RESOLUTION NO. f4/—/ 7� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING GPA- 14-92, THE UPPER STILLWATER AREA PLAN, FINDING THAT, INTER ALIA, FINAL EIR- 4-92 ADEQUATELY ADDRESSES THE ENVIRONMENTAL IMPACTS OF THE UPPER STILLWATER AREA PLAN; AND ADOPTING (1) FINDINGS FOR THE PROJECT; (2) A STATEMENT OF OVERRIDING CONSIDERATIONS FOR THE PROJECT; AND (3) A MITIGATION MONITORING AND REPORTING PROGRAM FOR THE PROJECT. WHEREAS, on May 10, 1994 the Planning Commission of the City of Redding certified that Final Environmental Impact Report EIR-4-92 for the Upper Stillwater Area Plan (Project) meets the standards of adequacy established in the California Environmental Quality Act; and WHEREAS, the City Council reviewed and considered the information contained in EIR-4-92 prior to approval of the Project; NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of Redding hereby approves GPA-14-92, the Upper Stillwater Area Plan and finds that EIR-4-92 adequately addresses the environmental impact of the Project, and that, for certain environmental areas as reflected in Exhibit "A" attached hereto and made a part hereof, changes or alterations have been required in or incorporated into said Project which mitigate or avoid the significant environmental effects thereof. BE IT FURTHER RESOLVED that the City Council of the City of Redding hereby finds that for the reasons set forth in 'Exhibit "B" attached hereto and made a part hereof, specific economic, social, and other considerations of the project outweigh the unavoidable impacts of the Project in regard to School Facilities as identified in Exhibit "A." BE IT FURTHER RESOLVED that the City Council hereby adopts Exhibits "A", "B", and "C" (Mitigation Monitoring and Reporting Program). HAY , C' Attorney D:\RES 1\gpa 14-92.cc EXHIBIT "A" The California Environmental Quality Act (CEQA) requires that no public agency shall approve or carry out a project for which an environmental impact report has been completed which identifies one or more significant effects thereof unless such public agency makes one or more of the following findings: a. Changes or alterations have been required in, or incorporated into, such project which mitigate or avoid the significant effects thereof as identified in the completed environmental impact report. b. Such changes or alterations are within the responsibility and jurisdiction of another public agency, and such changes have been adopted by such other agency or can and should be adopted by such other agency. C. Specific economic, social, or other considerations make infeasible the mitigation measures or project alternatives identified in the environmental impact report. (Section 21081 of the California Environmental Quality Act) CEQA further requires that, where the decision of the public agency allows the occurrence of significant effects which are identified in the final EIR, but are not at least substantially mitigated, the agency shall state in writing the specific reasons to support its action based on the final EIR and/or other information in the record (Section 15093 of the CEQA Guidelines). STATEMENT OF FINDINGS - EIR-4-92 A. The Redding City Council and Redding Planning Commission, having reviewed and considered the information contained in Final EIR-4-92 for the Upper Stillwater Area Plan project and having reviewed and considered the record, find that measures have been incorporated into the project design which mitigate or avoid certain significant environmental effects associated with the project in the following environmental areas as identified in the text of the Final EIR and the Mitigation Monitoring and Reporting Program for the project: 1. Soils, Geology, & Seismic 2. Wildlife & Vegetation 3. Hydrology, Drainage and Flooding 4. Air Quality 5. Safety 6. Historical/Archeological 7. Traffic & Congestion 8. Public Services, excluding School Facilities 9. Noise B. Findings Concerning Impacts on School Facilities The school facilities impacts identified in EIR-4-92 that are significant or potentially significant without mitigation, the adopted mitigation measures, and findings of the Redding City Council regarding those impacts with the adopted mitigation, are as follows: EXHIBIT "A", continued Significant Impact 8.4: Overcrowding of existing school facilities due to growth in student population. Mitigation Adopted by City Council 8.4.a: Refer all subdivision proposals within the study area to affected school districts for review and comment. 8.4.b: Include as a policy in the Upper Stillwater Area Plan a requirement to implement any policy that the City Council establishes on a citywide basis regarding school funding. Findings Concerning Adopted Mitigation Measures The City Council finds that the above-state mitigation measures are incorporated into the proposed Project. The City Council further finds that these mitigation measures are feasible, and will lessen, but not necessarily eliminate the potential adverse environmental effect associated with the Project. Because of its magnitude, the impact of potential development would still be significant after mitigation. Thus, this impact is significant and unavoidable. The City Council finds there are no other feasible mitigation measures or alternatives which the Council could adopt at this time which would reduce the impact to less than significant. To the extent that this adverse impact will not be substantially lessened or eliminated, the City Council finds that specific economic, social, or other considerations identified in the Statement of Overriding Considerations support approval of the Project and provide a basis for school planning. i EXHIBIT "B" STATEMENT OF OVERRIDING CONSIDERATIONS - EIR-4-92 The Redding City Council hereby finds that, for the reasons set forth below, the economic, social, and other considerations of the project, outweigh the unavoidable school facilities impacts identified in the findings. First, development of this area would, as a whole, be consistent with the City's objectives that provide for expanded urban growth. Population projections for the region show a continuous level of growth indicating a need for new housing opportunities for the expanding population. Secondly, the impact of development on the community's existing school facilities is viewed by the Council as a Countywide issue, not an issue to be addressed solely through the area plan process. Regional solutions are currently being sought through an interdisciplinary task force. Thirdly, in order to support regionwide goals for air quality, mixed use development as is proposed within the plan area must be considered. The mixed use concept requires a mix of residential densities rather than simply traditional single-family development on large rural lots. These higher densities have the potential to increase the plan area population, thereby adding to the area's student population. Fourthly, urban level densities are necessary to support the extension of the City sewer system, which provides far less impact to the area's water quality than do individual septic systems, and in the long-term will result in less sprawl for the community. Further, while it is recognized that all units of government face problems related to the funding of facilities, it is important to recognize that growth will occur within the metropolitan area, Shasta County, and the State as a whole. The data to support these overriding factors are found within Section III of the EIR, specifically, Sections III.D - Population, III.I - Hydrology, and III.K - Air Quality.
