WHEREAS, a 15 ' wide emergency access easement running parallel with and westerly of the east line of lot 26 was dedicated to the City with the recording of the Map of the Country Heights Subdivision, Unit 12, recorded in Book 21 of Maps at page 21, Shasta County Records (Easement #1) ; and WHEREAS, the developer has requested the abandonment of Easement #1 in exchange for a 15' emergency access easement lying 7 . 5 ' on each side of the southerly boundary of Lot 33 in said subdivision, (Easement #2) ; and WHEREAS, Easement #1 is shown on Exhibit "A" and Easement #2 is shown on Exhibit "B" attached hereto and incorporated herein by reference; and WHEREAS, the Fire Department has advised the Council that when Easement #2 has been deeded to the City, Easement #1 will no longer be required; the Planning and Public Works Departments concur; and WHEREAS, the Council elects to proceed in this matter under the provisions of the Public Streets, Highways, and Service Easements Vacation Law as the same is set forth in Section 8300, et seq. , of the Streets and Highways Code of the State of \\ California; y NOW, THEREFORE, the City Council of the City of Redding hereby resolves and orders. c( -3287PAGEF5)9 0 • 1. That the City of Redding accept Easement #2 from the developer. 2. Upon the recordation of Easement #2 in favor of the City of Redding, the Council hereby directs that: a) Easement #1 will no longer be necessary and shall be vacated; and b) the City Clerk is to record a certified copy of this Resolution, attested to by the City Clerk under seal of the City of Redding, in the office of the Shasta County Assessor/Recorder.
