A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING ENTERING INTO REVISION 1 TO THE THIRD
AMENDMENT TO THE AGREEMENT FOR CARETAKING AND SUPPORT
SERVICES ENTERED INTO BY AND BETWEEN THE CITY OF
REDDING AND BLACK & VEATCH CONSTRUCTION, INC. (C-2843) ,
AND AUTHORIZING THE MAYOR TO SIGN.
WHEREAS, the City of Redding entered into an Agreement for
Caretaking and Support Services with Black & Veatch Construction
Inc. (Black & Veatch) on July 29, 1991 ; Contract No. C-2843 ; and
WHEREAS, with the background Black & Veatch has acquired by
working on the Gas Turbine Project with the City over the past
couple of years, Black & Veatch has the knowledge and expertise
necessary to perform the services which must be replaced due to
the loss of the Project Developer, MLP Energy (MLP) ; and
WHEREAS, by selecting Black & Veatch directly, and modifying
Contract No. C-2843 , the City can eliminate several months ' time
in going through a selection process to acquire the needed
assistance in replacing the functions MLP was to provide in
connection with the Project start-up activities; and
WHEREAS, staff has recommended that the City enter into
Revision 1 to the Third Amendment to said Agreement to expand the
scope of services to include Black & Veatch acting as agent for
the City for the provision and procurement of all materials and
services, not otherwise provided for by existing City/Vendor
contracts, and for securing the coordinating technical
representatives of the major components of the City' s Gas Turbine
Project; and to modify certain terms and conditions in the
Agreement;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council as
follows:

1 . The foregoing recitals are true and correct.
2. Council believes entering into Revision 1 to the Third
Amendment No. C-2843 with Black & Veatch Construction, Inc. will
benefit City Electric Utility customers.
3 . Council hereby waives its Policy No. 1501 pertaining to
the selection of technical consultants inasmuch as time is
critical; and Black & Veatch has the knowledge, background, and
expertise to provide the best services for the least cost.
4. City Council hereby approves Revision 1 to the Third
Amendment to Contract No. C-2843 with Black & Veatch
Construction, Inc.
5. The Mayor is hereby authorized and directed to sign
said Revision 1 on behalf of the City of Redding; and the City
Clerk is directed to attest the signature of the Mayor and to
impress the official seal of the City thereto.
I HEREBY CERTIFY that the foregoing Resolution was
introduced, read, and approved at a regular meeting of the City
Council on the day of 1994, by the following vote:

REVISION 1 TO THE
THIRD AMENDMENT TO
AGREEMENT FOR CARETAKING AND SUPPORT SERVICES
BETWEEN
CITY OF REDDING, CALIFORNIA AND
BLACK & VEATCH CONSTRUCTION, INC.
(REVISED) TASK 4. 4 STARTUP AND ACCEPTANCE TESTING
The following subtasks will be performed to assist the City. The
purpose of the subtasks is to ensure that the facility is capable
of operating in accordance with the contract requirements and that
all guarantees and warranties have been properly demonstrated
and/or documented.
1. Provide all operating procedures and witness the initial
startup, shutdown, and steady state operation of the plant.
2. Provide all test procedures and methods. Witness and monitor
the conduct of all acceptance tests on site and review all
acceptance test reports.
3 . Monitor and review all operational problems, equipment
failures, and acceptance test failures to ensure that all
issues are properly resolved.
4. Act as the City' s Agent to procure and provide all materials
and services not otherwise provided for, and provide oversight
to subcontractors for startup as necessary to complete the Gas
Turbine Project.
5. Act as the City' s Agent in securing and coordinating technical
representatives of the manufacturers of the major components
of the Gas Turbine Project.
6. The total cost for Revised Task 4. 4 shall not exceed $393 ,000.
The expenses authorized here shall include mechanical and
electrical services, electrical tests and certain performance
tests associated with the startup of the Redding Power Plant
Gas Turbine Project.
Black & Veatch will provide public work performance and payment
bonds in the amount requested by the City, and at the expense of
the City, for the performance of the work described in this Task
4. 4 and to secure claims of laborers, mechanics, materialmen, and
other persons as provided by law.
