HomeMy WebLinkAboutReso 94-181 - Authorize entering into an agreement to process parking citations for the County of Shasta RESOLUTION NO. 94--/,?/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AUTHORIZING ENTERING INTO AN AGREEMENT TO PROCESS PARKING CITATIONS FOR THE COUNTY OF SHASTA, TO BE SIGNED BY THE INTERIM CITY MANAGER. IT IS HEREBY RESOLVED that the City Council of the City of Redding hereby authorizes entering into an Agreement to Process Parking Citations for the County of Shasta, a copy of which is attached hereto and incorporated herein by reference. BE IT FURTHER RESOLVED that the Interim City Manager is hereby authorized to sign the Agreement on behalf of the City; and the City Clerk is directed to attest the signature of the Interim City Manager and impress the official seal of the City of Redding thereto. HAYS(, City Attorney N AGREE> T TO PROCESS PARKING CITOIONS FOR COUNTY OF SHASTA THIS AGREEMENT is made and entered into as of the first day of August, 1994, by and between the CITY OF REDDING ("CITY") and the COUNTY OF SHASTA ("COUNTY"). IT IS MUTUALLY AGREED by the parties hereto as follows: 1. Pursuant to Vehicle Code §40200.4(b), THE COUNTY OF SHASTA wishes to contract with the CITY OF REDDING to process all parking citations issued by a county department, the California Highway Patrol, and any other entity for which the County of Shasta previously processed parking citations. 2. THE CITY agrees to process the COUNTY'S parking citations, upon receipt of hard copies thereof, in the same manner as the CITY'S parking citations are handled by the CITY, including administrative hearings for contested citations. 3. THE CITY will also provide a copy of its record of adjudication proceedings to the Municipal Court in the event of an appeal to the Court. The CITY'S role in processing the COUNTY'S parking citations will cease when said record is filed with the Court; CITY will not handle the Court appeal. 4. For performing the above-described services, the COUNTY covenants and agrees that the CITY shall keep all fines collected, with the exception of any amounts due SHASTA COUNTY or the State of California pursuant to State law which shall be paid by the CITY. There shall be no additional charge by the CITY to the COUNTY for processing the parking citations. 5. The term of this Agreement shall commence August 1, 1994, and remain in full force and effect until either party gives 30 days' advance written notice of cancellation to the other party. Notice shall be deemed to have been fully and properly given when made in writing, enclosed in a sealed envelope, and deposited in the United States Post Office, certified mail, postage prepaid, addressed as follows: If to the City: City of Redding c/o City Manager 760 Parkview Avenue P.O. It is understood and agreed between the parties hereto that the CITY, in carrying out the services to be performed hereunder, is not acting as an employee of the COUNTY OF SHASTA. THE COUNTY OF SHASTA expressly covenants and agrees that it shall indemnify, save harmless, and defend the CITY, its officers, officials, employees, agents, and volunteers from any and all liability and claims for damages or loss of whatever nature and kind in any way connected with the services to be provided herein by CITY on behalf of the COUNTY, other than that caused by the negligence or other legal fault of the CITY or its officers, officials, employees, agents and volunteers.
