A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING,
PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 19720,
ORDERING:
(1) THE CONSOLIDATION OF EXISTING LANDSCAPE MAINTENANCE
DISTRICTS 16, 17, AND 22 INTO A NEW DISTRICT TO BE KNOWN
AS LANDSCAPE MAINTENANCE DISTRICT "C";
(2) THE ANNEXATION OF ADDITIONAL TERRITORY, NAMELY GOLD
HILLS SUBDIVISION, UNIT 3A, R1, AND R2 (AREA 4) ;
MONTEREY SPRINGS SUBDIVISION, UNIT 2 (AREA 5) ; AND
POTTER MANOR SUBDIVISION (AREA 6) , INTO LANDSCAPE
MAINTENANCE DISTRICT "C"; AND
( 3) THE LEVY AND COLLECTION OF ASSESSMENTS IN LANDSCAPE
MAINTENANCE DISTRICT "C" FOR FISCAL YEAR 1994-95.
WHEREAS, on May 17, 1994, the City Council approved the Report of
the Engineer as filed relating to Landscape Maintenance District "C" ;
and
WHEREAS, said Report described the improvements therein, and gave
notice of the time and place of the July 5, 1994, public hearing on the
question of consolidating Landscape Maintenance Districts 16 , 17 , and
22 into Landscape Maintenance District "C" ; annexing the Gold Hills
Subdivision, Unit 3A, R1, and R2 (Area 4) , the Monterey Springs
Subdivision, Unit 2 (Area 5) , and the Potter Manor Subdivision (Area 6)
into said District; and the levy of assessments for fiscal year 1994-
95; and
WHEREAS, an illustration of the area encompassed by the District,
individual maps, and a summary are attached hereto and incorporated
herein by reference; and
WHEREAS, said public hearing, duly and properly noticed, commenced

at the City Council Chambers, 1313 California Street, Redding,
California, on July 5, 1994, and was concluded prior to the adoption of
this Resolution; and

WHEREAS, at the July 5th public hearing, the City Council gave
every interested person an opportunity to object to the proposed
consolidation, annexation of additional territory, and assessment; and
WHEREAS, all legal prerequisites to the adoption of this
Resolution have occurred, including a public meeting held June 7, 1994,
pursuant to Government Code Section 54954.6 ;
NOW, THEREFORE, the City Council of the City of Redding does
hereby find, resolve, determine, and order as follows:
1. The matters set forth above are true and correct.
2. With respect to existing Landscape Maintenance Districts 16, 17,
and 22 as they currently exist, Council has considered all oral
statements and written protests or communications made or filed by
interested persons at the public meeting of June 7, 1994, and the
public hearing of July 5, 1994, and hereby expressly overrules any
and all protests filed objecting to the consolidation of said
districts into a new district entitled Landscape Maintenance
District "C" and the proposed assessments to be levied.
3 . With respect to the additional territories proposed to be annexed
into Landscape Maintenance District "C" :
A. The owners of the respective lands within the boundaries of
the additional territories proposed to be annexed into the
District have filed their consents to said inclusion.
B. Said territories are described as follows:
Firstly (April 22 , 1993 , Petition and Consent) : All of that
certain real property situate in the City of Redding, Shasta
County, California, being Lots 1-22 inclusive of the Potter
Manor Subdivision as shown on the Map recorded July 9, 1993 ,
in Book 21 of Maps at page 18, Shasta County Records
(previously A.P. Nos. 110-150-09 and 110-150-16) ;
Secondly (August 22, 1993 , Petition and Consent) : All of
that certain real property situate in the City of Redding,
Shasta County, California, being Lots 1 through 49 inclusive
in Unit 2 of the Monterey Springs Subdivision as shown on the
Map recorded October 21, 1993 , in Book 21 of Maps at page 29,

Shasta County Records (previously A.P. Nos. 117-250-15 and
117-270-07) ; and
Thirdly (November 16, 1993, Petition and Consent) : All of
that certain real property situate in the City of Redding,
Shasta County, California, being Lots 1 through 8 inclusive
in Unit 3A of the Gold Hills Subdivision as shown on the Map
recorded February 24, 1994, in Book 21 of Maps at page 39,
Shasta County Records (previously A.P. Nos. 73-290-03 and 73-
290-04) , and Remaining Parcels R1 and R2.
C. The improvements as specified in the Engineer' s Report on
file with the City Clerk are hereby ordered to be completed.
D. City Council has considered all oral statements and written
protests or communications made or filed by interested
persons at the public meeting of June 7, 1994, and the public
hearing of July 5, 1994, and finds that a majority protest
against the annexations and levy of the assessments has not
been made. Council expressly overrules any and all protests
filed objecting to the proposed annexations or assessments to
be levied.
E. City Council hereby orders the annexation of said additional
territories into Landscape Maintenance District "C" for the
installation or construction of improvements and the
maintenance and/or servicing thereof, together with any and
all incidental expenses and administrative costs in
connection therewith, all as more particularly authorized
pursuant to the Landscaping and Lighting Act of 1972.
4 . The City Council finds that the Engineer has fairly and properly
apportioned the cost of the improvements to each lot/remaining
parcel of land in said District in proportion to the estimated
benefits to be received by each lot/remaining parcel from the
improvements.
5. That the assessment diagram contained in the Engineer' s Report is
hereby adopted and confirmed.
6 . That the following assessment against each lot and remaining
parcel located within the District for fiscal year 1994-95 is
hereby adopted and confirmed:

7. That the City Clerk shall forthwith transfer to the Auditor and
the Recorder/Assessor of Shasta County a certified copy of this
Resolution and a certified copy of the assessment diagram
contained in the Engineer' s Report.
I HEREBY CERTIFY that the foregoing Resolution pertaining to
Landscape Maintenance District "C" was introduced, read, and adopted at
a regular meeting of the City Council of the City of Redding on the 5th
day of July, 1994, by the following vote:
