IT IS HEREBY RESOLVED that the City Council of the City of Redding hereby approves the Second Amendment to Memorandum of Understanding entered into between the County of Shasta, the City of Redding, the City of Anderson, the City of Shasta Lake, and the Economic Development Corporation of Shasta County, a true copy of which is attached hereto and incorporated herein by reference. BE IT FURTHER RESOLVED that the Mayor of the City of Redding is hereby authorized and directed to sign said Amendment on behalf of the City of Redding; and the City Clerk is hereby authorized and directed to attest the signature of the Mayor and to impress the official seal of the City of Redding thereto. HA S, City Attorney a:mouamend.rso SECOND AMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF SHASTA, THE CITY OF REDDING, THE CITY OF ANDERSON, THE CITY OF SHASTA LAKE, AND THE ECONOMIC DEVELOPMENT CORPORATION OF SHASTA COUNTY LEGAL AUTHOR/TY Previously, the County of Shasta, the City of Redding, and the City of Anderson jointly proposed the designation of portions of their respective jurisdictions as a state Enterprise Zone (Shasta Metro Enterprise Zone) pursuant to Section 7073 of the California Government Code for the purpose of stimulating new employment and investment in economically depressed areas of their respective jurisdictions. The County of Shasta, the City of Redding, the City of Anderson, and the City of Shasta Lake hereinafter known as the "applicants," now intend to jointly propose the designation of portions of their respective jurisdictions as a State Recycling Market Development Zone pursuant to the California Public Resources Code for the purpose of providing incentives to stimulate development of secondary materials business enterprises in areas of their respective jurisdictions. It is the intention of the applicants that the proposed Recycling Market Development Zone have the same boundaries as the existing Shasta Metro Enterprise Zone, as shown on the map attached to and made a part of this Agreement. BACKGROUND In 1990, the Cities of Redding and Anderson, the County of Shasta, and the Economic Development Corporation of Shasta County submitted a joint application to the California Department Commerce (now California Trade and Commerce Commission) for designation of portions of their respective jurisdictions as a state enterprise zone. The designation was approved on November 6, 1991 and the Shasta Metro Enterprise Zone was created with a boundary comprising 50 square miles. In 1993, the enterprise zone was amended on two occasions expanding the present total area to 51 .1 square miles. The applicants committed to providing effective, innovative, and comprehensive, regulatory, tax, program, and other incentives to attract private sector investment to the Shasta Metro Enterprise Zone. In August of 1990, the Cities of Redding and Anderson, the County of Shasta, and the Economic Development Corporation of Shasta County entered into this Memorandum of Understanding for the purpose of assuring their mutual and common understanding of the intent of each party to use their best efforts, subject to the continued availability of financing, to continue and complete long term programs and projects to attract private sector investment to the Shasta Metro Enterprise Zone. Portions of the Shasta Metro Enterprise Zone originally within the Second Amendment to Memorandum of Understanding Between the County of Shasta, the City of Anderson, the City of Redding, and the Economic Development Corporation of Shasta County - Enterprise Zones Page 2 boundaries of the Shasta Dam Area Public Utility District are now within the boundaries of the newly incorporated City of Shasta Lake and the City would now like to be a participating agency in the activities of the enterprise zone and the application for designation as a Recycling Market Development Zone. STATEMENT OF PURPOSE The purpose of this amendment to the Memorandum of Understanding is to expand the commitments made under this Agreement to the proposed Recycling Market Development Zone and to acknowledge the City of Shasta Lake as a participating agency in the active management of both zones. To that end, The County of Shasta, the City of Redding, the City of Anderson, the City of Shasta Lake, and the Economic Development Corporation of Shasta County enter into this Agreement for the purpose of assuring their mutual and common understanding of the intent of each party to use their best efforts, subject to the continued availability of financing, to continue and complete long term programs and projects to attract private sector investment to both the existing Shasta Metro Enterprise Zone and the proposed Recycling Market Development Zone. OBJECT/VES It is mutually agreed that: 1 . The County of Shasta, the City of Redding, the City of Anderson, and the City of Shasta Lake will each provide staff support to administer programs, projects, or incentives provided by their respective jurisdictions within the Shasta Metro Enterprise Zone and proposed Recycling Market Development Zone. The staff of each jurisdiction will coordinate those economic and business development activities related to the Shasta Metro Enterprise Zone and proposed Recycling Market Development Zone through the Shasta County Economic Development Corporation (hereinafter known as the coordinating agency). As a part of this effort, the staff of the County and each City will cooperate with the coordinating agency to work with existing and prospective new businesses to explain the incentives, programs, and projects which may benefit the business, and to identify serious unmet needs or problems facing said businesses. In the event staff identifies a need for financial or job training assistance on the part of a business, the staff person will refer the business to the coordinating agency to arrange action by an entity or agency designated to provide such services. 2. There is hereby established a Policy Board consisting of the chief executive officer, or their designee, from the County of Shasta, the City of Redding, a Second Amendment to Memorandum of Understanding Betwtn the County of Shasta, the City of Anderson, the City of Redding, and the Economic Development Corporation of Shasta County - Enterprise Zones Page 3 the City of Anderson, the City of Shasta Lake, the Economic Development Corporation of Shasta County, and the Private Industry Council, and a seventh member to be selected at large by the other six members. The Policy Board shall review and monitor the progress and activities of the Shasta Metro Enterprise Zone and proposed Recycling Market Development Zone, and shall make such recommendations thereon as it deems appropriate to their respective legislative bodies. 3. The Shasta County Economic Development Corporation will function as the coordinating agency in marketing and promoting the zone areas to businesses and developers (including both those businesses and developers currently operating within the designated areas, and those interested in locating within the designated areas at some future time)• The Shasta County Economic Development Corporation covenants to provide print advertising, print materials, and other promotional activities as needed and feasible, subject to the continued availability of funding from Shasta County, City of Redding, City of Anderson, and the City of Shasta Lake, and such other sources of revenue as may be available to the Economic Development Corporation of Shasta County. 4. To supplement such sources of revenue as are, or may become, available to the Economic Development Corporation of Shasta County, the parties to this Memorandum of Understanding agree to share the costs of marketing and promoting the Shasta Metro Enterprise Zone and Recycling Market Development Zone on the basis of proportion of each agency's industrial and commercial acreage which is included in the zone areas. It is further agreed that the City of Redding's share of costs is thereby established at 45.4%, the County of Shasta's at 42.7%, the City of Anderson's at 6.9%, and the City of Shasta Lake's at 5.0%. The zone acreages and cost sharing percentages shall be reviewed each five years and adjusted as necessary. 5. Amendments to the Shasta Metro Enterprise Zone boundary by adding industrial or commercial property to the zones, shall be approved by the Policy Board. In accordance with State law, additions to the Enterprise Zone shall be limited to 15% of the total area encompassed in the original zone boundaries, and such additions must be approved by the legislative bodies of the general purpose local governments signatory to this Memorandum of Understanding and the California Trade and Commerce Commission. In order to effectuate the purposes of this section, expansion requests shall first be directed to the Zone Policy Board for its review and recommendation to the respective legislative bodies. In reviewing requests for the addition of Second Amendment to Memorandum of Understanding Between the County of Shasta, the City of Anderson, the City of Redding, and the Economic Development Corporation of Shasta County - Enterprise Zones Page 4 territory to the Shasta Metro Enterprise Zone or Recycling Market Development Zone, the Policy Board shall give first priority to that territory which is identified as industrial, second priority to commercial, and shall include only such other property as is necessary to establish contiguity between industrial and commercial properties and the zone boundary. In addition, the Policy Board also shall give priority to that territory which has the greatest potential for the expansion of existing businesses, or for which initial development appears to be eminent. The Policy Board may establish such review processes as it deems appropriate in order to implement these zone expansion provisions. 6. This Memorandum may be amended only by the mutual agreement of all parties in writing. This Memorandum, and any amendments thereof, shall remain in effect until terminated. IN WITNESS WHEREOF, the Parties agree to have executed this Second Amendment to the Memorandum on this day of October, 1994. This Second Amendment shall become effective upon the execution of it by all parties.
