A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING ENTERING INTO THE AGREEMENT BETWEEN THE CITY OF
REDDING AND THE SHASTA. COUN'T'Y WOMEN'S REFUGE TO PROVIDE
RAPE-CRISIS INTERVENTION SERVICES FOR THE PERIOD JULY 1,
1994, THROUGH JUNE 30, 1995, AND AUTHORIZING THE MAYOR TO
SIGN.
IT IS HEREBY RESOLVED that the City Council of the City of
Redding hereby approves entering into the above-mentioned Agreement
between the City of Redding and the Shasta County Women' s Refuge, a
true copy of which is attached hereto and incorporated herein by
reference.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized and
directed to sign said Agreement on behalf of the City; and the City
Clerk is hereby authorized and directed to attest the signature of
the Mayor and to impress the official seal of the City of Redding
thereto.

A G R E E M E N T
THIS AGREEMENT is made and entered into, effective July 1 ,
1994, by and between the CITY OF REDDING, a Municipal Corporation
and General Law City, hereinafter called "CITY, " and SHASTA
COUN'T'Y WOMEN'S REFUGE, hereinafter called "SCWR" :
W I T N E S S E T H:
WHEREAS, it is the desire of CITY' s Police Department
(hereinafter called "RPD" ) to have professional counselors
available to render rape-crisis intervention services to victims
needing such assistance; and
WHEREAS, SCWR is an organization especially qualified for
such rape-crisis intervention services, having counselors who
possess special training, expertise, and experience in this
field; and
WHEREAS, SCWR has provided these services to the CITY since
1988 , and wishes to continue; and
W EKREAS, it has been determined that this matter is not
subject to the provisions of the California Environmental Quality
Act;
NOW, KFORE, IT IS AGREED by and between the parties
hereto as follows:
1. The term of this Agreement shall be for one ( 1) year,
commencing July 1, 1994, and terminating June 30, 1995.
2. SCWR shall remain on call 24 hours a day during the
term of this Agreement; and when called by the RPD will report as
quickly as possible, but in no event later than one hour after
being contacted by the RPD.
3 . All SCWR Counselors assigned to work with the RPD shall
meet the qualifications listed in the Client Advocate/Rape Crisis
Advocate Job Title attached hereto and incorporated herein by
reference.
4. SCWR will only charge the CITY for Counselor-time spent
for evidence collection, victim interviews, follow-up interviews
at the request of an investigator, and Court appearances, as
necessary.
S. SCWR will be compensated by the CITY for rendering such
aid to victims at the rate of Fifteen Dollars ( $15.00) per hour,
with a minimum of two ( 2) hours per call-out, payable upon
receipt of SCWR' s billing approved by the RPD Chief of Police.
6. It is expressly agreed that in carrying out the terms
of this Agreement, SCWR shall be construed to be an independent
contractor, and nothing in this Agreement is intended nor shall
be construed to create an employer-employee relationship or a
joint venture relationship with the CITY.
7 . This Agreement is granted upon the express condition
that the CITY, its officers, officials, employees, agents, and
volunteers, shall be free from any and all liability and claims
for damages for personal injury, death, or property damage in any
way connected with SCWR' s services under this Agreement,
including claims of SCWR, its officers, agents, employees, and
counselors. SCWR shall indemnify and save harmless the CITY, its
officers, officials, employees, agents, and volunteers, from any
and all liability, loss, cost, or obligation on account of or
arising out of any such injury, death, or loss caused by the
negligence or other legal fault of SCWR or its officers, agents,
employees, and counselors.
8. The SCWR shall procure and maintain for the duration of
this Agreement the following insurance against claims for
injuries to persons or damages to property which may arise from
or in connection with the performance of the services hereunder
by the SCWR, its officers, officials, employees, agents, and
volunteers. The cost of such insurance shall be borne by the
SCWR.

Minimum Scope of Insurance
Coverage shall be at least as broad as:
a. Insurance Services Office Commercial General Liability
coverage (occurrence form CG 0001) . Claims-made form is
also acceptable.
b. Workers ' Compensation insurance as required by the State of
California and Employers ' Liability Insurance.

covering Automobile Liability, owned, non-owned, and hired,
if applicable.
Minimum Limits of Insurance
The SCWR shall maintain limits no less than:
a. General Liability: $1,000,000 per occurrence for bodily
injury, personal injury, and property damage. If Commercial
General Liability Insurance or other form with a general
aggregate limit is used, the general aggregate limit shall
be twice the required occurrence limit.
b. Employer ' s Liability: $1,000,000 per accident for bodily
injury or disease.
C. Automobile Liability: $1,000,000 per accident for bodily
injury and property damage.
Deductibles and Self-Insured Retentions
Any deductibles or self-insured retentions must be declared to
and approved by the City. At the option of the City, either the
insurer shall reduce or eliminate such deductibles or self-
insured retentions as respects the City, its officers, officials,
employees, agents, and volunteers; or the SCWR shall procure a
bond guaranteeing payment of losses and related investigations,
claims administration, and defense expenses.
Other Insurance Provisions
The general liability policy is to contain, or be endorsed to
contain, the following provisions:
a. The City, its officers, officials, employees, agents, and
volunteers, are to be covered as insureds as respects
liability arising out of activities performed by or on
behalf of the SCWR; products and completed operations of the
SCWR; premises owned, occupied, or used by the SCWR; or
automobiles owned, leased, hired, or borrowed by SCWR. The

coverage shall contain no special limitations of the scope
of protection afforded to the City, its officers, officials,
employees , agents, or volunteers.
b. The SCWR' s insurance coverage shall be primary insurance as
respects the City, its officers, officials, employees,
agents, and volunteers. Any insurance or self-insurance
maintained by the City, its officers, officials, employees,
agents, or volunteers, shall be excess of the SCWR' s
insurance and shall not contribute with it.
C. Any failure to comply with reporting or other provisions of
the policies, including breaches of warranties, shall not
affect coverage provided to the City, its officers,
officials, employees, agents, or volunteers.
d. The SCWR' s insurance shall apply separately to each insured
against whom claim is made or suit is brought, except with
respect to the limits of the insurer' s liability.
e. Each insurance policy required by this clause shall be
endorsed to state that coverage shall not be suspended,
voided, cancelled by either party, reduced in coverage or in
limits except after thirty ( 30) days ' prior written notice
has been given to the City.
Acceptability of Insurers
Insurance is to be placed with insurers with a current A.M.
Best' s rating of no less than A:VII .
Verification of Coverage
The SCWR shall furnish the City with Certificates of Insurance
and original endorsements effecting the coverages required by
this paragraph. The endorsements are to be signed by a person
authorized by that insurer to bind coverage on its behalf . All
endorsements are to be received and approved by the City prior to
July 1, 1994, the commencement date hereunder.
9. Either party hereto may cancel this Agreement by giving
thirty ( 30) days ' advance notice in writing to the other party of
its intention to do so.
10. Any notices or demands that may be given by either
party hereunder, including notice of default and notice of
termination, shall be deemed to have been fully and properly
given when made in writing, enclosed in a sealed envelope, and
deposited in the United States Post Office, certified mail,

postage prepaid, addressed as follows: To CITY c/o Chief of
Police, City of Redding, 1313 California Street, Redding,
California 96001; and to SCWR at Post Office Box 994211, Redding,
California 96099-4211.
IN WITNESS WHEREOF, the parties hereto have hereunto
executed this Agreement in the presence of their officers duly
authorized in that behalf on the days and year set forth below.

JOB TITLE : Client Advocate/RaE-,, Crisis Advocate
SUPERVISOR : Client Services Coordinator
SALARY AND
BENEFITS: $4. 66 - 6. 50 per hour and benefits as
defined in the SCWR personnel policy.
SCOPE : The Client. Advocate provides direct client
services to domestic violence and sexual
assualt victims by phone and in the office.
Assists with clerical tasks and statistical
reports.
DUTIES : 1. Answer crisis phones, providing crisis
intervention and referrals.
2. Interview clients - prepare temporary
restraining orders and child custody orders.
3. Attend Family Court, record the court
decisions, and post decisions to client tiles.
4. Provide domestic violence crisis counseling.
5. Attend additional trainings and monthly
inservice meetings as scheduled by the
Client Services Coordinator.
G. Perform advocacy services as required.
7. Complete and turn in required forms and
documentations.
S. Maintain confidentiai.ity of client information
and of the shelter location.
9. Arrange for collection and compilation of
necessary service statistics related to
sexual assault.
10. Other duties as assigned by supervisor.
QUALIFICATIONS : 1. Perceptiveness.
2. Organizational skills.
3. Ability to collect and collate information
into accurate and reasonable statistics.
4. Type accurately at 45 wpm.
5. Some computer skills/computer ability.
G. Experience dealing with women ' s issues.
7. A knowledge of community resources.
S. Ability to work with clients in crisis.
9. Ability to provide reliable
transportation, a certificate of auto
insurance and to transport clients as
needed.
10. Complete the 40 hour sexual assualt and
40 hour domestic violence training and
receive certificates of completion.
11. Ability to communicate effectively both
verbally and in writing.
