscape Maintenance District "B" are attached hereto and incorporated herein by reference. 3 . That JAMES KING, Senior Planner, is designated the Engineer for Landscape Maintenance District "B" ; and is hereby directed to file an Annual Report with the City Clerk in accordance with Streets and Highways Code Chapter 1, Article 4 (commencing with Section 22565) , of Part 2—Landscaping and Lighting Act of 1972.
