RESOLUTION NO. 94- 3 d 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING ORDERING THE VACATION AND ABANDONMENT OF THAT PORTION OF THE OASIS ROAD RIGHT-OF-WAY, DECLARED SURPLUS, SHOWN ON THE MAP AND DESCRIBED IN EXHIBIT A ATTACHED HERETO, AND LYING ADJACENT TO PROPERTY LOCATED AT 4455 OASIS ROAD (A-6-93) . WHEREAS, proceedings have been duly conducted and held in accordance with the provisions of the Public Streets, Highways, and Service Easements Vacation Law, Streets and Highways Code Section 8300 , et seq. ; and WHEREAS, the Council finds and determines that, subject to the conditions set forth in Exhibit B attached hereto and made a part hereof, said portion of street right-of-way, declared surplus, is not necessary for present or prospective street right-of-way purposes; NOW, THEREFORE, the City Council of the City of Redding hereby FINDS, RESOLVES, AND ORDERS as follows: 1. The Council makes the following findings in connection herewith: (a) The project is compatible with the Redding General Cy Plan; a Ltl c�'('•'c3� PACE 28? (b) The project will not significantly alter the existing land form; (c) The project is compatible with the surrounding land use; and (d) The project is compatible with the Redding Municipal Code. 2. The following surplus street right-of-way located in the City of Redding, County of Shasta, State of California, namely: that portion of Oasis Road located adjacent to property located at 4455 Oasis Road as more particularly described in Exhibit A and shown on the map attached hereto and incorporated herein by reference, be and hereby is vacated and abandoned as a street right-of- way: EXCEPTING AND RESERVING THEREFROM, pursuant to the provisions of Section 8340 of the Streets and Highways Code, and for the benefit of Pacific Gas and Electric Company, the permanent easement and right at any time and from time-to- time to construct, reconstruct, maintain, operate, replace, remove, repair, renew, and enlarge lines of conduits, cables, wires, poles, electrical conductors, and other convenient structures, equipment, and fixtures for the operation of electric and communication facilities, including access, and also the rights to: trim and cut trees and brush that may be a hazard to the facilities; keep property free from inflammable materials; and prevent any building or structure near the facilities; AND SUBJECT TO THE FOLLOWING CONDITIONS: (a) A slope easement shall be retained by the City for the purpose of accommodating necessary fill to construct Oasis Road to its ultimate improved section; and (b) The applicant/future property owner shall assume all responsibility for costs associated with the relocation or reconstruction of the existing utility services necessary to accommodate development of the area of abandonment; this shall include any necessary raising 2 cr( .'3231PAGL,283 of existing pole structures to maintain adequate clearance between power lines and grade resulting from the placement of fill; and (c) The applicant/future property owner shall construct or enter into a recorded deferred-improvement agreement with the City for vertical curb, gutter, 5-foot-wide sidewalk, street construction, and tie-in paving and overlay along the Oasis Road frontage of the abandonment area. 3 . The City Clerk is directed to record a certified copy of this Resolution, attested to by the City Clerk under the seal of the City of Redding, in the office of the Shasta County Assessor/Recorder.
