RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL- OF THE CITY OF REDDING
FINDING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
ACQUISITION FOR ROAD PURPOSES A PORTION OF REAL PROPERTY
OWNED BY FRANK L. LITTLE AND DORIS L. LITTLE, COMMONLY
REFERRED TO AS ASSESSOR'S PARCEL NUMBER 071-270-07.
BE IT RESOLVED by the City Council of the City of Redding
(hereinafter referred to as "City" ) as follows:
Section 1. The City finds and determines that public
convenience and necessity require the extension by the City of
Redding of public improvements, namely the extension of Browning
Street, by the acquisition for roadway purposes of a fee interest
in a portion of the real property owned by Frank L. Little and
Doris L. Little commonly referred to as A.P.N. 071-270-07 .
Section 2 . Section 4090 of Streets and Highways Code
authorizes the City to acquire the necessary real property
interests for said street widening by eminent domain.
Section 3 . An offer required by section 7267 . 2 of the
Government Code has been made to the owner or owners of record of
the real property sought to be taken by these eminent domain
proceedings.
Section 4 . The City finds and determines that the subject
project has been planned and is to be located in the manner that
will be most compatible with the greatest public good and the
least private injury.
Section 5 . The City finds and determines that the
acquisition of the real property interests depicted in Exhibit
"A" attached hereto, situate in the City of Redding, County of
Shasta, State of California, are necessary for the construction
and maintenance of the aforesaid public improvement, and the
taking of said real property interests is necessary therefor.
Section 6 . The City finds and determines that the Final
Supplement to Environmental Impact Report ETR-3-81-Amended Canby-
Hilltop-Cypress Redevelopment Project has considered the

environmental impacts, if any, and mitigation measures, if any,
for the extension of Browning Street.
Section 7 . The City Attorney of the City of Redding is
hereby authorized, empowered, and directed to perform as follows:
a. Commence an action or actions in eminent domain in the
Superior Court of the State of California, County of
Shasta, in the name of the City of Redding to acquire
necessary real property interests; and
b. To incur in the name of the City of Redding, and on
behalf thereof, all obligations and expenses necessary
to acquire the above-mentioned real property interests.
Section 8. The City Clerk of the City of Redding is hereby
directed to cause a certified copy of this Resolution to be
recorded in the office of the Shasta County Assessor/Recorder.
I HEREBY CERTIFY that the foregoing Resolution was
introduced and read at a regular meeting of the City Council of
the City of Redding on the 16th day of August, 1994, and was duly
adopted at said meeting by at least a four-fifths vote as
follows:

Legal Description
All that real property situate in the Northeast one-quarter
of Section 32, Township 32 North, Range 4 West, M.D.M. , in
the City of Redding, County of Shasta, State of California,
being two portions of Parcel 2, as shown on that certain map
recorded June 29, 1979 in Book 18 of Parcel Maps at page
115, Shasta County Records, more particularly and separately
described as follows:
PARCEL A: Commencing at a 6"x 6" concrete monument marked RE
5438 at the northwest corner of the south one-half of the
northeast one-quarter of said Section 32, as shown on said
map; thence along the west line of said Parcel 2 as shown on
said map, South 01'24'45" East (South 01'34'45" East per
said 18 PM 115) , 56.52 feet to the POINT OF BEGINNING;
thence South 56"44'48" East 98.22 feet; thence along a curve
to the right having a radius of 730.00 feet and a central
angle of 20'44'27", an arc distance of 264.26 feet to a
point on the boundary line of said Parcel 2, said point
hereinafter referred to as Point "A"; thence along said
boundary line, North 88"25'53" West (North 88"35'45" West
per 18 PM 115) , 77.83 feet; thence leaving said boundary
line, from a tangent bearing North 40"04'03" West, along a
curve to the left having a radius of 670.00 feet and a
central angle of 16'40'45", an arc distance of 195.04 feet;
thence North 56'44'48" West, 56.73 feet to a point on. the
west line of said Parcel `2; thence along said west line,
North 01'24'45" West (North 01'34'45" West per 18 PM 115) ,
72.95 feet, back to the Point of Beginning, containing
18,443 square feet, more or less.
PARCEL A-1 : An easement for slope protection and maintenance
purposes 12.00 feet wide, measured at right angles or
radially, being that portion of Parcel 2 per said Book 18
Parcel Maps, page 115, lying southwesterly of, and
contiguous to the above described Parcel A, containing 2,886
square feet, more or less.
PARCEL A-2: An easement for slope protection and maintenance
purposes 12.00 feet wide, measured at right angles or
radially, being that portion of Parcel 2 per said Book 18
Parcel Maps, page 115., lying northeasterly of, and
contiguous to the above described Parcel A, containing 4,480
square feet, more or less.

PARCEL A-3: A temporary easement for c=onstruction 'purposes
10.00 feet wide, measured at right angles or radially, being
those portions of Parcel 2 per said Book 18 Parcel Maps,
page 115, lying southwesterly of, and contiguous to the
above described Parcel A-1 , and also lying northeasterly of,
and contiguous to the above described Parcel A-2, containing
6, 130 square feet, more or less.
The sidelines of the above described easements shall be
lengthened or shortened so as to begin and terminate on the
respective boundary lines of the aforementioned Parcel 2 per
Book 18 Parcel Maps, page 115.
PARCEL B: Commencing at hereinbefore described Point A;
thence along the boundary line of Parcel 2 per said Book 18
Parcel Maps, page 115, South 33"25'53" East (South 88'35'45"
East per said 18 PM 115) , 32.05 feet; thence South 01'34'07"
West (South 01'24' 15" West per 18 PM 115) 45 .01 feet to the
POINT OF BEGINNING; thence leaving said boundary line from . a
tangent bearing South 31 '39'42" East, along a curve to the
right having a radius of 730.00 feet and a central angle of
13'07'54", an arc distance of 16:.31 feet; thence South
18'31 '49" East 66.61 feet, to a point on the northerly line
of Old Alturas Road as shown on said map; thence along said
northerly line, from a tangent bearing South 66'25'34" West,
along a curve to the left having a radius of 280.00 feet and
a central angle of 10'59' 10", an arc distance of 53.69 feet;
thence -South 55'26'02" West 7.59 feet; thence leaving said
northerly line , North 18'31 '49" West 73.51 feet; thence
along a curve to the lett having a radius of 670 .00 feet and

PARCEL B-1 : An easement for slope protection and maintenance

Parcel Maps, page 115, lying southwesterly of, and
contiguous to the above described Parcel B, containing 1,382
square feet, more or less.

PARCEL B-2: An easement for slope protection and maintenance
purposes 12.00 feet wide, measured at right angles or
radially, being that portion of Parcel 2 per said Book 18
Parcel Maps, page 115, lying northeasterly of, and
contiguous to the above described Parcel B, containing 2,926
square feet, more or less.
PARCEL B-3: A temporary easement for construction purposes
10.00 feet wide, measured at right angles or radially, being
those portions of Parcel 2 per said Book 18 Parcel Maps,
page 115, lying southwesterly of, and contiguous to the
above described Parcel B-1 , and also lying northeasterly of,
and contiguous to the above described Parcel B-2, containing
3,526 square feet, more or less .
The sidelines of the above described easements shall be
lengthened or shortened so as to begin and terminate on the
respective boundary lines of the aforementioned Parcel 2 per
Book 18 Parcel Maps, page 115.
